Description

[Technical field]

[0001] This application claims priority to U.S. Provisional Patent Application No. 62 / 254,739, filed November 13, 2015, which is incorporated by reference in its entirety.

[0002] TECHNICAL FIELD OF THEINVENTION The present invention generally relates to novel compositions, and methods for their preparation and therapeutic use. In particular, the present invention relates to novel pharmaceutical compositions that combine berberine (BBR) with omega-3 fatty acids, such as eicosapentaenoic acid (EPA) and / or docosahexaenoic acid (DHA), or esters thereof, and methods for their use. The pharmaceutical compositions of the present invention are useful in treating and / or preventing various diseases or disorders, including metabolic diseases or disorders such as dyslipidemia, hyperglycemia, hypertriglyceridemia, hyperlipidemia, diabetic dyslipidemia, diabetic hyperlipidemia, dyslipidemia in statin intolerant patients, diabetes, diabetic complications, hypercholesterolemia, or obesity. In addition, the pharmaceutical compositions of the present invention are useful in treating and / or preventing atherosclerosis, heart disease, neurodegenerative diseases, inflammation, cancer, and various liver diseases or disorders, such as fatty liver, nonalcoholic fatty liver disease, nonalcoholic steatohepatitis, cholestatic liver disease, or hepatic graft-versus-host disease. Additionally, the pharmaceutical compositions of the present invention are useful in improving liver function in chronic viral-related and alcohol-related liver diseases. [Background technology]

[0003] 2. Background of the Invention Dyslipidemia is a disorder of lipoprotein metabolism, including overproduction (hyperlipidemia) or deficiency of lipoproteins. Dyslipidemia can be manifested by elevated blood total cholesterol, "bad" low-density lipoprotein cholesterol, and triglyceride concentrations, and decreased "good" high-density lipoprotein cholesterol concentrations. Dyslipidemia is postulated in many conditions, including diabetes, which is a common cause of dyslipidemia.

[0004] Hyperlipidemia (or hyperlipoproteinemia) is the most common form of dyslipidemia. Hyperlipidemia is characterized by abnormally elevated levels of any or all lipids and / or lipoproteins in the blood. Diagnosis is by measuring plasma levels of total cholesterol, triglycerides, and individual lipoproteins. Treatment includes dietary modification, exercise, and lipid-lowering drugs. Hyperlipidemia is divided into primary and secondary subtypes. Primary hyperlipidemia is usually due to genetic causes (such as mutations in receptor proteins), whereas secondary hyperlipidemia results from other underlying causes such as diabetes. Lipid and lipoprotein abnormalities are considered modifiable risk factors for cardiovascular disease due to their effects on atherosclerosis.

[0005] Hyperglycemia is a condition characterized by excessive glucose circulation in plasma.Hyperglycemia can become a serious condition if not treated in a timely manner, and requires immediate treatment, because it can lead to ketoacidosis, a life-threatening condition.Chronic hyperglycemia causes damage to the heart and is strongly associated with heart attack and death in subjects who do not have a history of coronary heart disease or heart failure.

[0006] Diabetes is a metabolic disorder. It has become epidemic, and today it is estimated that more than 300 million people worldwide are living with diabetes. With no effective prevention, this number will increase to 500 million by 2030. There are three main types of diabetes: type 1 diabetes, type 2 diabetes, and gestational diabetes. Of these, type 2 diabetes is the most common form of diabetes, accounting for 90-95% of cases. Type 2 diabetes is characterized by impaired insulin secretion, increased hepatic glucose production, and reduced response of peripheral tissues to insulin, i.e., insulin resistance. Many therapeutic procedures are available for the management of type 2 diabetes, but are often associated with various side effects. Optimal treatment should be safe and include early initiation of combination drugs with complementary mechanisms of action.

