Description

Methods for evaluating programs, devices, and patents, investments, financing, stock trading, bond trading, and selecting target companies for M&A

[0001] Some aspects of the present invention relate to a determination method, an evaluation method, a program, a system, and an apparatus such as a server or a computer.

[0002] Information about patents is extremely important when estimating the technological capabilities and technological assets of a target company when selecting target companies for loans, investments, stock or debt transactions, creating investment product packages, and conducting due diligence during M&A and IPOs. However, there are almost no objective indicators that show the likelihood that patent information will contribute to the expansion or maintenance of the target company's business or to winning patent litigation, and the current situation has been that it is necessary to rely on subjective evaluations.

[0003] JP 2021-086238 A JP 2020-166902 A

[0004] Some aspects of the present invention aim to provide an objective index of patent competitiveness, and some aspects of the present invention aim to provide an efficient method for evaluating intellectual property, determining the competitiveness of intellectual property, and selecting companies as targets for investment, financing, stock trading, bond trading, or M&A.

[0005] A program according to some aspects of the present invention performs a first collection step of collecting, for each of a plurality of electronically digitized patent publications, a plurality of unexamined patent publications, or a plurality of published patent publications, at least one first parameter selected from a plurality of first parameters, the plurality of first parameters being the total number of claims, the total number of claim categories, the total number of independent claims, the total number of dependent claims, the largest number of independent claims in the same claim category, the total number of claims in a claim category identical to or related to a specified designated product, technology, or service, the total number of independent claims in a claim category identical to or related to a specified designated product, technology, or service, and the total number of dependent claims in a claim category identical to or related to a specified designated product, technology, or service. Note that, in some aspects of the present invention, the patent publications, unexamined patent publications, and published patent publications may be those issued not only by the Japan Patent Office but also by patent offices of major countries such as the United States, China, South Korea, and European countries, as well as other countries.

[0006] In the above program, the designated services may include, for example, services, business models, and businesses.

[0007] The above-described program has the effect of enabling rapid collection of information on the effectiveness of a patent as a right, such as the competitiveness of the patent or robustness against invalidity claims or invalidation.

[0008] It is preferable that the above-mentioned program further executes a specifying step of specifying the applicant or patent owner for each of the plurality of patent publications or the unexamined patent publications or published patent publications.

[0009] By identifying applicants or patent holders using the above-mentioned program, it is possible to obtain information on the effectiveness of patent rights, such as the competitiveness or robustness of the patent, as well as information on the relationship between the applicants or patent holders. Therefore, the program is useful, for example, for identifying patents or patent applications that form the foundation of a business, or for selecting patents or patent applications to present to suspected infringers or negotiating partners in patent litigation or license negotiations. It can also be used as an indicator of the quality of patent practice, for example, from the perspective of obtaining exclusive monopoly rights, which is the original purpose of patent acquisition, and from the perspective of patent invalidity resistance, which is a prerequisite for enforcing rights.

[0010] Information regarding the effectiveness of patent rights, such as the competitiveness or robustness of the patent, and information regarding the relationship with the applicant or patent holder, which can be obtained through the above-mentioned program, can be one of the important pieces of information in, for example, investment, loans, stock trading, bond trading, or selecting a company as a target for M&A, or due diligence when listing, etc.

[0011] In the above-mentioned program, it is preferable to carry out a first extraction step of extracting the plurality of patent publications or the plurality of published patent publications or the plurality of published patent publications as those corresponding to a plurality of patent applications in which the applicant or patent holder is a company, individual, or institution designated as the subject of the investigation.

[0012] At least one of the plurality of first parameters obtained by the above-mentioned program for a plurality of patent applications whose applicants or patent holders are companies, individuals, or organizations designated as the subjects of investigation may be used, for example, as a benchmark for other companies, individuals, or organizations. By setting the benchmark applicant or patent holder to, for example, a competitor of one's own company's product, service, or business, it is possible to evaluate the strength of the patent of the competitor and one's own company in the product or service.

[0013] It is preferable that the above-mentioned program further performs a second collection step of collecting, as a second parameter, the number of cited documents, which is the number of prior documents cited in the examination at the Patent Office of the plurality of patent publications or the plurality of published patent publications or the plurality of patent applications corresponding to the plurality of patent publications or the plurality of published patent publications.

[0014] In the above-mentioned program, the number of cited documents cited by the examiner during the examination can be obtained, for example, by counting the references in Japanese patent publications. Also, in U.S. patent publications, the number of cited documents cited by the examiner during the examination can be obtained, for example, by counting the documents marked with *, which indicates that they were cited by the examiner, in the References Cited.

[0015] Since cited documents are, for example, a type of obstacle when an applicant tries to obtain a patent, the number of cited documents can be considered to correspond to the degree of obstacles or restrictions when an applicant tries to obtain a patent.

