[0004] Background of the invention
[0005] Skin is exposed to various environmental stresses, such as UV rays, which cause free radicals to form in the skin. Sunscreens are widely used to protect skin from sundamage, sunburn, photo-aging, as well as to decrease the chances of skin cancer development caused by exposure to ultraviolet ("UV") radiation. The degree of UV protection afforded by a composition is directly related to the amount and type of UV filters contained therein, for example, UVA and UVB filters. It is desirable for sunscreen compositions to provide good protection against UV radiation, a measure of which is the Sun Protection Factor (SPF) value, a desirable balance between UVA and UVB protection.
[0006] While there are many sunscreen products available on the market, it has been recognized that aesthetic and performance problems still exist in many sunscreen products. Some of the drawbacks include what is known as “white-cast” which appears as a noticeable white film of the skin after the sunscreen composition is applied to the skin. This affect is more noticeable with melanin-rich skin which can cause consumers to avoid using sunscreen compositions leaving the skin vulnerable to the UV radiation and damage it causes.
[0007] Accordingly, described herein is a novel sunscreen composition that does not whiten the skin after application or after becoming wet with water or perspiration, is sweat and water resistant, is translucent, has a blurring effect, and can provide some additional skin care benefits in addition to simply protecting skin from UV radiation such as excellent skin hydration, improved skin barrier, reduced inflammation / skin stress, even skin tone, reduced skin dullness, and reduced appearance of fine lines and wrinkles. Summary of the Invention
[0008] In a first aspect, the invention is directed to a water-in-oil (W / O) emulsion comprising: (a) from 0.9 wt% to 35 wt%, preferably, from 4 wt% to 30 wt%, more preferably, from 10 wt% to 30 wt%, most preferably, from 13 wt% to 25 wt%, and even more preferably, from 14 wt% to 20 wt% of an aqueous phase; and (b) from 64.9 wt% to 99 wt%, preferably, from 70 wt% to 95 wt%, more preferably, from 70 wt% to 90 wt%, and most preferably, from 74 wt% to 88 wt%, and even more preferably, from 78 wt% to 85 wt% of an oil phase, comprising at least one oil-soluble sunscreen, a functional elastomer, and at least one non-sunscreen oil with a Hansen Solubility Parameter of greater than or equal to 15, preferably, from 15.5 to 23, more preferably, from 15.6 to 22, and most preferably, from 15.8 to 22, wherein a weight ratio of the functional elastomer to the at least one oil-soluble sunscreen is from 15:1 to 1 :1 , preferably, from 7:1 to 1 :1 , and more preferably, from 5:1 to 1 :1 , wherein the emulsion comprises from 0.1 wt% to 10 wt%, preferably, from 0.1 wt% to 5 wt%, more preferably, from 0.5 wt% to 2 wt% of a nonionic emulsifier, based on the weight of the emulsion, with an HLB value from 3.5 to 12, preferably, from 3.5 to 10, more preferably, from 3.5 to 8; and wherein the emulsion has translucency of 30 to 70, measured with UV Vis Spectroscopy across visible spectrum 400-700 nm.

