Description

1 / 39 “RINSE-OFF HAIR COSMETIC COMPOSITION, HAIR TREATMENT METHOD, METHOD FOR PROVIDING IMPROVED CURL DEFINITION AND USE OF A COMPOSITION” Field of Invention

[001] The present invention relates to rinse-off hair cosmetic compositions comprising (a) at least one organic acid, (b) a non-aqueous solvent comprising at least one compound with at least one hydroxyl group, (c) at least one amino acid, (d) at least one fatty compound selected from vegetable oils, vegetable resins, vegetable waxes and mixtures thereof, (e) water and (f) at least one surfactant selected from cationic surfactants, nonionic surfactants and mixtures thereof. The invention also relates to a method of treating hair, particularly curly hair, to a method for providing improved curl definition to hair and to the use of a composition for making a rinse-off hair care product to provide improved curl definition. Background of the Invention

[002] People have used various cosmetic and personal care compositions to improve the appearance and texture of keratin fibers, such as hair.

[003] Particularly with regard to curly hair, consumers are always dealing with problems related to curl definition, such as frizz, volume, and shape. Curly hair tends to frizz and increase significantly in volume when exposed to high humidity, chemical treatments, and other factors. In addition, the shape and definition of curls are lost after sleep.

[004] Many attempts have been made to develop products that would discipline, define and control hair, especially Petition 870250091691, dated 07 / 10 / 2025, page 47 / 94 2 / 39 curly hair, enhancing / maintaining the definition, retention and regularity of curls, without leaving the hair feeling artificial and stiff, but such products resulted in additional problems or difficulties in maintenance.

[005] For example, state-of-the-art products generally require a large amount of product to provide good combability and feel to the hair. However, considering that the effect of these products is not long-lasting, consumers need to reapply them several times a day or after sleeping to regain definition and frizz control, which results in product buildup on the hair surface, resulting in a heavy, wet look, artificial feel and oily sensation, since such products do not penetrate the keratin fibers and remain on the surface of the hair fiber.

[006] In this sense, there is a need in the market for curly hair products that define curls in a lasting way, without the need to reapply the product until the next wash or after sleeping, also reducing the need to use large amounts of product between washes.

[007] In addition, the standard routine for curly hair includes the use of various cosmetic products throughout the length of the hair and must be reset every two days, as curls tend to lose definition and a vibrant appearance after this period - it is a rather time-consuming routine, which involves consumers restarting all steps every two days, including washing their hair and applying different cosmetic products.

[008] Therefore, it is desirable to have a rinse-out hair cosmetic for curly hair that not only helps define curls but also offers long-lasting cosmetic benefits to the consumer's hair, such as frizz resistance, shine, ease of application, and does not leave hair feeling wet or heavy, which improve with continued use of the product. There are Petition 870250091691, dated 07 / 10 / 2025, page 48 / 94 3 / 39 also the need for rinse-out hair cosmetics for curly hair to reduce the amount of product used by the consumer and prolong the effects of the formula, so that the consumer can gain extra days before having to restart their curly hair cosmetics routine.

[009] The inventors of the present invention have surprisingly and unexpectedly obtained rinse-out cosmetic hair compositions, particularly designed for curly hair, comprising (a) at least one organic acid, (b) a non-aqueous solvent comprising at least one compound with at least one hydroxyl group, (c) at least one amino acid, (d) at least one fatty compound selected from vegetable oils, vegetable resins, vegetable waxes and mixtures thereof, (e) water and (f) at least one surfactant selected from cationic surfactants, nonionic surfactants and mixtures thereof, which are capable not only of penetrating the hair fiber without accumulating on the fiber surface, while providing curl definition until the next wash, long-lasting curl definition, frizz control, natural appearance and desirable volume, and which do not feel heavy on the hair, but also provide cosmetic benefits such as shine,Smooth feel and spreadability. [0124] As used in this document, the term “rinse-off” refers to a composition that is rinsed and / or washed with water after or during application of the composition to the hair and before drying and / or styling. At least part of the composition is removed from the hair during rinsing and / or washing.

