[0001] The present disclosure relates to compositions intended for human use. The compositions are configured for oral use and deliver substances, such as flavorings and / or active ingredients, during use. Such products may include tobacco or tobacco-derived products, or may be tobacco-free alternatives. [Background technology]
[0002] Tobacco may be enjoyed in so-called "smokeless" forms. Particularly popular smokeless tobacco products are used by inserting some form of processed tobacco or tobacco-containing formulation into the oral cavity of the user. Traditional forms of such smokeless tobacco products include moist snuff, snus and chewing tobacco, which are typically almost entirely made of particulate, granular or cut tobacco, either to be divided by the user or presented to the user in individual portions, such as single-use pouches or sachets. Other traditional forms of smokeless products include compressed or agglomerated forms, such as plugs, tablets or pellets. Alternative product forms, such as tobacco-containing gums and mixtures of tobacco with other plant materials, are also known.See, for example, U.S. Pat. Nos. 1,376,586 to Schwartz; 4,513,756 to Pittman et al.; 4,528,993 to Sensabaugh, Jr. et al.; 4,624,269 to Story et al.; 4,991,599 to Tibbetts; 4,987,907 to Townsend; 5,092,352 to Sprinkle, III et al.; and 5,092,352 to Whitman et al. [0123] The product described herein comprises a filler, at least one active ingredient, salt and at least one sweetener. The amount of each of the various components in the composition may vary and is typically selected to provide the desired sensory and performance characteristics to the oral product.Exemplary individual components of the composition are described herein below.
[0124] Filler The compositions described herein include at least one filler. Such fillers may perform multiple functions, such as improving certain organoleptic properties, for example texture and mouthfeel, improving the cohesiveness or compressibility of the product. Generally, fillers are porous particulate materials and are cellulose-based. For example, suitable fillers are any non-tobacco plant material or derivatives thereof, including cellulose materials derived from such sources. Examples of cellulosic non-tobacco plant materials include grains (e.g., maize, oats, barley, rye, buckwheat), sugar beet (e.g., FIBREX® brand fillers available from International Fiber Corporation), bran fibers, and mixtures thereof. Non-limiting examples of derivatives of non-tobacco plant materials include starch (e.g., from potato, wheat, rice, corn), natural cellulose, and modified cellulosic materials. Some starches are modified starches. Modified starches have undergone one or more structural modifications, often designed to alter their high heat resistance. Some starches have been developed by genetic modification and are referred to as "genetically modified" starches. Other starches are obtained and subsequently modified by chemical, enzymatic or physical means. For example, modified starches can be starches that have been subjected to chemical reactions such as esterification, etherification, oxidation, depolymerization (thinning) by acid catalysis or oxidation in the presence of a base, bleaching, transglycosylation and depolymerization (e.g., dextrinization in the presence of a catalyst), crosslinking, acetylation, hydroxypropylation, and / or partial hydrolysis. Enzyme treatments include subjecting raw starches to enzyme isolates or concentrates, microbial enzymes, and / or enzymes native to plant material, e.g., amylases present in corn kernels that modify corn starch. Other starches are modified by heat treatments such as pregelatinization, dextrinization, and / or cold water swelling processes. Some modified starches include monostarch phosphate, distarch glycerol, distarch phosphate esterified with sodium trimetaphosphate, phosphorylated distarch phosphate, acetylated distarch phosphate, starch acetate esterified with acetic anhydride, starch acetate esterified with vinyl acetate, acetylated distarch adipate, acetylated distarch glycerol, hydroxypropyl starch, hydroxypropyl distarch glycerol, and starch sodium octenylsuccinate.

[0173] Bleached active ingredients In some embodiments, the oral product comprises an active ingredient disclosed herein, and the active ingredient is characterized as being bleached. Such a bleached active ingredient may be desirable, for example, to prevent discoloration of teeth during use of the oral product, or to make any residue remaining in the user's mouth after use of the product less visible and less likely to cause staining of fibrous materials that may come into contact with the residue, such as clothing. A "bleached" active ingredient refers to an active ingredient (e.g., a botanical material or a derivative thereof) that naturally possesses color and has been treated to reduce or remove the color. "Color" refers to a characteristic of human visual perception described through color categories with names such as red, blue, yellow (primary colors) or brown, orange, green, purple resulting from combinations of primary colors. This perception of color originates from the stimulation of cone cells in the human eye by electromagnetic radiation in the visible spectrum associated with the object through the wavelengths of light reflected from the object. This reflection is affected by the physical properties of the object, such as its absorption and emission spectrum across the electromagnetic spectrum.
