The risk of communication congestion when a communication device transmits or receives data is reduced. [Solution] A communication device 1 according to one embodiment of the present invention has a receiving unit 121 that receives congestion information indicating the communication congestion status in each of a plurality of areas, an identification unit 122 that identifies the area among the plurality of areas in which the communication device is located, a judgment unit 123 that determines whether or not to wait for the communication device to send or receive data based on the congestion status indicated by the congestion information and the congestion status of the area identified by the identification unit, and a communication control unit 124 that sends or receives data on the condition that the judgment unit has determined not to wait for transmission or reception, and after determining to wait for transmission or reception, the judgment unit again determines whether or not to wait for transmission or reception of data based on the congestion status in the area in which the communication device is located when a re-determination condition for re-determining whether or not to wait for transmission or reception of data is met.