[0125] “Conditioner”, as used in this document, means a product / composition capable of imparting to one or more hair fibers at least one property chosen from combability, moisture retention, shine, luminosity, and softness. The conditioning state can be evaluated by any means known in the state of the art, such as, for example, measuring and comparing the ease of combing the hair. Petition 870250091691, dated 07 / 10 / 2025, pp. 72 / 94 27 / 39 treated and untreated hair in terms of styling work (gm-in) and consumer perception.

[0126] The term “treatment” (and its grammatical variations), as used in this document, refers to the application of the compositions of this disclosure to the surface of the hair. The term “treat” (and its grammatical variations), as used here, also refers to the contact of the hair with the compositions of this disclosure.

[0127] As used herein, the expression “at least one” means one or more and therefore includes individual components as well as mixtures / combinations.

[0128] Except in operational examples, or where otherwise indicated, all numbers expressing quantities of ingredients and / or reaction conditions should be understood as modified in all cases by the term “about”, meaning within + / - 5% of the number indicated.

[0129] As used herein, all ranges provided must include each specific range within the ranges provided and the combination of sub-ranges between them. Thus, a range of 1 to 5 specifically includes 1, 2, 3, 4, and 5, as well as sub-ranges such as 2 to 5, 3 to 5, 2 to 3, 2 to 4, 1 to 4, etc. All ranges and values disclosed herein are inclusive and combinable. For example, any value or point described herein that falls within a range described herein may serve as a minimum or maximum value to derive a sub-range, etc.

[0130] The term “substantially free” or “essentially free,” as used herein, means that there is less than about 5% by weight of a specific material added to a composition, based on the total weight of the compositions. However, compositions may include less than about 2% by weight, less than about 1% by weight, less than about 0.5% by weight, less than about 0.1% by weight, less than 0.01% by weight, or none of the above. Petition 870250091691, dated 07 / 10 / 2025, pp. 73 / 94 28 / 39 materials specified.

[0131] The term “active material”, as used here in relation to the percentage quantity of an ingredient or raw material, refers to 100% activity of the ingredient or raw material.

[0132] “Cosmetically acceptable” means that the item in question is compatible with a keratinous substrate, such as skin and hair. For example, a “cosmetically acceptable vehicle” means a vehicle that is compatible with a keratinous substrate, such as skin and hair.

[0133] The term “hair cosmetic composition”, as used herein, may also refer to a composition for styling or shaping hair, or to a composition for hair care or hair treatment.

[0134] The term “cationic surfactant” means a surfactant with a positive charge. This surfactant may have one or more permanent positive charges or may contain one or more cationizable functions in its composition, according to the disclosure.

[0135] Throughout the disclosure, the term “a combination of the same” (or a mixture of the same) may be used after a list of elements, as shown in the following example, where the letters AF represent the elements: “one or more elements selected from the group consisting of A, B, C, D, E, F and a combination thereof”. The term “a combination thereof” does not require that the combination include all elements A, B, C, D, E, and F (although all elements A, B, C, D, E, and F may be included). Instead, it indicates that a combination of any two or more elements A, B, C, D, E, and F may be included. In other words, it is equivalent to the phrase “one or more elements selected from the group consisting of A, B, C, D, E, F and a combination of any two or more elements A, B, C, D, E, and F”. Petition 870250091691, dated 07 / 10 / 2025, pp. 74 / 94 29 / 39

[0136] Similarly, the term “a salt of the same” also refers to “salts of the same”. Thus, when the disclosure refers to “an element selected from the group consisting of A, B, C, D, E, F, a salt of the same and a combination thereof”, it indicates that one or more of A, B, C, D and F may be included, one or more of a salt of A, a salt of B, a salt of C, a salt of D, a salt of E and a salt of F may be included, or a combination of any two of A, B, C, D, E, F, a salt of A, a salt of B, a salt of C, a salt of D, a salt of E and a salt of F may be included.