[0174] Some active ingredients have naturally occurring compounds that reflect light in the visible range of the electromagnetic spectrum in the compound, imparting color to the active ingredient (e.g., chlorophyll or pigment breakdown products in some botanical materials reflect green and brown colors, respectively). Such compounds or portions thereof that are color-sensitive to the active ingredient can be chemically altered or removed by various treatments. In some embodiments, the treatment is effective to remove at least 70% of the chemicals present in the active ingredient that exhibit maximum transmission of wavelengths in the visible range of the electromagnetic spectrum, relative to the weight of the naturally occurring compound. For example, such treatments can be effective to remove 70%, 80%, 90%, 95%, 99% or even 100% of the naturally occurring compounds that are color-sensitive to the active ingredient's visible color.
[0175] In some embodiments, the treatment for bleaching (i.e., altering or removing colored compounds from the active ingredient) includes extraction, chemical bleaching, or a combination thereof. One particularly suitable extraction method is supercritical carbon dioxide (CO2) extraction. For example, chemical bleaching methods for botanical materials, including tobacco, are known and include, as non-limiting examples, treatment with hydrogen peroxide, ozone, or other oxidizing agents. For example, bleached active ingredients (e.g., bleached botanicals or tobacco materials) can be produced by a variety of whitening methods using a variety of bleaching or oxidizing agents. Exemplary oxidizing agents include peroxides (e.g., hydrogen peroxide), chlorites, chlorates, perchlorates, hypochlorites, ozone, ammonia, potassium permanganate, and combinations thereof. An oxidation catalyst may be used. Exemplary oxidation catalysts are titanium dioxide, manganese dioxide, and combinations thereof.
[0176] Known bleaching methods for bleaching tobacco can be applied to this active ingredient. Methods for treating tobacco with bleaching agents are described, for example, in U.S. Patents 787,611 to Daniels, Jr.; 1,086,306 to Oelenheinz; 1,437,095 to Delling; 1,757,477 to Rosenhoch; 2,122,421 to Hawkinson; 2,148,147 to Baier; 2,170,107 to Baier; 2,274,649 to Pratz et al.; 2,770,239 to Rosenhoch; 2,622,641 to Hawkinson; 2,622,641 to Baier; 2,770,239 to Pratz et al.; 2,622,641 to Rosenhoch; 2,770,250 to Rosenhoch; 2,770,260 to Rosenhoch; 2,770,270 to Rosenhoch; 2,770,280 to Rosenhoch; 2,770,29 ... [0178] In some embodiments, the bleached activator is characterized as being lighter in color (e.g., "whitened") compared to the untreated activator. White is often defined with reference to the International Commission on Illumination (CIE) chromaticity diagram. The bleached activator, or a composition or product comprising the bleached activator, in some embodiments, is characterized as being closer to pure white on the chromaticity diagram than the untreated activator, or a composition or product comprising the untreated activator.
[0179] The whiteness value of bleached active ingredients, compositions and pouched products containing such ingredients can be determined in accordance with the Commission Internationale de l'Eclairage (CIE) model, for example, using a handheld color meter, compared to a control product (see "Precise Color Communication; Color Control from Perception to Instrumentation", Konica Minolta, 2007; http: / / konicaminolta.com / instruments / about / network, which is incorporated herein by reference). Discoloration from white can be evaluated by the E313 Whiteness Index according to ASTM method E313, using the formula WI=(3.388Z-3Y, where Y and Z are CIE tristimulus values, measured by a handheld color meter).
[0180] water The moisture content (e.g., water content) of the composition prior to use of the product by the consumer can vary according to the desired properties. In some embodiments, the taste modifier is capsaicin.
[0183] In some embodiments, the taste modifier is an amino acid, gamma-aminobutyric acid (GABA), as mentioned herein above with respect to amino acids. Studies in mice suggest that GABA may aid in taste bud function(s) in addition to synaptic inhibition. See, for example, Dvoryanchikov et al., J Neurosci. 2011 Apr;13;31(15):5782-91. Without wishing to be bound by theory, GABA may suppress the perception of certain tastes, for example bitterness. In some embodiments, the composition comprises caffeine and GABA.
[0184] In some embodiments, the taste modifier is adenosine monophosphate (AMP). AMP is a naturally occurring nucleotide substance that can block bitter food flavors or enhance sweetness. It does not directly alter the bitter flavor, but may alter the human perception of "bitter" by blocking the associated receptor.

As used herein, the term "organic acid" refers to an organic (i.e., carbon-based) compound characterized by acidic properties. Typically, organic acids are relatively weak acids (i.e., they do not completely dissociate in the presence of water), such as carboxylic acids (-CO2H) or sulfonic acids (-SO2OH). As used herein, reference to an organic acid refers to an organic acid that is intentionally added. In this respect, an organic acid may be intentionally added as a particular blend ingredient, as opposed to one that is essentially only present as a component of another blend ingredient (e.g., a small amount of an organic acid that may be inherently present in a blend ingredient, such as a tobacco material). In some embodiments, one or more organic acids are added neat (i.e., in their free acid, raw solid or liquid form) or as a solution, for example, in water. In some embodiments, one or more organic acids are added in the form of a salt, as described herein below.