[0016] In the above-mentioned program, it is preferable to carry out a designation step in which the designated goods or designated services are designated based on the company, individual, or institution being surveyed, or the goods manufactured or sold, or the business or services being carried out by the company, individual, or institution being surveyed.

[0017] In the above-mentioned program, it is preferable to carry out a selection step of selecting the designated goods or designated services based on the results of a survey conducted via an electronic database or the Internet on the companies, individuals, or organizations being surveyed, or the goods or services being manufactured or sold by the companies, individuals, or organizations being surveyed.

[0018] The program preferably further includes a first calculation step of calculating, as a third parameter, a significance probability of the correlation between the second parameter and the value of the at least one first parameter. For example, when the at least one first parameter is related to the number of independent claims (e.g., the total number of independent claims, the maximum number of independent claims in the same claim, the total number of independent claims in a claim category that is the same as or related to a specified designated product, a specified designated product, a specified technology, or a specified service), the strength of the correlation with the second parameter is considered to correspond to the results or attempts by an applicant or patentee to maximize the scope of a patent in the face of obstacles or constraints in obtaining a patent, which are cited documents.

[0019] For example, when the at least one first parameter relates to the number of dependent claims (e.g., the total number of dependent claims, the total number of dependent claims in a claim category that is the same as or related to a specified designated product, a specified designated product, a specified technology, or a specified service, etc.), the strength of the correlation with the second parameter is considered to correspond to the result of or attempt by the applicant or patent owner to ensure resistance to an invalidity claim or invalidation in the face of obstacles or constraints in obtaining a patent, namely, cited documents.

[0020] In the above-mentioned program, it is preferable to perform a second calculation step of calculating a correlation coefficient as a fourth parameter for the correlation between the second parameter and the value of the at least one first parameter. The correlation coefficient can be used as an index of, for example, the result or attempt by an applicant or patent holder to maximize the scope of patent rights in response to obstacles or constraints in obtaining a patent, which are cited documents, or the result or attempt by an applicant or patent holder to ensure resistance to invalidity claims or invalidation in response to obstacles or constraints in obtaining a patent, which are cited documents.

[0021] The program preferably further includes a third calculation step of calculating a ratio between the second parameter and the at least one first parameter as a fifth parameter. The ratio can be used as an indicator of, for example, the result or attempt of an applicant or patentee maximizing the scope of a patent in the face of obstacles or constraints in obtaining a patent, such as cited documents, or the result or attempt of an applicant or patentee ensuring resistance to invalidity claims or invalidation in the face of obstacles or constraints in obtaining a patent, such as cited documents.

[0022] In the above-mentioned program, it is preferable that the plurality of patent publications or the plurality of published patent publications or the plurality of published patent publications include at least a plurality of first patent publications or a plurality of first published patent publications or a plurality of first published patent publications belonging to a first group and a plurality of second patent publications or a plurality of second published patent publications or a plurality of second published patent publications belonging to a second group, and that a first testing step is performed to test for significance of a difference between the first group and the second group in the at least one first parameter.

[0125] Some aspects of the present invention, such as a method for evaluating intellectual property, a method for determining the competitiveness of intellectual property, and a method for determining companies that are targets for investment, financing, stock trading, bond trading, or M&A, use at least one of the above-mentioned programs.

[0126] Programs relating to some aspects of the present invention, such as a method for evaluating intellectual property, a method for determining the competitiveness of intellectual property, a method for determining companies that are targets for investment, financing, stock trading, bond trading, or M&A, include at least one of the above-mentioned programs.

[0127] A program according to some embodiments of the present invention includes any of the programs described above and further includes a function of collecting corporate information. The corporate information typically includes, for example, sales, net profit, current profit, enterprise value, business value, stock value, free cash flow, dividend per share, dividend payout ratio, dividend yield, growth rate, price-earnings ratio, price-book value ratio, return on equity, current profit, market capitalization, weighted average cost of capital, return on equity, cost of equity, earnings per share, and net income per share. Two or more of these pieces of corporate information may be acquired.

[0128] The above-described program can be used, for example, to select companies to be targets for investment, financing, stock trading, bond trading, or M&A.

[0129] A program according to some aspects of the present invention includes a parameter collection step of collecting at least one parameter from each of a plurality of electronically converted patent publications, a plurality of unexamined patent publications, or a plurality of published patent publications, and a company information collection step of collecting company information of at least some of the companies listed as applicants in the plurality of patent publications, a plurality of unexamined patent publications, or a plurality of published patent publications. Typical examples of the company information are as described above.

