[0001] The present invention relates to a new process for producing 4- (4-fluoro-2-methyl-phenyl) -5-nitro-1H-pyridin-2-one, a key intermediate of 2- [3, 5-bis (trifluoromethyl) phenyl] -N- {4- (4-fluoro-2-methylphenyl) -6- [ (7S, 9aS) -7- (hydroxymethyl) hexahydropyrazino [2, 1-c] [1, 4] oxazin-8 (1H) -yl] pyridin-3-yl} -N, 2-dimethylpropanamide (elinzanetant) .Background of the Invention

[0002] 2- [3, 5-bis (trifluoromethyl) phenyl] -N- {4- (4-fluoro-2-methylphenyl) -6- [ (7S, 9aS) -7- (hydroxymethyl) hexahydropyrazino [2, 1-c] [1, 4] oxazin-8 (1H) -yl] pyridin-3-yl} -N, 2-dimethylpropanamide (herein also referred to by its INN: elinzanetant) is being developed for treatment of different diseases and conditions (WO 2007 / 028654 A1) , including sex-hormone dependent diseases and disorders (WO 2016 / 184829 A1) . Elinzanetant is a dual neurokinin-1 (NK-1) receptor antagonist and neurokinin-3 (NK-3) receptor antagonist (also referred to as dual NK-1 / NK-3 receptor antagonist) . Elinzanetant is the compound of Formula (I) :

[0003] The prior-art production of elinzanetant comprises the compound of Formula (II) or salts thereof as a central intermediate and precursor for obtaining the final product; see WO 2021 / 094247 A1:

[0004] In WO 2021 / 094247 A1 the production of the compound of Formula (II) and the hydrochloride salt thereof is performed sequentially via a chlorination using phosphoryl chloride and a final reduction of the nitro group of the compound of Formula (III) (4- (4-fluoro-2-methyl-phenyl) -5-nitro-1H-pyridin-2-one) .

[0005] 4- (4-fluoro-2-methyl-phenyl) -5-nitro-1H-pyridin-2-one (Compound of Formula (III) ) , and a method for its preparation was first disclosed in WO 2021 / 094247 A1. However, the methods of prior art suffer from low yield and high costs with a consequential impact on the overall cost of synthesis of the compound of Formula (III) and subsequent products, such as elinzanetant. In prior art, the compound of Formula (III) is synthesized through a palladium catalyzed Suzuki-Miyaura cross-coupling of 4-fluoro-2-methylphenyl boronic acid (compound of Formula (IV) )

[0006] and 4-chloro-5-nitropyridin-2 (1H) -one (compound of Formula (V) ) , resulting in only 60%purity of the compound of Formula (III) .

[0007] The synthesis of the compound of Formula (V) is disclosed in e.g.: R. A Stavenger, et. al, J. Med. Chem. 2007, 50, 2-5; A. T. Plowright, Med. Chem. Commun., 2013, 4, 151-158; and WO2005 / 037197 A2. The synthesis of the compound of Formula (V) comprises an oxidation at very low temperatures (-60℃) . Such steps at very low temperatures are at least unfavorable in the industrial scale, in particular with regards to costs of goods and conversion costs.

[0008] For medicinal products, it is necessary to safeguard that the products contain a minimum proportion of impurities / byproducts. Further, the presence of impurities leads to reduced quality of the product and to a loss of yield. Further, cumbersome crystallization processes may be needed to deplete the impurities, but they are accompanied by a loss of yield.

[0009] Hence, there is a need for the provision of an improved synthesis of the compound of Formula (III) and subsequently the compound of Formula (II) which reduces costs and impurities and provides for the possibility of upscaling to an industrial applicable scale.

[0010] The inventors of the present invention have found that the method to prepare the compound of Formula (III) according to the process of the present invention results in a high quality product (intermediate) with drastically decreased content of byproducts, i.e. resulting in a higher purity of the desired product. In addition, the process allows for the production of the compound of Formula (III) on industrial scale with decreased cost of goods and energetical efforts.

[0011] The synthesis process involving the steps of the present invention may start with a 1, 4-addition of a nitromethylene source to the Michael system of a cinnamate of Formula (VI)

[0013] The inventors found that 4- (4-fluoro-2-methyl-phenyl) -5-nitro-1H-pyridin-2-one can be obtained by oxidizing 4- (4-fluoro-2-methyl-phenyl) -5-nitro-3, 4-dihydro-1H-pyridin-2-one with an iodide in the presence of a sulfur containing oxidizing agent. The use of the combination of an iodide in the presence of a sulfur containing oxidizing agent and optionally a radical initiator allowed for the efficient production of 4- (4-fluoro-2-methyl-phenyl) -5-nitro-1H-pyridin-2-one, while other conditions resulted either in the degradation of the starting material (compound of Formula (IX) ) or incomplete or no conversion; see screening efforts summarized in Table 2 in the Examples section, below.