[0201] Suitable organic acids typically have a range of liposolubility (i.e., polarity that results in an appropriate balance of aqueous and organic solubilities). Liposolubility is conveniently measured by logP, the partition coefficient of a molecule between aqueous and liposoluble phases, usually water and octanol, respectively. Typically, the liposolubility of an organic acid may be between about -2 and about 6.5. In some embodiments, the organic acid may be more soluble in water than in octanol (i.e., has a negative logP value, e.g., about -2 to about -1). In some embodiments, the organic acid may be about equally soluble in octanol but not in water (i.e., has a logP value of about 0). In some embodiments, the organic acid may be more soluble in octanol than in water (i.e., has a positive logP value, e.g., about 1 to about 6.5). In some embodiments, the organic acid has a logP value of about 1.5 to about 5.0, for example, about 1.5, about 2.0, about 2.5, or about 3.0 to about 3.5, about 4.0, about 4.5, or about 5.0.

[0225] In some embodiments, Nicotiana species may be selected for the content of various compounds present therein. For example, plants may be selected based on the fact that such plants produce relatively large amounts of one or more compounds that are desired to be isolated therefrom. In some embodiments, Nicotiana species plants (e.g., Galpao commun tobacco) are grown specifically for the abundance of compounds on the leaf surface. Tobacco plants may be grown outdoors in greenhouses, growth chambers, or fields, or may be grown hydroponically.
[0226] Various parts or portions of a Nicotiana species plant may be included in the compositions disclosed herein. For example, virtually the entire plant (e.g., the whole plant) may be harvested and used as is. Alternatively, various parts or pieces of the plant may be harvested or separated for further use after harvest. For example, flowers, leaves, stems, stems, roots, seeds, and various combinations thereof may be isolated for further use or processing. In some embodiments, the tobacco material comprises tobacco leaf (lamina). The compositions disclosed herein may include processed tobacco parts or pieces, dried and aged tobacco in essentially natural lamina and / or stem form, tobacco extracts, extracted tobacco pulp (e.g., using water as a solvent) or mixtures of the foregoing (e.g., a mixture combining extracted tobacco pulp with granulated dried and aged natural tobacco lamina).
[0227] In some embodiments, the tobacco material comprises a solid tobacco material selected from the group consisting of lamina and stem. The tobacco used in the mixture most preferably comprises tobacco lamina, or a mixture of tobacco lamina and stem, at least a portion of which is smoked. The tobacco portion in the mixture may have a processed form, such as processed tobacco stems (e.g., cut-rolled stems, cut-roll-expanded stems, or cut-puffed stems) or volume-expanded tobacco (e.g., puffed tobacco, e.g., dry ice expanded tobacco (DIET)). See, for example, the tobacco expansion processes set forth in U.S. Patent Nos. 4,340,073 to de la Burde et al.; 5,259,403 to Guy et al.; and 5,908,032 to Poindexter et al.; and 7,556,047 to Poindexter et al., all of which are incorporated by reference. Additionally, the mixture may optionally incorporate fermented tobacco. See also tobacco processing techniques of the type set forth in PCT Publication WO2005 / 063060 to Atchley et al., which is incorporated herein by reference.
[0228] Tobacco materials are typically used in a form that can be described as particulate (i.e., shredded, ground, granulated, or powdered form). The means by which tobacco materials are provided in a pulverized or powder-type form may vary. Preferably, plant parts or pieces are pulverized, ground, or comminuted into particulate form using equipment and techniques for grinding, milling, and the like. Most preferably, the plant material is in a relatively dry form during grinding or milling using equipment such as hammer mills, cutter heads, air controlled mills. For example, tobacco parts or pieces may be ground or milled when their moisture content is less than about 15% by weight, or less than about 15% by weight. Most preferably, tobacco materials are used in the form of parts or pieces having an average particle size of 1.4 millimeters to 250 microns. In some instances, tobacco particles can be sized to pass through a screen mesh to achieve the required particle size range. If necessary, air classification equipment can be used to ensure that tobacco particles of the desired size or size range can be collected. If necessary, different sized pieces of granulated tobacco may be mixed together.
[0229] The means by which tobacco is provided in pulverized or powder-type form may vary. Preferably, tobacco parts or pieces are pulverized, crushed or finely milled into a powder-type form using equipment and techniques for grinding, milling, and the like. Most preferably, the tobacco is in a relatively dry form during grinding or milling using equipment such as hammer mills, cutter heads, air controlled mills. For example, tobacco parts or pieces may be crushed or milled when their moisture content is less than about 15% to about 5% by weight. For example, tobacco plants or portions thereof may be separated into individual parts or pieces (e.g., leaves may be removed from the stems and / or stems and leaves may be removed from the trunks). Harvested plants or individual parts or pieces may be further subdivided into parts or pieces (e.g., leaves may be chopped, cut, pulverized, finely milled, or crushed into pieces or pieces characterized as filler-type pieces, granules, particulates, or fine powder). The plant or part thereof can be subjected to an external force or pressure (e.g., by pressing or rolling). When such processing conditions are performed, the plant or part thereof can have a moisture content that approximates its natural moisture content (e.g., its moisture content immediately after harvesting), a moisture content achieved by adding moisture to the plant or part thereof, or a moisture content that results from drying the plant or part thereof. For example, a powdered, pulverized, crushed, or milled piece of a plant or part thereof can have a moisture content of less than about 25% by weight, often less than about 20% by weight, and frequently less than about 15% by weight.