[0137] The salts mentioned throughout the disclosure may include salts with a counter-ion, such as an alkali metal, alkaline earth metal, or ammonium counter-ion. This list of counter-ions, however, is not exhaustive.

[0138] Some of the compounds discussed throughout the disclosure may be in the form of a salt in the composition or added to the composition in the form of a salt (and dissociate in the composition). Thus, all compounds and quantities of compounds refer to both the salt form of the compound and the dissociated form of the compound. In other words, even if the expression “a salt of the same” is not specifically or expressly stated in relation to ingredients that can form salts or are available as salts, it is understood that the salt form of the compound is included.

[0139] The term “inclusive” for a range of concentrations means that the limits of the range are included within the defined interval.

[0140] Except in operational examples, or where otherwise indicated, all numbers expressing quantities of ingredients and / or reaction conditions should be understood as modified in all cases by the term “approximately”, meaning within + / - 5% of the number indicated.

[0141] The term “INCI” is an abbreviation for International Nomenclature of Cosmetic Ingredients, which is a naming system provided Petition 870250091691, dated 07 / 10 / 2025, pp. 75 / 94 30 / 39 by the International Nomenclature Committee of the Personal Care Products Council to describe personal care ingredients.

[0142] All components and elements positively set forth in this disclosure may be negatively excluded from the claims. In other words, the compositions of this disclosure may be free or essentially free of all components and elements positively mentioned throughout this disclosure.

[0143] Some of the various categories of components identified may overlap. In such cases, where overlap may occur and the composition includes both components (or the composition includes more than two overlapping components), an overlapping component or ingredient does not represent more than one component. For example, if a polyacrylate falls under the description of a thickening polymer and the description of a film-forming polymer, the specifically mentioned polyacrylate is understood to be either only the thickening polymer or only the film-forming polymer. A specific polyacrylate cannot be interpreted simultaneously as both a thickening polymer and a film-forming polymer, for example, when the claims establish both a thickening polymer and a film-forming polymer (even though the polyacrylate may function as both a thickening polymer and a film-forming polymer). In other words, a single compound or ingredient cannot simultaneously serve as two different components of a claimed composition.

[0144] All publications and patent applications cited in this descriptive report are incorporated herein by reference, and for all purposes, as if each individual publication or patent application were specifically and individually indicated for incorporation by reference. In case of inconsistency between this disclosure and any publications or patent applications incorporated herein by reference, this disclosure shall prevail. However, when using the Violet pigment, composition of Ex. 2, the setting shows a tendency towards superiority in setting (T24) and lasting setting (TAT and TAP). Test 2 - In vitro tests of definition and control of volume and frizz in HAIR SAMPLES - MASK

[0158] The rinse-off hair cosmetic composition, according to Example 1 of the present invention, was compared to a prior art mask composition comprising water, cetearyl alcohol, dimethicone, glycerin, behentrimonium chloride, fragrance, lactic acid, hydroxycitronellal, sodium hydroxide, hydrolyzed wheat protein with Petition 870250091691, dated 07 / 10 / 2025, pp. 82 / 94 37 / 39 hydroxypropyltrimonium, hydrolyzed rice protein, phenoxyethanol, arginine, limonene, benzyl salicylate, linalool, benzyl alcohol, pentylene glycol, amodimethicone, isopropyl alcohol, 2-oleamido-1,3-octadecanediol, serine, cetrimonium chloride, citronellol, coumarin, hexyl cinnamal and amyl cinnamal.

[0159] The composition of Example 1 and the state-of-the-art composition were applied to samples of virgin curly hair (three 2.7 gram samples per composition) after the steps of contacting the hair with a shampoo and a conditioner, and were evaluated according to a curl definition score (from 0 to 10) 24 hours after hair treatment (T24), 24 hours after breaking the stiff effect (running fingers through the hair (TAT) and after combing the TAT sample (TAP). The definition measurement was performed using image data. The results are presented in Figure 2A for various periods between application to the hair and removal from the hair, including no time between application of the composition to the hair and removal from the hair (0 min), 1 minute between application of the composition to the hair and removal from the hair (1 min), 3 minutes between application of the composition to the hair and removal from the hair (3 min), and 5 minutes between application of the composition to the hair and removal from the hair (5 min).