[0007] Despite sustained efforts and meaningful progress over the past decades in understanding and managing diabetes, diabetic patients remain at high risk for, and many suffer from, several serious cardiovascular, ocular, renal, and neurological complications due to hyperglycemia, high cholesterol, and high blood pressure. Cardiovascular disease is the most common cause of death in diabetic patients. Diabetic nephropathy, caused by damage to the small blood vessels in the kidneys, leads to overall kidney function decline or failure. Diabetic neuropathy is caused by damage to nerves throughout the body when blood sugar levels and blood pressure are too high. Most diabetic patients develop diabetic retinopathy, which leads to vision loss or blindness. Consistently high levels of blood sugar, along with high blood pressure and high cholesterol, are the main causes of diabetic retinopathy. Despite the development of several antidiabetic drugs, there is an unmet need for therapeutic agents that can be effectively used to treat and manage diabetic complications.

[0008] Metabolic syndrome is a term referring to a group of risk factors that occur together (e.g., abdominal (central) obesity, elevated blood pressure, elevated fasting plasma glucose, high serum triglycerides, and low high-density cholesterol (HDL) levels). Metabolic syndrome has been shown to increase the risk of developing cardiovascular disease, especially heart failure, and diabetes. Studies estimate the prevalence of metabolic syndrome in the United States to be about 34% in the adult population. Although therapeutic drugs are available, the first-line treatment is lifestyle modification. High-dose statins are recommended to reduce cardiovascular risk, but have been linked to a more advanced progression to diabetes, especially in patients with metabolic syndrome.

[0009] Cardiovascular disease (CV), often used interchangeably with the term "heart disease," refers to a range of conditions that affect the heart, including coronary artery disease, arrhythmias, congestive heart failure, and cerebrovascular disease. Many forms of CV can be prevented or treated by healthy lifestyle choices, controlling conditions such as atherosclerosis, hypertension, diabetes, or obesity with a variety of medications, including antiplatelet agents, anticoagulants, digitalis, angiotensin-converting enzyme (ACE) inhibitors, beta-blockers, and LDL cholesterol-lowering drugs. Comorbidities often require patients to take multiple medications, and it would be desirable if one pill could target multiple abnormalities.

[0010] Statins are one of the most widely prescribed drugs due to their proven ability to prevent cardiovascular disease. Although statins are generally well tolerated, statin intolerance occurs in some patients and requires careful consideration. In addition, patients are sometimes concerned about the potential risks of statins in causing diabetes mellitus, cancer, and memory loss, and often doubt whether they should continue the drug. For statin-intolerant patients, nonstatin LDL-C-lowering drugs can be used; however, until the approval of PCSK9 inhibitors, there were no approved drugs that were as effective as statins. For these patients, the development of alternative effective therapeutic agents is greatly needed.

[0011] Neurodegenerative diseases are a general term for a series of conditions that primarily affect neurons in the human brain. Neurons are the building blocks of the nervous system, including the brain and spinal cord. Neurons do not normally regenerate or replace themselves when damaged or killed. Examples of neurodegenerative diseases include Parkinson's disease, Alzheimer's disease, and Huntington's disease. Neurodegenerative diseases are incurable, debilitating conditions that result in the progressive degeneration and / or death of nerve cells. The unmet medical need for neurodegenerative diseases urgently requires the development of effective therapeutic agents.

[0012] Cancer is a group of diseases associated with abnormal cell growth that has the potential to invade or spread to other parts of the body. In 2012, approximately 14 million new cancer cases occurred worldwide. The most common types of cancer include lung, prostate, colorectal and gastric cancer in men, and breast, colorectal, lung and cervical cancer in women. Although many treatment options exist for cancer, including surgery, chemotherapy, radiation therapy, hormone therapy, targeted therapy and palliative care, cancer remains the greatest threat to health and is responsible for approximately 15% of all human deaths.

[0013] Fatty liver is a reversible condition in which large vacuoles of triglyceride fat accumulate in liver cells through a process of steatosis. Despite having multiple causes, fatty liver can be considered a single disease occurring worldwide in obese people with excessive alcohol intake. Nonalcoholic fatty liver disease (NAFLD) is a form of fatty liver disease that occurs when excess fat is deposited in the patient's liver without excessive alcohol intake. NAFLD is generally recognized to be associated with metabolic syndromes such as insulin resistance, hypertension, and obesity. Approximately one-third of the adult population in developed countries suffers from NAFLD. Nonalcoholic steatohepatitis (NASH) is the most extreme form of NAFLD, with progressive fibrosis (scarring), cirrhosis, and chronic inflammation that can eventually lead to liver failure and death. NASH is similar to alcoholic liver disease, but occurs in people who drink little or no alcohol. The main characteristic of NASH is fat in the liver, accompanied by inflammation and damage. Often a "silent" liver disease, most people with NASH feel fine and are unaware that they have liver problems. Nonetheless, NASH can be severe and can lead to cirrhosis if the liver becomes permanently damaged, scarred, and no longer works properly.