[0130] The program preferably further includes a parameter analysis step for analyzing at least one parameter collected in the parameter collection step, and a company output step for outputting companies listed as applicants in patent publications, published patent publications, or published patent publications that received a rating of at least a predetermined value or higher in at least one evaluation item in the parameter analysis step. The filing period of the patents or patent applications from which the parameters used to calculate the evaluation items are collected can be appropriately set for each evaluation item. For example, since basic inventiveness (B) is expected to have a time lag before commercialization, it may be better to use parameters collected from applications filed earlier than robustness (R), which becomes important after the market transitions from a growth phase to a stable phase. For example, coverage (C) is an important evaluation item during the market growth phase after the establishment of a dominant design for a product or service, so it may be better to use parameters collected from applications filed earlier than robustness (R).

[0131] The at least one parameter mentioned above is typically, for example, the total number of claims, the total number of claim categories, the total number of independent claims, the total number of dependent claims, the largest number of independent claims in the same claim category, the total number of claims in the claim category, the total number of independent claims in the claim category and the number of dependent claims in the claim category, the number of prior documents or cited documents, the number of limiting elements mentioned above and the number of specified terms and phrases, etc., and may further include the results of a correlation analysis such as a correlation coefficient between multiple of these parameters.

[0132] The above-mentioned program preferably further includes a selection step of selecting the companies outputted by the company output step as target companies for financing, investment, stock trading, bond trading, or M&A.

[0133] The above-mentioned program makes it possible to quantify and compare patent competitiveness, robustness, accuracy in patent practice, and level of technical understanding, which strongly reflect a company's competitiveness and stability, thereby ensuring objectivity when selecting a company as a target for loans, investments, stock trading, bond trading, or M&A.

[0134] The above-mentioned program preferably further includes a company evaluation step of evaluating companies based on the company information obtained in the company information collection step, and a company extraction step of extracting companies that have a predetermined value or more in at least one evaluation item used as a judgment criterion in the company evaluation step, and the parameter collection step is performed for the companies extracted in the company extraction step.

[0135] It is preferable that the above-mentioned program further includes a parameter analysis step for analyzing the at least one parameter collected by the parameter collection step, and a company output step for outputting companies that have a predetermined value or above in at least one evaluation item by the parameter analysis step.

[0136] A program according to some aspects of the present invention includes a parameter collection step of collecting a plurality of parameters from a plurality of electronically converted patent publications, or a plurality of published patent publications, a company information collection step of collecting company information on at least some of the companies listed as applicants in the plurality of patent publications, or the plurality of published patent publications, or the plurality of published patent publications, a data analysis step of analyzing the plurality of parameters collected by the parameter collection step and evaluating the plurality of patent publications, or the plurality of published patent publications, for a plurality of evaluation items, and a company selection step of selecting at least one company for each of the plurality of evaluation items or for two or more evaluation items.

[0137] The above-mentioned evaluation items are typically, for example, evaluations (CUPRB evaluations) of coverage (C), technical understanding (U), practical accuracy (P), robustness (R), and basic invention (B) as shown in FIG. 5 described later.

[0138] In the above-mentioned program, it is preferable that the companies selected in the company selection step are those that have obtained scores of a predetermined value or more in each evaluation item in the data analysis step.

[0139] For example, when trading stocks, it may be necessary to consider the balance between investment risk and return. Among the above-mentioned evaluation items, for example, if growth potential is emphasized, companies ranked high in coverage (C) may be included as targets for investment, loans, stock trading, bond trading, or M&A. If stability is emphasized over risk, companies ranked high in robustness (R) may be included as targets for investment, loans, stock trading, bond trading, or M&A. Furthermore, when making long-term investments, loans, stock trading, bond trading, or M&A, emphasis may be placed on the evaluation of inventiveness (B), for example. If practical ability in intellectual property is emphasized, emphasis may be placed on the evaluation of practical accuracy (P), for example. If technical level is emphasized, emphasis may be placed on the evaluation of technical understanding (U).

[0140] Of the multiple evaluation items described above, companies may be ranked based on, for example, two or more evaluation items. In this case, when selecting target companies for loans, investments, stock trading, bond trading, etc., with an emphasis on the growth period of the patents or patent applications for which parameters serving as the basis for calculating the evaluation items are collected, the companies may be selected after evaluating coverage (C) and basic inventiveness (B) in a predetermined ratio. In this case, depending on the evaluation item, basic inventiveness (B) takes time to be reflected in the business, so it may be better to use parameters collected from applications filed in an older period than robustness (R), which becomes important after the transition to a stable period. Since coverage (C) is an important evaluation item during the market growth period after the establishment of a dominant design for a product or service, it may be better to use parameters collected from applications filed in an older period than robustness (R).

[0141] The device according to the present invention is equipped with any of the above-described programs.

[0142] Any of the above programs may be implemented at least in part by the user, and may be, for example, a method for patent evaluation, a method for selecting a target company for investment, financing, stock trading, bond trading or M&A, or a due diligence method.