[0160] Additionally, the composition of Ex. 1 and the state-of-the-art composition were applied to samples of virgin curly hair (three 2.7 gram samples per composition) after the hair had been in contact with a shampoo and a conditioner and were evaluated for volume and frizz control. Measurement data were generated by a trained panel and the score ranges from 1 to 4 in 0.5 increments, where 4 is the highest score (best value). The results are presented in Figure 2B.

[0161] As demonstrated in Figures 2A and 2B, the rinse-out hair care composition of Ex. 1 of the present invention, used as a mask, shows superior results in volume and frizz control in Petition 870250091691, dated 07 / 10 / 2025, pp. 83 / 94 38 / 39 any time between application of the composition to the hair and removal from the hair (0, 1, 3 or 5 min), compared to the reference mask with 5 min between application of the composition to the hair and removal from the hair. In terms of definition performance, the composition of Ex. 1 of the present invention, when used as a mask without a time limit (application followed by rinsing), already shows definition equal to that of the reference with 5 min between application of the composition to the hair and removal from the hair. Furthermore, when it comes to longer times between application of the composition to the hair and removal from the hair (1, 3 or 5 min), the composition of Ex. 1 of the present invention shows superior definition. Test 3 - In vitro tests of definition and control of volume and frizz in HAIR SAMPLES - MASK WITH PIGMENT

[0162] The rinse-off hair cosmetic composition, according to Example 2 of the present invention, was compared to a prior art mask composition comprising water, cetearyl alcohol, dimethicone, glycerin, behentrimonium chloride, fragrance, lactic acid, hydroxycitronellal, sodium hydroxide, hydroxypropyltrimonium hydrolyzed wheat protein, hydrolyzed rice protein, phenoxyethanol, arginine, limonene, benzyl salicylate, linalool, benzyl alcohol, pentylene glycol, amodimethicone, isopropyl alcohol, 2-oleamido-1,3-octadecanediol, serine, cetrimonium chloride, citronellol, coumarin, hexyl cinnamal and amyl cinnamal.

[0163] The composition of Example 2 and the state-of-the-art composition were applied to samples of virgin curly hair (three 2.7 gram samples per composition) after the steps of contacting the hair with a shampoo and a conditioner, and were evaluated according to a curl definition score (from 0 to 10) 24 hours after hair treatment (T24), 24 hours after breaking the stiff effect (running fingers through the hair (TAT) and after combing the TAT sample (TAP). The measurement of definition Petition 870250091691, dated 07 / 10 / 2025, pages 84 / 94 39 / 39 was performed using image data. The results are presented in Figure 3A for various periods between application of the composition to the hair and removal of the hair, including no time (0 min), 1 minute between application of the composition to the hair and removal of the hair (1 min), 3 minutes between application of the composition to the hair and removal of the hair (3 min), and 5 minutes between application of the composition to the hair and removal of the hair (5 min).

[0164] In addition, the composition of Ex. 2 and the state-of-the-art composition were applied to samples of virgin curly hair (three 2.7 gram samples per composition) after the hair contact steps with shampoo and conditioner, and were evaluated according to volume and frizz control. Measurement data were generated by a trained panel and the score ranges from 1 to 4 in 0.5 increments, where 4 is the highest score (best value). The results are presented in Figure 3B.

[0165] The data show that the composition of Ex. 2, with a 3-minute interval between application of the composition to the hair and removal of the hair, presents the same result in immediate definition (T24) as the standard routine, with 5 minutes between application of the composition to the hair and removal of the hair, but loses in long-lasting definition (TAT and TAP) (Figure 3A). In volume and frizz control (Figure 3B), all times between application of the composition to the hair and removal of the hair demonstrate superiority.