[0230] To prepare oral products, harvested plants of Nicotiana species are typically subjected to a curing process. Tobacco materials incorporated into the mixture for inclusion in the products disclosed herein are appropriately cured and / or aged. Descriptions of different types of curing processes for different types of tobacco are set forth in Tobacco Production, Chemistry and Technology, Davis et al. (eds.) (1999). Examples of techniques and conditions for curing flue-cured tobacco are set forth in Nestor et al., Beitrage Tabakforsch. Int., 20, 467-475 (2003) and U.S. Patent No. 6,895,974 to Peele, which are incorporated herein by reference. Exemplary techniques and conditions for air-curing tobacco are set forth in U.S. Patent No. 7,650,892 to Groves et al.; Roton et al., Beitrage Tabakforsch. Int., 21, pp. 305-320 (2005) and Staaf et al., Beitrage Tabakforsch. Int., 21, pp. 321-330 (2005), which are incorporated herein by reference. Certain types of tobacco may be subjected to alternative types of curing processes, such as flame curing or sun curing.
[0231] In certain embodiments, tobacco materials that may be used include flue-cured or Virginia (e.g., K326), Burley, sun-cured (e.g., Indian Kurnool and Oriental tobaccos, including Katerini, Pre-Lip, Komotini, Shanti, and Yambol tobaccos), Maryland, dark, dark flame-cured, dark air-cured (e.g., Madole, Pasanda, Cuban, Jatein, and Bouzouki tobaccos), light air cured (e.g., North Wisconsin and Galpao tobaccos), Indian air cured, Red Russian, and Rustic tobaccos, as well as various other rare or specialty tobaccos and various blends of any of the foregoing tobaccos.
[0232] The tobacco material may have a so-called "blend" form. For example, the tobacco material may include a mixture of parts or pieces of flue-cured, burley (e.g., Malawi burley tobacco) and oriental tobacco (e.g., as tobacco composed of or derived from tobacco lamina or a mixture of tobacco lamina and tobacco stem). For example, a representative blend may incorporate about 30 to about 70 parts burley tobacco (e.g., lamina or lamina and stem) and about 30 to about 70 parts flue-cured tobacco (e.g., stem, lamina or lamina and stem) on a dry weight basis. Other exemplary tobacco blends incorporate about 75 parts flue-cured tobacco, about 15 parts burley tobacco and about 10 parts oriental tobacco; or about 65 parts flue-cured tobacco, about 25 parts burley tobacco and about 10 parts oriental tobacco; or about 65 parts flue-cured tobacco, about 10 parts burley tobacco and about 25 parts oriental tobacco on a dry weight basis. Other exemplary tobacco blends incorporate, on a dry weight basis, from about 20 to about 30 parts Oriental tobacco and from about 70 to about 80 parts flue-cured tobacco.
[0233] The tobacco material used in the present disclosure may be, for example, fermented, bleached. If necessary, the tobacco material may be, for example, irradiated, pasteurized, or otherwise subjected to a controlled heat treatment. Such treatment processes are described in detail, for example, in U.S. Patent No. 8,061,362 to Mua et al., which is incorporated herein by reference. The amount of oral care additive in the composition typically does not exceed about 30%, often does not exceed about 25%, and frequently does not exceed about 20% by total dry weight of the composition.
[0238] Processing Aids Flow aids may also be added to the composition to improve the flowability of the composition if necessary for subsequent processing of the composition, such as granulation, mixing, or molding. In some embodiments, the composition (e.g., melt and chewing tobacco forms) may be surface treated with anti-adherents, such as oils, silicones. Exemplary flow aids include microcrystalline cellulose, silica, polyethylene glycol, stearic acid, calcium stearate, magnesium stearate, zinc stearate, sodium stearyl fumarate, canauba wax, and combinations thereof. In some embodiments, the flow aid is sodium stearyl fumarate.
[0239] When present, a representative amount of flow aid may comprise at least about 0.5 percent, or at least about 1 percent, of the total dry weight of the composition. Preferably, the amount of flow aid in the composition does not exceed about 5 percent, and frequently does not exceed about 3 percent, of the total dry weight of the composition.