[0143] According to some aspects of the present invention, for example, it becomes possible to effectively evaluate the competitiveness, robustness, accuracy of intellectual property practices, basic invention, and technical understanding of many patent applications and patents, which can be used for selecting target companies for investment, financing, stock trading, bond trading, or M&A, and for due diligence purposes.

[0145] Hereinafter, embodiments according to several aspects of the present invention will be described with reference to Figures 1 to 13. Note that these figures illustrate specific examples of the several aspects, and the scope of the present invention and its concepts is not limited to these embodiments. Figure 1 shows steps 1 to 4 of a program according to several aspects of the present invention. In step 1 (S1), the program inputs a designated applicant or designated right holder, designated goods, designated technology, or designated services. In step 2 (S2), the program extracts patent publications, unexamined patent publications, or published patent publications that include the designated goods, designated technology, or designated services input in S1 in their claim categories. Note that the input designated services may also include, for example, services, business models, and businesses. The patent publications, unexamined patent publications, or published patent publications extracted in S2 will hereinafter be collectively referred to as extracted patent publications, etc.

[0146] In step 3 (S3), data on the total number of claims (a or m), the total number of claim categories (b or n), the total number of independent claims (c or o), the total number of dependent claims (d or p), the largest number of independent claims in the same claim category (e or q), the total number of claims in the claim category that is the same as or related to the specified designated goods, designated technology, or designated service (f or r), the total number of independent claims in the claim category that is the same as or related to the specified designated goods, designated technology, or designated service (g or s), and the total number of dependent claims in the claim category that is the same as or related to the specified designated goods, designated technology, or designated service (h or t) are collected from the patent publications, etc. extracted in S2.

[0147] Typical parameters related to claims obtained in S3 are shown in Table 1. Parameters at the time of patent filing or publication include, for example, the total number of claims (a), the total number of claim categories (b), the total number of independent claims (c), the total number of dependent claims (d), the largest number of independent claims in a claim category (e), the total number of claims in a specified claim category (f), the total number of independent claims among the specified claims (g), and the total number of dependent claims among the specified claim categories (h). Parameters at the time of grant of a patent include, for example, the total number of claims (m), the total number of claim categories (n), the total number of independent claims (o), the total number of dependent claims (p), the largest number of independent claims in a claim category (q), the total number of claims in a specified claim category (r), the total number of independent claims among the specified claims (s), and the total number of dependent claims among the specified claim categories (t).

[0148]

[0149] In step 4 (S4), the number of documents cited by the examiner during the examination is identified from the patent publications extracted in S2.

[0150] Figure 2 shows steps 5 to 7 of this program. In step 5 (S5), the number of specified phrases (such as "said," "the," "the," "the," "the above," and "this" that specify the preceding phrase) in each claim and the number of limiting elements (verbs, nouns, adjectives, and adverbs) other than the specified phrases in the claim are counted. It is preferable that the limiting elements are basically independent words.

[0151] Typical examples of limiting elements and specified terms are explained below: "(Claim 1) An <apparatus> characterized by comprising: a first <unit> <detecting> the <effective> <value> of the> <current> <supplied> to an <electric> <machine>; a second <unit> <storing> the <current> <value> of the <coil> <current> of [said] <electric> <machine> <corresponding> to the <maximum> <torque> of [said] <electric> <machine>; a third <unit> <calculating> the <ratio> of [said] <effective> <value> to said <current> <value> and <outputting> <data> <corresponding> to [said] <ratio>; and a fourth <unit> <controlling> the <voltage> <applied> to [said] <electric> <machine> <based> on said> <data>."

[0152] In the above example, limiting elements and all specified terms are represented by "<>" and "[ ]", respectively. The program according to this embodiment also focuses on predicates such as verbs and modifiers such as adjectives and adverbs. This is for the following reason: The outer boundaries of a patented invention are determined based on the all-elements rule. Specifically, if the accused infringing item satisfies all of the limiting elements (limiting elements) in claim interpretation among the words and phrases described in the claim, it is generally determined to be a patent infringement.

[0153] For example, modifiers such as "electric" in "electric machine" and "corresponding" in "data corresponding to the ratio" limit the "machine" and "data," respectively, so words such as "electric" and "corresponding," which modify and limit these other limiting elements, are also counted as limiting elements. Note that "first" and "second" in "first unit" and "second unit" are words used for the convenience of claim description and do not substantially limit the scope of the right, so they are not counted as limiting elements in the program according to this embodiment. Based on the above, the total number of limiting elements L in claim 1 in the above example is 41.

[0154] In addition to the above-mentioned limiting elements, specified terms were also used to analyze the claims. The specified terms refer to the "said" in "said effective value" and "said ratio" in the above example, which in this case specifies the limiting elements "effective value" and "ratio" already mentioned in the claim. The total number of specified terms S for claim 1 in the above example is 6. In the program according to this embodiment, in addition to "said," words such as "said," "said," "said," "the," and "this" are also considered to be specified terms. The total number of specified terms (S) basically corresponds to the description of the relationship between limiting elements in the claim.