[0014] There are currently no drugs approved for the treatment of NASH, which occurs in approximately one-quarter of patients with NAFLD. The current standard of care for NASH involves weight loss and increased physical activity. NASH affects 2-5% of Americans and is likely becoming more common due to the growing number of Americans who are obese. Over the past decade, the prevalence of obesity has doubled in adults and tripled in children.

[0015] The available treatments and methods for managing diseases or disorders such as diabetes, diabetic complications, dyslipidemia, obesity, metabolic syndrome, prediabetes, heart disease, neurodegenerative disease, NAFLD, NASH, muscle atrophy, inflammation and cancer are suboptimal. There is an ongoing and urgent need for new and improved therapies and methods for treating such diseases or disorders. Summary of the Invention

DETAILED DESCRIPTION OF THE PREFERRED EMBODIMENTS

[0025] Detailed Description of the Invention The following description in conjunction with the figures and examples is intended to illustrate the problems solved by the invention and advantageous implementations of the invention, but is not intended to limit the invention.

[0026] Unless otherwise specified, all technical and scientific terms used herein have the same meaning as commonly understood by one of ordinary skill in the art to which this invention belongs. General principles of organic chemistry, as well as specific functional moieties and reactivities, are described in "Organic Chemistry", Thomas Sorrell, University Science Books, Sausalito: 2006.

[0027] Certain compounds of the present invention may exist in specific geometric or stereoisomeric forms. The present invention contemplates all such compounds as being within the scope of the present invention, including cis- and trans-isomers, R- and S-enantiomers, diastereomers, (D)-isomers, (L)-isomers, racemic mixtures thereof, and other mixtures. Additional asymmetric carbon atoms may be present in a substituent, such as an alkyl group. All such isomers, as well as mixtures thereof, are intended to be included in the present invention.

[0028] Isomeric mixtures containing any of a variety of isomeric ratios may be used in accordance with the present invention. For example, when combining only two isomers, mixtures containing isomeric ratios of 50:50, 60:40, 70:30, 80:20, 90:10, 95:5, 96:4, 97:3, 98:2, 99:1, or 100:0 are contemplated by the present invention. Those skilled in the art will readily understand that similar ratios are contemplated for more complex isomeric mixtures.

[0029] For example, if a particular enantiomer of a compound of the invention is desired, it may be prepared by asymmetric synthesis or by derivatization with a chiral auxiliary, where the resulting diastereomeric mixture is separated and the auxiliary group is cleaved to give the pure desired enantiomer. Alternatively, if the molecule contains a basic functional group such as amino, or an acidic functional group such as carboxyl, diastereomeric salts can be formed with a suitable optically active acid or base, followed by resolution of the diastereomers so formed by fractional crystallization or chromatographic methods well known in the art, followed by recovery of the pure enantiomers.

[0030] Given the benefit of this disclosure, one skilled in the art will understand that the synthetic methods described herein may use various protecting groups. The term "protecting group" as used herein means to temporarily block a specific functional moiety, e.g., O, S, or N, so that reaction can be selectively carried out at another reactive site of a multifunctional compound. In a preferred embodiment, the protecting group reacts selectively in good yield to produce a protected substrate that is stable to the planned reaction; the protecting group should be selectively removable in good yield by a readily available, non-toxic reagent that preferably does not attack other functional groups; the protecting group forms an easily separable derivative (more preferably, without the generation of a new stereogenic center); and the protecting group has a minimum of additional functional groups to avoid further reactive sites. Oxygen, sulfur, nitrogen, and carbon protecting groups may be used. Examples of various protecting groups can be found in Protective Groups in Organic Synthesis, Third Ed. Greene, TW and Wuts, PG, Eds., John Wiley & Sons, New York: 1999.