[0240] Other Additives Other additives may be included in the disclosed compositions. For example, the compositions may be processed, blended, compounded, combined, and / or mixed with other materials or ingredients. The additives may be artificial or obtained or derived from herbal or biological sources. Examples of additional types of additives include thickening or gelling agents (e.g., fish gelatin), emulsifiers, preservatives (e.g., potassium sorbate), disintegration aids, zinc or magnesium salts selected to be relatively water-soluble for compositions with high water solubility (e.g., magnesium gluconate or zinc gluconate) or relatively water-insoluble for compositions with low water solubility (e.g., magnesium oxide or zinc oxide), or combinations thereof. See, for example, U.S. Patent No. 9,237,769 to Mua et al., U.S. Patent No. 7,861,728 to Holton, Jr. et al., U.S. Patent Application Publication No. 2010 / 0291245 to Gao et al., and U.S. Patent Application Publication No. 2007 / 0062549 to Holton, Jr. et al. for their representative components, combinations of components, equivalents of the components, and means and methods for using such components, each of which is incorporated herein by reference. Typical inclusion ranges for such additional additives may vary depending on the nature and function of the additive and its intended effect on the final composition, with exemplary ranges being up to about 10% by weight (e.g., about 0.1 to about 5% by weight) based on the total weight of the composition.
[0241] In some embodiments, the composition includes a magnesium salt. A non-limiting example of a suitable magnesium salt is magnesium gluconate. In some embodiments, the composition includes about 0.1% to about 2%, or about 0.2 to about 1% by weight of magnesium based on elemental magnesium.
[0242] The aforementioned additives can be used together (e.g., as an additive blend) or separately (e.g., individual additive components can be added at different stages involved in the preparation of the final composition). Furthermore, the aforementioned types of additives can be encapsulated to provide them as a final product or composition. Exemplary encapsulated additives are described, for example, in Atchley's WO2010 / 132444, which is incorporated herein by reference as previously described.
[0243] Preparation of the Composition The means by which the various components of the composition (e.g., filler, water, active ingredient) are combined may vary. Thus, for example, the overall composition with powdered composition components may be relatively homogeneous in nature. The above-mentioned components, which may be in liquid or dry solid form, may be blended in a pre-processing step before mixing with any remaining components of the composition, or may simply be mixed together with all other liquid or dry ingredients. The various components of the composition may be contacted, combined, or mixed together using any mixing technique or equipment known in the art. Any mixing method that brings the composition ingredients into intimate contact may be used, such as a mixing device featuring an impeller or other structure capable of stirring. Examples of mixing equipment include casing drums, conditioning cylinders or drums, liquid spraying devices, cone-type blenders, ribbon blenders, mixers available as FKM130, FKM600, FKM1200, FKM2000 and FKM3000 from Littleford Day, Inc., plowshare-type mixer cylinders, Hobart mixers, etc. See also, for example, the type of methodology set forth in U.S. Patent No. 4,148,325 to Solomon et al.; U.S. Patent No. 6,510,855 to Korte et al.; and U.S. Patent No. 6,834,654 to Williams, each of which is incorporated herein by reference. In some embodiments, the ingredients forming the composition are prepared so that their mixture can be used in a starch molding process to form the composition. Means and methods for blending the composition are clear to those skilled in the art. See, for example, the types of methodologies set forth in U.S. Pat. Nos. 4,148,325 to Solomon et al.; 6,510,855 to Korte et al.; and 6,834,654 to Williams, 4,725,440 to Ridgway et al., and 6,077,524 to Bolder et al., each of which is incorporated herein by reference.
[0244] In some embodiments, any one or more of the components and the entire oral product described herein are described as particulate materials. As used herein, the term "particulate" refers to material in the form of a plurality of individual particles, some of which may be in the form of agglomerates of a plurality of particles, the particles having an average length to width ratio of less than 2:1, such as less than 1.5:1, for example about 1:1. In various embodiments, the particles of particulate materials may be described as substantially spherical or granular.
[0245] The particle size of a particulate material may be measured by sieve analysis. As one skilled in the art will readily appreciate, sieve analysis (otherwise known as gradient testing) is a method used to measure the particle size distribution of a particulate material. Typically, sieve analysis involves a nested column of sieves, including screens, preferably in the form of a wire mesh fabric. A pre-weighed sample may be introduced into the top or uppermost sieve in the column, which has the largest screen opening or mesh size (i.e., the sieve with the largest pore size). Each lower sieve in the column has a screen opening or mesh size that is progressively smaller than the sieve above. Typically, the base portion of the column of sieves is the receiving portion that collects any particles having a particle size smaller than the screen opening or mesh size of the bottom or lowest sieve in the column (which has the smallest screen opening or mesh size).