comprising the step of allowing 4- (4-fluoro-2-methyl-phenyl) -5-nitro-3, 4-dihydro-1H-pyridin-2-one of Formula (IX)to react with an iodide in the presence of a sulfur containing oxidizing agent and optionally a radical initiator.2.The method according to claim 1, wherein 4- (4-fluoro-2-methyl-phenyl) -5-nitro-3, 4-dihydro-1H-pyridin-2-one is allowed to react with trimethylsilyl iodide in the presence of DMSO.3.A method of preparing 4- (4-fluoro-2-methyl-phenyl) -5-nitro-3, 4-dihydro-1H-pyridin-2-one of Formula (IX) comprising the step of allowing 3- (4-fluoro-2-methyl-phenyl) -4-nitro-butanamide (compound of Formula (VIII) )to react with a with a C1-synthon in the oxidation state of formic acid in the presence of a base.4.The method according to claim 3, wherein the C1-synthon in the oxidation state of formic acid is dimethylformamide dimethylacetal (DMF-DMA) or tert-butoxy bis(dimethylamino) methane.5.The method according to claim 3 or 4, wherein the base is selected from the group consisting of DBN, 1, 8-diazabicyclo [5.4.0] undec-7-ene (DBU) , diisopropyl ethyl amine (DIPEA) , piperidine, and potassium carbonate.6.The method according to any one of claims 3 to 5, wherein the C1-synthon in the oxidation state of formic acid is DMF-DMA, and wherein the base is DBU.7.The method according to any one of claims 3 to 6, wherein the method further comprises the step of preparing 3- (4-fluoro-2-methyl-phenyl) -4-nitro-butanamide by allowing a compound of Formula (VII) wherein R1 is a C1-to C4-alkyl or optionally substituted phenyl,to react with an optionally N-protected nitrogen nucleophile in the presence of a base and, optionally, in the presence of a source of cyanide ions.8.The method according to claim 7, wherein the base is an alkali C1-C4-alkoxide.9.The method according to claim 7 or 8, wherein the base is sodium methoxide.10.The method according to any one of claims 7 to 9, wherein R1 is ethyl.11.The method according to any one of claims 7 to10, wherein the optionally N-protected nitrogen nucleophile is selected from the group consisting of ammonia, NH3·BH3, NaNH2·BH3, formamide, tert-butyl amine, allylamine, and hexamethyldisilazan (bis (trimethylsilyl) amine or HMDS) , or its derivatives.12.The method according to any one of claims 7 to 11,wherein R1 is ethyl,wherein the base is sodium methoxide, andwherein the optionally N-protected nitrogen nucleophile is formamide.13.The method according any one of claims 3 to 12, wherein the method further comprises the step of preparing the compound of Formula (VII) by allowing a cinnamate of Formula (VI)wherein R1 is a C1-to C4-alkyl or optionally substituted phenyl,to react with a nitromethylene source in the presence of a base, and optionally a phase transfer catalyst.14.The method according to any one of claims 13, wherein the nitromethylene source is selected from the group consisting of nitromethane, nitroacetic acid, and nitromalonic acid.15.The method according to claim 13 or 14, wherein the nitromethylene source is nitromethane.16.The method according to any one of claims 13 to 15, wherein the base is selected from the group consisting of lithium hexamethyl disilazide, sodium hexamethyl disilazide, potassium hexamethyl disilazide, phosphazines, amidines, and guanidines (such as 8-diazabicyclo [5.4.0] -undec-7-ene (DBU) , 7-methyl-1, 5, 7-triazabicyclo (4.4.0) dec-5-ene (MTBD) , diisopropyl ethyl amine (DIPEA) , 1, 5-diazabicyclo (4.3.0) non-5-ene (DBN) , diethyl phosphazine, 1, 1, 3, 3-tetramethylguanidine, and salts in which the anion is selected from the group consisting of carbonate, bicarbonate, mono-, and bi-or tri phosphate bases, and in which the cation is selected from the group consisting of sodium, potassium, lithium and cesium.17.The method according to any one of claims 13 to 16, wherein the base is K2CO3..18.The method according to claim 17, wherein TBAB is additionally present as a phase transfer catalyst.19.The method according to any one of claims 13 to 18, wherein R1 is ethyl.20.The method according to any one of claims 13 to 19,wherein the nitromethylene source is nitromethane,wherein the base is K2CO3 in the presence of TBAB as phase transfer catalyst, andwherein R1 is ethyl.21.The method according to claim 1 or 2 further comprising the preparation of 4- (4-fluoro-2-methyl-phenyl) -5-nitro-3, 4-dihydro-1H-pyridin-2-one according to any one of claims 3 to 20.22.A method of preparing 6-chloro-4- (4-fluoro-2-methylphenyl) pyridin-3-amine of Formula (II) comprising the method according to any one of claims 1, 2 or 21, and the step of chlorinating the compound of Formula (III)by allowing it to react with suitable chlorinating agent,and the step of converting the nitro group into an amino group to obtain 6-chloro-4- (4-fluoro-2-methylphenyl) pyridin-3-amine, andoptionally converting the 6-chloro-4- (4-fluoro-2-methylphenyl) pyridin-3-amine into a salt thereof.23.The method according to claim 22, wherein the chlorinating agent is POCl3.24.The method according to claim 22 or 23, wherein the conversion of the nitro group into the amino group is conducted with Raney-Nickel.25.A compound of Formula (VII) :