[0024] The W / O emulsions of the present invention comprise from 0.9 wt% to 35 wt%, preferably, from 4 wt% to 30 wt%, more preferably, from 10 wt% to 30 wt%, most preferably, from 13 wt% to 25 wt%, and even more preferably, from 14 wt% to 20 wt% of an aqueous phase, or a dispersed aqueous phase. In emulsion technology, the term "dispersed phase" means that the phase exists as small particles or droplets suspended in and surrounded by a continuous phase (e.g., oil phase). The dispersed phase is also known as the internal or discontinuous phase. The dispersed aqueous phase is a dispersion of small aqueous particles or droplets (e.g., 1 to 50 microns) suspended in and surrounded by the continuous oil phase described herein. The aqueous phase can be water, and / or a combination of water and one or more water- soluble ingredients. Non-limiting examples of such optional water-soluble ingredients include but are not limited to thickeners, acids, bases, salts, chelants, gums, water- soluble sunscreens, water-soluble vitamins, humectants, buffers, and preservatives. [0027] The W / O emulsions of the present invention comprise from from 64.9 wt% to 99 wt%, preferably, from 70 wt% to 95 wt%, more preferably, from 70 wt% to 90 wt%, and most preferably, from 74 wt% to 88 wt%, and even more preferably, from 78 wt% to 85 wt% of an oil phase, comprising at least one oil-soluble sunscreen, an functional elastomer, and at least one non-sunscreen oil with a Hansen Solubility Parameter of greater than or equal to 15, preferably, from 15.5 to 23, more preferably, from 15.6 to 22, and most preferably, from 15.8 to 22. Suitable oil-soluble sunscreens include octyl salicylate, 3,3,5-trimethylcyclohexyl 2- hydroxybenzoate (“homosalate”), ethylhexyl salicylate (“octisalate”), 2-ethylhexyl 2- cyano-3,3-diphenylprop-2-enoate (“octocrylene”), or 2-ethylhexyl-4-methoxycinnamate (also known as octyl methoxycinnamate or “OMC”), 4-t-butyl-4’- methoxydibenzoylmethane (“avobenzone”), 2-methyldibenzoylmethane, 4-methyl- dibenzoyl-ethane, 4-isopropyldibenzoyl-methane, 4-tert-butyldibenzoylmethane, 2,4- dimethyldibenzoylmethane, 2,5-dimethyldibenzoylmethane, 4,4’- diisopropyldibenzoylmethane, 2-methyl-5-isopropyl-4’-methoxy-dibenzoylmethane, 2- methyl-5-tert-butyl-4’-methoxy-dibenzoylmethane, 2,4-dimethyl-4’- methoxydibenzoylmethane, 2,6-dimehyl-4-tert-butyl-4’methoxy-dibenzoylmethane, diethylaminohydroxybenzoyl hexyl benzoate, or methyl anthranilate. Additional oil-soluble sunscreens include those commercially available from BASF corporation: Uvinul T-150 (Ethylhexyl triazone; a UV-B sunscreen oil), Uvinul A Plus (Diethylamino hydroxybenzoyl hexyl benzoate; a UV-A sunscreen oil), Tinosorb S (bis-ethylhexyloxyphenol methoxyphenyl triazine; a UV-A and UV-B sunscreen oil), Tinosorb M(methylene bisbenzotriazolyl tetramethylbutylphenol; a UV-A and UV-B sunscreen oil), Mexoryl XL, and / or Mexoryl 400. [0056] In one aspect, the present invention is directed to a water-in-oil emulsion comprising: (a) from 0.9 wt% to 35 wt%, preferably, from 4 wt% to 30 wt%, more preferably, from 10 wt% to 30 wt%, most preferably, from 13 wt% to 25 wt%, and even more preferably, from 14 wt% to 20 wt% of an aqueous phase, wherein the emulsion has from 1 wt% to 27 wt%, preferably, from 5 wt% to 27 wt%, more preferably, from 7 wt% to 25 wt%, and most preferably, from 10 wt% to 25 wt%, and even more preferably from 10 wt% to 20 wt%, and even more preferably, from 10 wt% to 15 wt% of water, and wherein the aqueous phase further comprises at least one water-soluble vitamin, preferably niacinamide and / or a carboxymethyl cysteine compound, preferably, lysine carboxymethyl cysteinate; and (b) from 64.9 wt% to 99 wt%, preferably, from 70 wt% to 95 wt%, more preferably, from 70 wt% to 90 wt%, and most preferably, from 74 wt% to 88 wt%, and even more preferably, from 78 wt% to 85 wt% of an oil phase, comprising at least one oil-soluble sunscreen, a functional elastomer, and at least one non-sunscreen oil with a Hansen Solubility Parameter of greater than or equal to 15, preferably, from 15.5 to 23, more preferably, from 15.6 to 22, and most preferably, from 15.8 to 22, preferably an ester oil, triglyceride and / or a linear or branched alkane, and optionally a PPAR activator, an oil-soluble vitamin, and / or a resorcinol, wherein a weight ratio of the functional elastomer to the at least one oil-soluble sunscreen is from 15:1 to 1 :1 , preferably, from 7:1 to 1 :1 , and more preferably, from 5:1 to 1 :1 , wherein the emulsion comprises from 0.1 wt% to 10 wt%, preferably, from 0.1 wt% to 5 wt%, more preferably, from 0.5 wt% to 2 wt% of a nonionic emulsifier, based on the weight of the emulsion, with an HLB value from 3.5 to 12, preferably, from 3.5 to 10, more preferably, from 3.5 to 8, and wherein the emulsion has translucency of 30 to 70, measured with UWis Spectroscopy across visible spectrum 400-700 nm. Preferably, the functional elastomer is an elastomer of Structure (I), wherein x is from 15 to 40, preferably, from 15 to 30, more preferably, from 15 to 25, most preferably, x is 20; and wherein y and z are each are from 0 to 500, or from 0 to 250, or from 0 to 100, or from 0 to 50, from 1 to 500, or from 1 to 250, or from 1 to 100, or from 1 to 50.