[0246] In some embodiments, the column of sieves may be placed on or in a mechanical agitator. The agitator causes vibration of each of the sieves in the column. The mechanical agitator may be run for a pre-specified time to ensure that all particles are collected on the correct sieve. In some embodiments, the column of sieves is agitated for a period of time between 0.5 minutes and 10 minutes, such as between 1 minute and 10 minutes, such as between 1 minute and 5 minutes, such as approximately 3 minutes. Once the agitation of the sieves in the column is complete, the material collected on each sieve is weighed. The weight of each sample on each sieve can then be divided by the total weight to obtain the percentage of mass retained on each sieve. As one skilled in the art would readily appreciate, the size of the screen opening or mesh size of each sieve in the column used for sieve analysis may be selected based on the particle size of the sample to be analyzed or the known maximum / minimum particle size. In some embodiments, a column of sieves may be used for the sieve analysis, the column comprising 2 to 20 sieves, for example 5 to 15 sieves. In some embodiments, a column of sieves may be used for the sieve analysis, the column comprising 10 sieves. In some embodiments, the maximum screen opening or mesh size of the sieve used for the sieve analysis may be 1000 μm, for example 500 μm, for example 400 μm, for example 300 μm.
[0247] In some embodiments, any material characterized in particulate form as referred to herein (e.g., fillers, tobacco materials, and entire oral products) may have at least 50% by weight of particles having a particle size as measured by sieve analysis of not greater than about 1000 μm, such as not greater than about 500 μm, such as not greater than about 400 μm, such as not greater than about 350 μm, such as not greater than about 300 μm. In some embodiments, at least 60% by weight of the particles of any particulate material referred to herein have a particle size as measured by sieve analysis of not greater than about 1000 μm, such as not greater than about 500 μm, such as not greater than about 400 μm, such as not greater than about 350 μm, such as not greater than about 300 μm. In some embodiments, at least 70% by weight of the particles of any particulate material referred to herein have a particle size, as measured by sieve analysis, of not greater than about 1000 μm, such as not greater than about 500 μm, such as not greater than about 400 μm, such as not greater than about 350 μm, such as not greater than about 300 μm. In some embodiments, at least 80% by weight of the particles of any particulate material referred to herein have a particle size, as measured by sieve analysis, of not greater than about 1000 μm, such as not greater than about 500 μm, such as not greater than about 400 μm, such as not greater than about 350 μm, such as not greater than about 300 μm. In some embodiments, at least 90% by weight of the particles of any particulate material referred to herein have a particle size, as measured by sieve analysis, of not greater than about 1000 μm, such as not greater than about 500 μm, such as not greater than about 400 μm, such as not greater than about 350 μm, such as not greater than about 300 μm. In some embodiments, at least 95% by weight of the particles of any particulate material referred to herein have a particle size, as measured by sieve analysis, of not greater than about 1000 μm, such as not greater than about 500 μm, such as not greater than about 400 μm, such as not greater than about 350 μm, such as not greater than about 300 μm.In some embodiments, at least 99% by weight of the particles of any particulate material referred to herein have a particle size, as measured by sieve analysis, of not greater than about 1000 μm, such as not greater than about 500 μm, such as not greater than about 400 μm, such as not greater than about 350 μm, such as not greater than about 300 μm. In some embodiments, approximately 100% by weight of the particles of any particulate material referred to herein have a particle size, as measured by sieve analysis, of not greater than about 1000 μm, such as not greater than about 500 μm, such as not greater than about 400 μm, such as not greater than about 350 μm, such as not greater than about 300 μm.
[0248] In some embodiments, at least 50% by weight, such as at least 60% by weight, such as at least 70% by weight, such as at least 80% by weight, such as at least 90% by weight, such as at least 95% by weight, such as at least 99% by weight, of the particles of any particulate material referred to herein have a particle size of from about 0.01 μm to about 1000 μm, such as from about 0.05 μm to about 750 μm, such as from about 0.1 μm to about 500 μm, such as from about 0.25 μm to about 500 μm, as measured by sieve analysis. In some embodiments, at least 50% by weight, such as at least 60% by weight, for example at least 70% by weight, such as at least 80% by weight, for example at least 90% by weight, such as at least 95% by weight, for example at least 99% by weight, of the particles of any particulate material referred to herein have a particle size of from about 10 μm to about 400 μm, such as from about 50 μm to about 350 μm, for example from about 100 μm to about 350 μm, such as from about 200 μm to about 300 μm, as measured by sieve analysis.
[0249] In one embodiment, a method for preparing a composition disclosed herein is provided, comprising mixing a filler, at least one active ingredient and a salt to form a first mixture, and adding water to the first mixture to form a composition. In some embodiments, the method further comprises adding one or more binders to the first mixture. In some embodiments, the method further comprises adding a buffer, one or more sweeteners, humectants, flavorings, or combinations thereof to the first mixture. In some embodiments, the method further comprises adding additional water to the composition.
[0250] In another aspect, there is provided a composition prepared by the methods disclosed herein.