[0155] In step 6 (S6), the presence or number of quantitative expressions in the embodiments or examples for carrying out the inventions of the extracted patent publications, etc. is confirmed. Quantitative expressions include, for example, descriptions of experimental results or other results based on actual numerical data. For example, the percentage of patent applications or patents that contain quantitative expressions in the embodiments or examples for a specified applicant or right holder, a specified technology, or a specified product may be calculated.

[0156] In step 7 (S7), the ratio of two parameters obtained in S3 and S4 is calculated as shown in Tables 2 and 3 below. Table 2 is based on parameters extracted from the scope of patent claims at the time of patent application or publication, and Table 3 is based on parameters extracted from the scope of patent claims at the time of patent allowance or registration.

[0157]

[0158]

[0159] Table 2 shows the ratios of parameters extracted from the claims at the time of patent application or publication, and in this embodiment, specifically, b / a, c / a, d / a, e / a, f / a, g / a, h / a, x / a, c / b, d / b, e / b, f / b, g / b, h / b, x / b, d / c, e / c, f / c, g / c, h / c, x / c, e / d, f / d, g / d, h / d, x / d, f / e, g / e, h / e, x / e, g / f, h / f, x / f, h / g, x / g, and x / h.

[0160] Table 3 shows the parameter ratios extracted from the claims at the time of allowance, which in this embodiment are n / m, o / m, p / m, q / m, r / m, s / m, t / m, x / m, o / n, p / n, q / n, r / n, s / n, t / n, x / n, p / o, q / o, r / o, s / o, t / o, x / o, q / p, r / p, s / p, t / p, x / p, r / q, s / q, t / q, x / q, s / r, t / r, x / r, t / s, x / s, and x / t.

[0161] In step 8 (S8), the correlation coefficient between two parameters among the parameters related to the extracted claims is obtained. Table 4 shows the correlation coefficient r based on the parameters extracted from the scope of the patent claims at the time of filing or publication. a 1~r a 36, and Table 5 shows the correlation coefficient r based on parameters extracted from the scope of patent claims at the time of patent allowance or patent registration. b 1~r b It is 36.

[0162]

[0163]

[0164] In step 9 (S9), evaluation is performed based on the values obtained in steps S3, S4, S5, S6, S7, and S8. In this case, it is preferable to perform similar calculations in advance for the applicant or patentee, or the designated goods, designated technologies, or designated services, etc., that serve as a benchmark depending on the information to be obtained, or to perform evaluation by comparing with stored benchmark data.

[0165] Table 6 shows the calculated values and parameters to be evaluated for each of coverage (C), technical comprehension (U), practical accuracy (P), robustness (R), and basic invention (B).

[0166] Coverage (C) is an evaluation index related to the extent to which a patent's rights are maximized. To measure the breadth of rights, parameters related to the number of independent claims (g and s), such as the total number of independent claims (c and o), the highest number of independent claims in the same claim category (e and q), and the total number of independent claims in a specified claim category, are primarily relevant. However, because the scope of rights is limited by prior or cited documents, it is desirable to include the ratio of the number of cited documents x to the number of independent claims in assessing coverage (C), in addition to the aforementioned parameters related to the number of independent claims, in order to maximize the scope of rights based on the number of cited documents. Coverage (C) indicates whether a patent has or is attempting to maximize the scope of rights within the limited scope of patent rights available through cited or prior documents, and is considered a key component of a patent's competitiveness.

[0167] The degree of technical understanding (U) is, for example, an evaluation of whether the claims reflect an understanding and understanding of prior documents or cited documents. Specifically, the index is the correlation coefficient between the number of cited documents (x) and the number of independent claims, such as the total number of independent claims (c and o), the most number of independent claims in the same claim category (e and q), and the total number of independent claims in a specified claim category (g and s).

[0168] Practical accuracy (P) is evaluated based on, for example, the number of designated terms (S) and the ratio of the number of designated terms (S) to the number of limiting elements (L). The reason for this is that when drafting a claim, for example, when describing the relationship between limiting elements, designated terms such as "said," "said," "the," "the," "this," "the above," or "above" are added before the previously mentioned limiting element to describe the relationship with the new limiting element, so the number of designated terms (S) and the ratio of the number of designated terms (S) to the number of limiting elements (L) are considered to be indicators of the accuracy of the description of the relationship between the limiting elements.

[0169] Robustness (R) is an indicator of resistance to, for example, patent invalidity claims or patent revocation claims. For example, in order to prepare for patent invalidity claims or patent revocation claims, it is important to understand and grasp the content of prior art or cited documents and to appropriately position dependent claims. Therefore, robustness is considered to be reflected in the correlation coefficient between the number of cited documents (x) and the total number of dependent claims (d or p) or the total number of dependent claims in a specified claim category (h or t).