[0031] It will be understood that the compounds described herein may be substituted with any number of substituents or functional moieties. Throughout the specification, groups and substituents thereof may be selected to provide stable moieties and compounds.

[0032] As used herein, the term "effective amount" of an active substance refers to an amount sufficient to induce a desired biological response. As will be understood by those skilled in the art, the effective amount of the compound of the present invention may vary depending on factors such as the desired biological end point, the pharmacokinetics of the compound, the disease being treated, the mode of administration, and the patient.

[0033] As used herein, the term "treating, ameliorating, or preventing a disease or disorder" refers to ameliorating such a condition before it occurs or after it has occurred. The degree of such amelioration or prevention, as compared to an equivalent untreated control, is at least 5%, 10%, 20%, 40%, 50%, 60%, 80%, 90%, 95%, or 100%, as measured by any standard technique.

[0034] As used herein, the term "pharmaceutically acceptable excipient, carrier, or diluent" refers to a pharma- ceutically acceptable material, composition, or vehicle, such as a liquid or solid filler, diluent, excipient, solvent, or encapsulating material, that is involved in carrying or transporting a drug of interest from one organ or part of the body to another organ or part of the body. Each carrier must be "acceptable" in the sense of being compatible with the other ingredients in the formulation and not injurious to the patient. Some examples of materials which can serve as pharma- ceutically acceptable carriers include: sugars such as lactose, glucose, and sucrose; starches such as corn starch and potato starch; cellulose and its derivatives, such as sodium carboxymethylcellulose, ethylcellulose, and cellulose acetate; powdered tragacanth; malt; gelatin; talc; excipients such as cocoa butter and suppository waxes; oils such as peanut oil, cottonseed oil, safflower oil, sesame oil, olive oil, corn oil, and soybean oil; glycols such as propylene glycol; polyols such as glycerin, sorbitol, mannitol, and propylene glycol; esters such as ethyl oleate and ethyl laurate; agar; buffers such as magnesium hydroxide and aluminum hydroxide; alginic acid; pyrogen-free water; isotonic saline; Ringer's solution; ethyl alcohol; phosphate buffers; and other non-toxic compatible substances used in pharmaceutical preparations. Wetting agents, emulsifying agents, and lubricants such as sodium lauryl sulfate, magnesium stearate, and polyethylene oxide-polypropylene oxide copolymers, as well as coloring agents, release agents, coating agents, sweetening, flavoring and perfuming agents, preservatives and antioxidants can also be present in the composition.

[0035] As used herein, the terms "isolated" or "purified" refer to material that is substantially or essentially free from components that normally accompany it in its native state. Purity and homogeneity are typically determined using analytical chemistry techniques such as polyacrylamide gel electrophoresis or high performance liquid chromatography.

[0036] The term "subject" as used herein means any animal (e.g., mammal), including but not limited to humans, non-human primates, rodents, etc., that will be the recipient of a particular treatment. Typically, the terms "subject" and "patient" are used interchangeably herein in reference to human subjects.

[0037] As used herein, "sufficient amount" refers to the amount of compound, alone or in combination with another therapy, required to treat, prevent or alleviate metabolic disorders such as diabetes in a clinically relevant manner. For the therapeutic treatment of conditions caused by or contributing to diabetes, the sufficient amount of active compound used to carry out the present invention varies according to the mode of administration, the age, weight and general health of the mammal or patient.Ultimately, the prescriber will determine the appropriate amount and method of administration. In addition, effective amount may be the amount of compound in the combination of the present invention that is determined and approved by regulatory authorities (such as the U.S. Food and Drug Administration) to be safer and more effective in treating patients with metabolic disorders such as diabetes than each agent alone.

[0038] As used herein, "low dose" means at least 5% (e.g., at least 10%, 20%, 50%, 80%, 90%, or 95%) less than the lowest standard recommended dose of a particular compound formulated for a given route of administration for the treatment of any human disease or condition. For example, a low dose of an agent that lowers glucose levels and is formulated for administration by inhalation will be different from a low dose of the same agent formulated for oral administration.

[0039] As used herein, "high dose" means at least 5% (e.g., at least 10%, 20%, 50%, 100%, 200%, or 300%) more than the highest standard recommended dose of a particular compound for the treatment of any human disease or condition.