[0251] Constructed for oral use A product configured for oral use is provided herein. As used herein, the term "configured for oral use" means that the product is provided in such a form that, during use, the saliva in the user's oral cavity passes one or more of the components of the composition (e.g., flavoring agent and / or active ingredient) into the user's oral cavity. In some embodiments, the product is adapted to deliver an ingredient to the user through the mucous membrane in the user's oral cavity, the user's digestive system, or both, and in some examples, the ingredient is an active ingredient (e.g., including but not limited to, stimulants, vitamins, taste modifiers, or combinations thereof) that can be absorbed through the mucous membrane in the oral cavity or absorbed through the digestive tract when the product is used.
[0252] The products configured for oral use described herein may take a variety of forms including gels, troches, gums, lozenges, powders and pouches. Gels may be soft or hard. Some products configured for oral use are in the form of troches. As used herein, the term "lozenges" refers to a dissolvable oral product made by solidifying a liquid or gel composition such that the final product is a semi-firm solid gel. The stiffness of the gel is highly variable. Some products of the present disclosure are in solid form. Some products may exhibit, for example, one or more of the following characteristics: crispy, granular, chewy, syrupy, pasty, fluffy, smooth and / or creamy. In some embodiments, the desired textural properties may be selected from the group consisting of adhesiveness, stickiness, density, dryness, brittleness, granularity, stickiness, hardness, weight, moisture absorption, moisture release, mouth coating, roughness, slipperiness, smoothness, viscosity, wettability and combinations thereof.
[0253] Products including compositions of the present disclosure may be dissolvable. As used herein, the terms "dissolve", "dissolving" and "dissolvable" refer to compositions having water-soluble components that interact with moisture in the oral cavity and go into solution, thereby causing gradual consumption of the product. According to one embodiment, the dissolvable product is capable of remaining in the oral cavity of the user for a period of time until it completely dissolves. The dissolution rate may vary over a wide range, from about 1 minute or less to about 60 minutes. For example, a rapid release composition typically dissolves and / or releases the active substance in about 2 minutes or less, often about 1 minute or less (e.g., about 50 seconds or less, about 40 seconds or less, about 30 seconds or less, or about 20 seconds or less). Dissolution may occur by any means, such as melting, mechanical disruption (e.g., chewing), enzymatic or other chemical degradation, or disruption of interactions between the components of the composition. In some embodiments, the product may be meltable, for example as discussed in U.S. Patent Application Publication No. 2012 / 0037175 to Cantrell et al., while in other embodiments the product does not dissolve during residence of the product in the user's mouth.
[0254] In one embodiment, the product comprising the composition of the present disclosure is in the form of a composition disposed in a moisture-permeable container (e.g., a water-permeable pouch). Such compositions in a water-permeable pouch format are typically used by placing one pouch containing the composition in the oral cavity of a human subject / user. Generally, the pouch is placed somewhere in the oral cavity of the user, e.g., under the lips, in the same way that moist snuff products are typically used. The pouch is preferably not chewed or swallowed. Exposure to saliva then causes some of the components of the composition therein (e.g., flavoring agents and / or active ingredients) to pass through, e.g., the water-permeable pouch, providing flavor and satisfaction to the user, without the user having to expectorate any part of the composition. After about 10 to about 60 minutes, typically about 15 to about 45 minutes of use / tasting, a substantial amount of the composition has been absorbed through the oral mucosa in the human subject, and the pouch can be removed from the oral cavity of the human subject for disposal.
[0255] Thus, in an embodiment, the composition disclosed herein and any other components mentioned above are combined in a moisture-permeable sachet or pouch that acts as a container for using the composition to obtain a pouched product configured for oral use. Some embodiments of the present disclosure are described with reference to FIG. 1 of the accompanying drawings, and these described embodiments involve a snus-type product having an outer pouch and containing the composition described herein. As will be explained in more detail below, such embodiments are shown by way of example only, and the pouched product of the present disclosure may contain compositions in other forms. The composition / construction of such a sachet or pouch, for example the container pouch 102 in the embodiment illustrated in FIG. 1, may vary. Referring to FIG. 1, a first embodiment of a pouched product 100 is shown. The pouched product 100 includes a moisture-permeable container in the form of a pouch 102, which contains a material 104 that includes the composition described herein.
[0256] Any suitable sachet, pouch or container of the type used to manufacture smokeless tobacco products can be used in this embodiment in the pouch. Examples of such smokeless tobacco products are available under the trade names CatchDry, Ettan, General, Granit, Goteborgs Rape, Grovsnus White, Metropol Kaktus, Mocca Anis, Mocca Mint, Mocca Wintergreen, Kicks, Probe, Prince, Skruf and TreAnkrare. The composition can be contained and packaged in the pouch by using the type of ingredients used to manufacture traditional snus-type products. The pouch provides a type of liquid-permeable container that is considered to be similar in characteristics to the mesh-type materials used in the construction of tea bags. The ingredients of the composition diffuse immediately through the pouch into the mouth of the user.