[0170] Basic invention (B) corresponds to, for example, the discovery of new knowledge. Specifically, it is an evaluation of whether the embodiments or examples contain specific numerical values, i.e., quantitative expressions. For example, the patent publications or published patent applications extracted in S2 may be calculated as the percentage of patent applications or patents that contain quantitative expressions in the embodiments or examples for each designated applicant or right holder, or designated technology or product, among the extracted patent publications.

[0171]

[0172] 4 shows an example of a program for scoring the elements of coverage (C), technical comprehension (U), practical accuracy (P), robustness (R), and basic invention (B). First, the program according to this embodiment identifies the companies implementing business W, namely, companies a, b, c, d, e, and f, using a database or the Internet to identify the companies implementing business W and their market shares. Next, it extracts patent applications or patents related to business W that were filed within a specified period for each of companies a, b, c, d, e, and f. Patent applications and patents related to business W refer to, for example, patent applications and patents that include a claim category for a product, service, or service related to business W in the scope of the claims.

[0173] Next, for the extracted patent applications or patents, if patent applications are the target of extraction, typical parameters are collected, for example, the total number of claims (a), the total number of claim categories (b), the total number of independent claims (c), the total number of dependent claims (d), the most independent claims in the same claim category (e), the total number of claims in a specified claim category (f), the total number of independent claims for specified claims (g), and the total number of dependent claims in a specified claim category (h).If patents are the target of extraction, typical parameters are collected, for example, the total number of claims (m), the total number of claim categories (n), the total number of independent claims (o), the total number of dependent claims (p), the most independent claims in the same claim category (q), the total number of claims in a specified claim category (r), the total number of independent claims for specified claims (s), and the total number of dependent claims in a specified claim category (t).In addition, the number of cited documents (x) cited by the examiner during the examination of the patent to be extracted is collected. If patent applications that have not yet been patented are the target of extraction, the number of cited documents (x) can be determined from the patent corresponding to the patent application.

[0174] For each of Company A, Company B, Company C, Company D, Company E, and Company F, count the number of specified terms (words such as "said," "the," "the," "the," "above," "above," and "this" that specify the preceding term) and the number of limiting elements (verbs, nouns, adjectives, and adverbs) other than the specified terms in the claim.

[0175] Scoring of each element of coverage (C), technical understanding (U), practical accuracy (P), robustness (R), and basic invention (B) can be performed based on the correspondence table shown in Table 6, which shows coverage (C), technical understanding (U), practical accuracy (P), robustness (R), and basic invention (B) with parameters and data obtained by processing the parameters. For example, a similar evaluation can be performed on the magnitude of the difference from the benchmark or a set of a certain size, and the evaluation can be performed using a standard deviation, etc. Figure 5 shows a radar chart visualizing the evaluation results of coverage (C), technical understanding (U), practical accuracy (P), robustness (R), and basic invention (B). This visualization makes it possible to visually understand patents and patent applications from multiple perspectives.

[0176] FIG. 6 shows an example of application of the program according to this embodiment to market share. First, data on manufacturers or sellers of product X and their market shares of product X is obtained. Patent applications or patents filed during a predetermined period for the extracted manufacturers or sellers and the extracted manufacturers or sellers, i.e., companies A, B, C, and D, as applicants or rights holders are extracted. Here, the predetermined period may be, for example, the period from the start of the development period of product X, the product being investigated, to the end of sales. Alternatively, the program according to this embodiment may set the predetermined period according to, for example, the product life cycle, such as the introduction phase, growth phase, maturity phase, and decline phase. Parameters such as those shown in Table 1 are collected for the extracted patent applications or patents for companies A, B, C, and D, and ratios or correlation coefficients between the parameters are calculated. Companies A, B, C, and D are then ranked based on coverage (C), technical comprehension (U), practical accuracy (P), robustness (R), and basic invention (B).

[0177] Figure 7 shows an example of using the program according to this embodiment to identify companies to be acquired. Companies engaged in business Y, which the company is conducting, and their market shares are obtained from a database or the Internet. Next, patents or patent applications related to business Y filed during a specified period are extracted for each of the extracted companies engaged in business Y, namely, Company E, Company F, and Company G, and the company itself, and the parameters shown in Table 1 are collected. Furthermore, ratios or correlation coefficients between the parameters are calculated, and evaluations are performed for coverage (C), technical understanding (U), practical accuracy (P), robustness (R), and basic invention (B). The results of the company's parameter analysis are added to the results of the parameter analyses for Company E, Company F, and Company G, and a radar chart is created. This allows the company to determine which of Company E, Company F, and Company G should be acquired to receive a high evaluation in the desired evaluation axis of coverage (C), technical understanding (U), practical accuracy (P), robustness (R), and basic invention (B).