[0040] Isotopically labeled compounds are also within the scope of the present disclosure. As used herein, "isotopically labeled compounds" refers to the compounds of the present disclosure, including its pharmaceutical salts and prodrugs, each of which is described herein, in which one or more atoms are replaced with atoms that have different atomic mass or mass number from the atomic mass or mass number that is usually found in nature. The examples of isotopes that can be incorporated into the compounds of the present disclosure include the isotopes of hydrogen, carbon, nitrogen, oxygen, phosphorus, fluorine and chlorine, such as 2H, 3H, 13C, 14C, 15N, 18O, 17O, 31P, 32P, 35S, 18F and 36Cl, respectively.

[0041] By isotopically labeling the compounds of the present disclosure, the compounds can be useful in drug and / or substrate tissue distribution assays.Tritium (3H) and carbon-14 (14C) labeled compounds are particularly preferred due to their ease of preparation and detectability. In addition, substitution with heavier isotopes such as deuterium (2H) can provide certain therapeutic advantages as a result of increased metabolic stability, for example, increased half-life in vivo or reduced required dose, and therefore may be preferred in some situations. The isotopically labeled compounds of the present disclosure, including pharmaceutical salts, esters, and prodrugs thereof, can be prepared by any means known in the art.

[0042] Furthermore, the replacement of the normally abundant hydrogen (1H) with a heavier isotope such as deuterium can provide certain therapeutic benefits, for example as a result of improved absorption, distribution, metabolism and / or excretion (ADME) properties, creating drugs with improved efficacy, safety and / or tolerability. Benefits may also be obtained from the replacement of the normally abundant 12C with 13C. See WO 2007 / 005643, WO 2007 / 005644, WO 2007 / 016361 and WO 2007 / 016431.

[0043] All stereoisomers (e.g., cis and trans isomers) and all optical isomers (e.g., R and S enantiomers) of the compounds of the present disclosure, as well as racemic, diastereomeric and other mixtures of such isomers, are within the scope of the present disclosure.

[0044] After their preparation, the compounds of the invention are preferably isolated and purified to obtain compositions containing 95% or more by weight ("substantially pure"), which are then used or formulated as described herein. In certain embodiments, the compounds of the invention are greater than 99% pure.

[0045] Solvates and polymorphs of the compounds of the invention are also contemplated herein. Solvates of the compounds of the invention include, for example, hydrates.

[0046] Possible formulations include those suitable for oral, sublingual, buccal, parenteral (e.g., subcutaneous, intramuscular, or intravenous), rectal, topical including transdermal, nasal, and inhalation administration. [0051] Berberine (5,6-dihydro-9,10-dimethoxybenzo[g]-1,3-benzodioxolo[5,6-a]quinolizinium), an isoquinoline alkaloid isolated from Rhizoma Coptidis, has a long history of medicinal use in China to treat various gastrointestinal disorders. Berberine is found in a variety of plants, such as Berberis, Hydrastis canadensis, Xanthorhiza simplicissima, Phellodendron amurense, Coptis chinensis, Tinospora cordifolia, Argemone mexicana, and Eschscholzia californica. Over the past two decades, in vitro and in vivo studies have demonstrated the efficacy of berberine, alone or in combination, in diabetes, dyslipidemia, cancer, neuroprotection, and cardiovascular disease.

[0105] The following examples are illustrative of the practice of the present invention and are not intended to be limiting in any manner. EXAMPLES

[0106] Example 1: Pharmacokinetic properties of berberine and EPA / DHA combinations in rats and dogs This example describes in vivo studies in rats and dogs on the pharmacokinetic (PK) properties of the combination of berberine (BBR) with EPA and / or DHA disclosed in this invention.

[0107] After 7 days of acclimation, healthy male Sprague-Dawley (SD) rats weighing 210-250 g were randomly divided into three groups (3 rats per group) as follows: TIFF2024014894000004.tif32151

[0108] Rats in each group were orally treated with a suspension of the corresponding test article shown above in 0.5% tragacanth gum. Blood samples of the test animals were collected before dosing and at 15 minutes, 30 minutes, 1 hour, 1.5 hours, 2 hours, 4 hours, 8 hours, and 24 hours after dosing. The collected blood samples (approximately 400 μL) were placed into tubes containing sodium heparin and centrifuged at 8,000 rpm for 6 minutes at 4°C to separate plasma. The plasma obtained from each sample was stored at -80°C until analysis.