[0257] Non-limiting examples of suitable types of pouches are set forth, for example, in U.S. Pat. No. 5,167,244 to Kjerstad and U.S. Pat. No. 8,931,493 to Sebastian et al.; and U.S. Patent Application Publication Nos. 2016 / 0000140 to Sebastian et al.; 2016 / 0073689 to Sebastian et al.; 2016 / 0157515 to Chapman et al.; and 2016 / 0192703 to Sebastian et al., each of which is incorporated herein by reference. The resulting pouches, either as individual pouches or as multiple pouches (e.g., 2, 4, 5, 10, 12, 15, 20, 25 or 30 pouches), can be strung or linked together (e.g., end to end) so that a single pouch or individual portions can be readily removed for use from an integral strand or matrix of pouches.
[0258] Exemplary pouches may be manufactured from materials and means that cause the pouch to undergo controlled dispersion or dissolution during use by the user. Such pouch materials may have the form of mesh, screen, perforated paper, permeable fabric, and the like. For example, a pouch material manufactured from rice paper in a mesh form or perforated rice paper may dissolve in the oral cavity of the user. As a result, both the pouch and the composition may be ingested by the user, since each of the pouch and the composition may undergo complete dispersion in the oral cavity of the user under normal use conditions. Other examples of pouch materials may be manufactured using materials that form water-dispersible films (e.g., binders, e.g., alginates, carboxymethylcellulose, xanthan gum, pullulan), as well as materials such as ground cellulose derivatives (e.g., finely divided wood pulp). Preferred pouch materials are water-dispersible or dissolvable, but may be designed and manufactured such that a significant amount of the composition contents will permeate through the pouch material under normal use conditions before the pouch experiences loss of physical integrity. If desired, flavoring materials, disintegration aids and other desired ingredients may be incorporated within or applied to the pouch material.
[0259] The amount of material contained in each product unit, e.g., pouch, may vary. In some embodiments, the weight of the composition in each pouch is at least about 50 mg, e.g., about 50 mg to about 2 grams, about 100 mg to about 1.5 grams, or about 200 to about 700 mg. In some smaller embodiments, the weight of the composition in each pouch may be about 100 to about 300 mg. In larger embodiments, the weight of the material in each pouch may be about 300 mg to about 700 mg. Other ingredients may be contained in each pouch, as desired. For example, at least one flavor strip, piece, or sheet of flavored water-dispersible or water-soluble material (e.g., a breath freshening edible film-type material) may be placed in each pouch, with or without at least one capsule. Such strips or sheets may be folded or rolled for easy incorporation into the pouch. See, for example, U.S. Pat. Nos. 6,887,307 to Scott et al. and 6,923,981 to Leung et al.; and materials and techniques of the type set forth in The EFSA Journal (2004) 85, 1-32, which are incorporated herein by reference.
[0260] In certain embodiments, one or more active ingredients described herein are included in a composition within a pouched product, and one or more additional active ingredients are disposed within or on the exterior surface of the product (e.g., on or in a pouch material disclosed herein). In some embodiments, the active ingredients at different sites may allow for staggered release profiles (e.g., one active ingredient may be immediately available to the oral cavity and / or digestive system, while another active ingredient may be released more gradually relative to use of the product).
[0261] The pouched products described herein may be packaged within any suitable inner packaging material and / or outer container, such as those utilized for smokeless tobacco products (see, for example, U.S. Patent Nos. 7,014,039 to Henson et al.; 7,537,110 to Kutsch et al.; 7,584,843 to Kutsch et al.; 8,397,945 to Gelardi et al.; D592,956 to Thiellier; D594,154 to Patel et al.; and D625,178 to Bailey et al.; U.S. Patent Publication Nos. 2008 / 0173317 to Robinson et al.; 2009 / 0014343 to Clark et al.; 2009 / 0014450 to Bjorkholm; and 200 See, for example, US Pat. No. 9 / 0250360; Gelardi et al., US Pat. No. 2009 / 0266837; Gelardi, US Pat. No. 2009 / 0223989; Thiellier, US Pat. No. 2009 / 0230003; Gelardi, US Pat. No. 2010 / 0084424; and Bailey et al., US Pat. No. 2010 / 0133140; Bailey et al., US Pat. No. 2010 / 0264157; and Bailey et al., US Pat. No. 2011 / 0168712, which are incorporated herein by reference, for various types of containers for smokeless type products.
[0262] In a further aspect, there is provided a composition configured to deliver an active ingredient to a user through contact with moisture in the oral cavity, the composition comprising: a filler in an amount of at least 20% by weight, based on the total weight of the composition; at least one active ingredient comprising one or more botanical materials, stimulants, amino acids, vitamins, antioxidants, nicotine components, cannabinoids, pharmaceuticals, or combinations thereof; a salt; and at least one sweetener, wherein the product composition has a moisture content of at least about 40% by weight, based on the total weight of the composition.