[0178] FIG. 8 illustrates a case where the program according to this embodiment is used to reform or discontinue a business within a company. First, patent applications or patents related to a specific company's or its own businesses S, T, U, and V are extracted. For the extracted patent applications or patents, parameters such as those shown in Table 1 are collected, and ratios or correlation coefficients between multiple parameters are obtained, as shown in Tables 2, 3, 4, and 5. Based on these parameters and the calculation results, evaluations (CUPRB evaluations) of coverage (C), technical comprehension (U), practical accuracy (P), robustness (R), and basic invention (B) are performed. This allows for the identification of businesses with highly competitive patent portfolios or those with patent portfolios capable of maintaining a high market share. Businesses lacking particular strengths from the perspective of their patent portfolios can be transferred to other companies or discontinued.

[0179] Figure 9 shows a case where the program according to this embodiment is used to ascertain the strengths and weaknesses of a patent portfolio relative to competitors. Information about competitors of a company's product Z and their market shares is obtained from a database or the Internet. The parameters shown in Table 1 are collected for the patent applications or patents obtained, for which Company H, Company I, and Company J are the applicants or rights holders. For example, ratios between multiple parameters or correlation coefficients between multiple parameters are further obtained, as shown in Tables 2, 3, 4, and 5. At this point, a statistical test is performed to see if the company's parameters or the analytical results of the parameters differ from those of the benchmark company H, and an analysis of the company's own parameters is then performed.

[0180] 10 is a diagram illustrating a program that uses the results of evaluation of a patent or patent application for selecting a target company for investment, financing, stock trading, bond trading, or M&A according to some aspects of the present invention. The evaluation of the patent or patent application can basically use at least a part of any of the above-mentioned programs.

[0181] A typical operation of the program is as follows.

[0182] In the first step, companies in the target business and / or industry are listed. The conditions for listing, such as the number of companies to be listed, nationality, and company size, can be set as appropriate.

[0183] In the second step, patents or patent applications filed within a predetermined period of time for the companies listed in the first step are extracted. The predetermined period can be selected programmatically or manually as appropriate. For example, the patents or patent applications to be extracted are typically those filed between five and one and a half years prior to the planned date of investment, financing, stock trading, bond trading, or M&A, and more typically those filed between three and one and a half years prior to the planned date of investment. Either patents or patent applications, or both patents and patent applications, may be extracted.

[0184] In the third step, parameters of the patents or patent applications extracted in the second step are collected. The parameters typically include at least one of the following: the total number of claims, the total number of claim categories, the total number of independent claims, the total number of dependent claims, the largest number of independent claims in the same claim category, the total number of claims in a claim category identical to or related to a specified designated product, technology, or service; the total number of independent claims in a claim category identical to or related to a specified designated product, technology, or service; the total number of limiting elements in a claim; and the total number of specified terms and phrases used to specify previously-mentioned limiting elements in the claim and describe their relationship with other limiting elements. The parameters include at least one of the following: the total number of claims, the total number of claim categories, the total number of independent claims, the total number of dependent claims in a claim category identical to or related to a specified product, technology, or service; the total number of limiting elements in a claim; and the total number of specified terms and phrases used to specify previously-mentioned limiting elements in the claim and describe their relationship with other limiting elements.

[0185] In the fourth step, the above parameters extracted in the third step are analyzed.

[0186] In the fifth step, the results of the above analysis are typically output as statistical data such as deviation values, average values, and correlation coefficients for each company, and the companies are ranked.

[0187] In the sixth step, current corporate information, or corporate information expected to be available for a predetermined period from now or for a predetermined period from now, is acquired for companies up to a predetermined rank based on the rankings made in the fifth step. The corporate information typically includes, for example, sales, net profit, current profit, enterprise value, business value, stock value, free cash flow, dividend per share, dividend payout ratio, dividend yield, growth rate, price-earnings ratio, price-book ratio, return on equity, current profit, market capitalization, weighted average cost of capital, return on equity, cost of equity, earnings per share, and net profit per share, and two or more of these corporate information may be acquired.

[0188] In the seventh step, companies that satisfy predetermined criteria are extracted. Typical examples of the criteria include a price-earnings ratio equal to or greater than a predetermined value, a stock value equal to or greater than a predetermined value, a price-to-book ratio equal to or greater than a predetermined value, a growth rate equal to or greater than a predetermined value, a return on equity equal to or greater than a predetermined value, a dividend per share equal to or greater than a predetermined value, an earnings per share equal to or greater than a predetermined value, a net earnings per share equal to or greater than a predetermined value, a return on equity equal to or greater than a predetermined value, a dividend payout ratio equal to or greater than a predetermined value, and a dividend yield equal to or greater than a predetermined value. Among the criteria, the price-earnings ratio and the price-to-book ratio are also known as PER (Price Earnings Ratio) and PBR (Price-to-Value Ratio), respectively. The lower the values, the more undervalued a stock is, and these are particularly suitable as criteria for stock investment.