[0109] Plasma concentrations of BBR and EPA were determined using tandem mass spectrometry (LC-MS / MS). PK parameters were calculated using the non-compartmental module of WinNonlin® Professional 5.2 (Pharsight; St. Louis MO). The abbreviation AUC(0-t) represents the area under the curve from the time of dosing to the time of last observation, AUC(0-∞) represents the area under the curve from the time of dosing to infinity, and Cmax represents the maximum concentration detected. The concentration-time curves and selected PK parameters are shown in Table 1 below.

[0110] (Table 1) Selected pharmacokinetic parameters of BBR in SD rats after a single oral dose TIFF2024014894000005.tif60128

[0111] In another single-dose pharmacokinetic study in rats, after 7 days of acclimation, healthy male Sprague-Dawley (SD) rats weighing 210–250 g were randomly divided into 6 groups (5 rats per group) as follows: TIFF2024014894000006.tif51165

[0112] Rats in each group were orally treated with a suspension of the corresponding test article shown above in 0.5% tragacanth gum.

[0113] Plasma concentrations of BBR and EPA were determined and PK parameters were calculated. Concentration-time curves and selected PK parameters are shown in Figures 2-3 and Table 2 below.

[0114] (Table 2) Selected pharmacokinetic parameters of BBR in SD rats after a single oral dose TIFF2024014894000007.tif57128

[0115] In a single-dose pharmacokinetic study in dogs, six healthy male beagle dogs weighing 9.95-11.45 Kg were randomly divided into two groups (3 dogs per group) as follows: TIFF2024014894000008.tif21128

[0116] Dogs in each group were orally treated with the corresponding test article shown above. Blood samples of test animals were collected before dosing and at 15 minutes, 30 minutes, 1 hour, 1.5 hours, 2 hours, 4 hours, 8 hours, and 24 hours after dosing. Blood samples (approximately 400 μL) were collected and placed into tubes containing sodium heparin and centrifuged at 8000 rpm for 6 minutes at 4°C to separate plasma. Plasma obtained from each sample was stored at -80°C until analysis.

[0117] Plasma concentrations of BBR were measured and PK parameters were calculated. After a single oral dose of hard capsules (200 mg BBR / capsule), BBR plasma concentrations at all collection points in two of three dogs were below the LLOQ (0.1 ng / mL); only one dog had measurable BBR plasma concentrations, with Cmax and AUC(0-24h) of 0.42 ng / mL and 7.40 ng / mL*h, respectively. After a single oral dose of softgel capsules (200 mg BBR / capsule), mean Cmax and AUC(0-24h) were 8.67 ng / mL and 63.42 ng / mL*h, respectively. Concentration-time curves and selected PK parameters are shown in the figures and in Table 3 below.

[0118] (Table 3) Selected pharmacokinetic parameters of BBR in beagle dogs after a single oral dose TIFF2024014894000009.tif36149* Only one dog had measurable BBR plasma concentrations.

[0119] The above experimental results show that the combination of BBR and EPA / DHA synergistically improves the bioavailability of BBR, as evidenced by the increased Cmax and AUC, compared to BBR administered alone. The increased exposure level is influenced by the ratio of BBR to EPA / DHA; however, it is not strictly dose-dependent. The preferred ratio of BBR to EPA / DHA was found to be in the range of about 1:1 to about 1:3.

[0120] The results demonstrate that the combination of BBR and EPA / DHA provides significantly improved pharmacokinetic properties.More specifically, in HFD / STZ-induced diabetic dyslipidemia mouse model, the combination of BBR and EPA / DHA is shown to effectively improve glucose homeostasis;reduce TC, TG and LDL-c in serum;reduce TC, TG in liver tissue;reduce elevated liver enzymes and improve liver function;reduce oxidative stress in liver;reduce liver index;and improve pancreatic index, compared with BBR used alone.