[0189] In the eighth step, companies that satisfy the predetermined criteria in the seventh step are output as companies that are targets for investment, financing, stock trading, bond trading, or M&A.

[0190] 11 is a diagram illustrating a program using the results of patent or patent application evaluations to select target companies for investment, loans, stock trading, bond trading, or M&A according to some aspects of the present invention. This program differs from the program described using FIG. 10 in that the order of analysis based on company information and parameter analysis of patents or patent applications is changed. Specifically, after performing a step of extracting target companies for investment, loans, stock trading, bond trading, or M&A based on company information, an analysis based on patents and patent applications is performed to determine target companies for investment, loans, stock trading, bond trading, or M&A.

[0191] 12 is a diagram illustrating a program that uses the results of patent or patent application evaluations to select target companies for investment, financing, stock trading, bond trading, or M&A according to some aspects of the present invention. Specifically, this program extracts multiple target companies for investment, financing, stock trading, bond trading, or M&A based on the ranking of each evaluation item in the parameter analysis of patents or patent applications. This makes it possible to create, for example, a single stock investment package.

[0192] A typical operation of the program is as follows.

[0193] In the first step, companies in the target business and / or industry are listed. The conditions for listing, such as the number of companies to be listed, nationality, and company size, can be set as appropriate.

[0194] In the second step, patents or patent applications filed within a predetermined period of time for the companies listed in the first step are extracted.

[0195] In the third step, parameters related to each evaluation item of the patent or patent application extracted in the second step are collected. The evaluation items are typically, for example, the evaluation (CUPRB evaluation) of coverage (C), technical comprehension (U), practical accuracy (P), robustness (R), and basic invention (B) as shown in FIG. 5 . Of these, coverage (C) is an indicator of a company's high growth rate because companies with a high market share show relatively high values during the market's growth period after the dominant design of the product or service is established. On the other hand, robustness (R) is an indicator of a company's stability because companies with a high market share show relatively high values during the market's stable period.

[0196] The above-mentioned parameters typically include, for example, at least one of the following regarding the scope of claims: the total number of claims, the total number of claim categories, the total number of independent claims, the total number of dependent claims, the largest number of independent claims in the same claim category, the total number of claims in a claim category that is the same as or related to the specified designated goods, designated technology, or designated service; the total number of independent claims in a claim category that is the same as or related to the specified designated goods, designated technology, or designated service; the total number of limiting elements, which is the number of limiting elements of a claim; and the total number of specified terms and phrases, which is the number of specified terms and phrases used to specify previously mentioned limiting elements of the claim and describe their relationship with other limiting elements; and the presence or number of quantitative expressions in the scope of claims or the specification.

[0197] In the fourth step, the above parameters extracted in the third step are analyzed.

[0198] In the fifth step, the results of the above analysis are output for each evaluation item, typically as statistical data such as standard deviation, average value, and correlation coefficient for each company, and the companies are ranked.

[0199] In the sixth step, based on the ranking for each evaluation item performed in the fifth step, current corporate information, or corporate information expected to be available for a predetermined period from the present or for a predetermined period from the present, is acquired for companies ranked up to a predetermined position in the ranking. The corporate information typically includes, for example, sales, net profit, current profit, enterprise value, business value, stock value, free cash flow, dividend per share, dividend payout ratio, dividend yield, growth rate, price-earnings ratio, price-book ratio, return on equity, current profit, market capitalization, weighted average cost of capital, return on equity, cost of equity, earnings per share, and net profit per share, and two or more of these corporate information may be acquired.

[0200] In the seventh step, companies that satisfy predetermined criteria for each evaluation item are extracted. Among the criteria mentioned above, the price-earnings ratio and the price-to-book ratio are known as the price-earnings ratio (PER) and the price-to-book-value ratio (PBR), respectively. The lower the PER, the more undervalued a stock is, and these are particularly suitable as criteria for stock investment.

[0201] In the eighth step, companies that meet the predetermined criteria in the seventh step are output as target companies for investment such as stock investment, loans, stock trading, bond trading, or M&A for each evaluation item. The number of companies to be targeted for stock investment for each evaluation item can be determined appropriately depending on the risk and return of the set stock investment package. For example, if growth potential is emphasized, many companies ranked high in coverage (C) can be included as stock investment targets, and if stability is emphasized over risk, many companies ranked high in robustness (R) can be included as stock investment targets.

[0202] FIG. 13 shows the configuration of a device according to several aspects of the present invention. In FIG. 13, reference numerals 1 to 3 respectively denote a patent database, an information processing device, and an internet connection. Here, information processing device 2 is equipped with a program according to several aspects of the present invention. By connecting to patent database 1 via internet connection 3 using information processing device 2, evaluation results obtained using the above-mentioned program can be acquired.