In one aspect, the emulsion is initially translucent in appearance and remains translucent in appearance upon application onto skin (e.g., no white cast). Surprisingly and unexpectedly, it is possible to get a translucent emulsion even with the inclusion of water.

[0060] Many types of packaging can be used to store and deliver the present personal care emulsion. The selection of packaging is dependent upon the personal care end use and the viscosity of the emulsion itself. As an example, leave-on lotions and creams for skin typically employ plastic containers with an opening at a dispense end covered by an appropriate closure. Conventional closures include flip-top hinged lids, screw-caps and non-aerosol pumps. As another example, appropriate packaging to be used for antiperspirants, deodorants and depilatories include a container with a roller-ball applicator on a dispensing end if the emulsion is fluid and of a thinner viscosity. If the emulsion is in a stick format, a container with a propel-repel mechanism wherein the stick is fixed on a platform towards a dispensing orifice is appropriate. If the emulsion is in an aerosol format, then metallic cans pressurized by a propellant and having a spray nozzle is appropriate. In general, patches, bottles, tubes, roller-ball applicators, squeeze containers or lidded jars are preferred.

[0065] Emulsions were prepared by mixing the amounts of the components as indicated in Table 1. The oil phase (except functional elastomer and optional non-functional elastomer) was heated to about 65°C and then mixed. Elastomer (e.g., functional elastomer and optional non-functional elastomer) was added to oil phase and mixed until homogenous, and then cooled. Separately, the water phase was prepared by mixing all of the components, and then added to oil phase at room temperature. Amounts are listed in % by weight. Table 1 As can be seen in Table 1 , the emulsions varied by amount of functional elastomer and water. When water is included in an emulsion, such as a W / O emulsion, the emulsion is typically opaque or milky. Compositions 1-5 surprisingly and unexpectedly were translucent formulations with satisfactory SPF, having up to 25 wt% of water. Composition A, however, was not translucent.

Claims
Claims1 . A water-in-oil emulsion comprising: a) from 0.9 wt% to 35 wt%, preferably, from 4 wt% to 30 wt%, more preferably, from 10 wt% to 30 wt%, most preferably, from 13 wt% to 25 wt%, and even more preferably, from 14 wt% to 20 wt% of an aqueous phase; and b) from 64.9 wt% to 99 wt%, preferably, from 70 wt% to 95 wt%, more preferably, from 70 wt% to 90 wt%, and most preferably, from 74 wt% to 88 wt%, and even more preferably, from 78 wt% to 85 wt% of an oil phase, comprising at least one oil-soluble sunscreen, a functional elastomer, and at least one non-sunscreen oil with aHansen Solubility Parameter of greater than or equal to 15, preferably, from 15.5 to 23, more preferably, from 15.6 to 22, and most preferably, from 15.8 to 22, wherein the functional elastomer is of Structure (I):wherein x is from 1 to 100; and wherein y and z are each are from 1 to 100; wherein a weight ratio of the functional elastomer to the at least one oil-soluble sunscreen is from 15:1 to 1 :1 , preferably, from 7:1 to 1 :1 , and more preferably, from 5:1 to 1 :1 , wherein the emulsion comprises from 0.1 wt% to 10 wt%, preferably, from 0.1 wt% to 5 wt%, more preferably, from 0.5 wt% to 2 wt% of a nonionic emulsifier, based on the weight of the emulsion, with an HLB value from 3.5 to 12, preferably, from 3.5 to 10, more preferably, from 3.5 to 8; and wherein the emulsion has translucency of 30 to 70, measured with UV Vis Spectroscopy across visible spectrum 400-700 nm.
2. The emulsion of claim 1 , wherein the emulsion comprises from 1 wt% to 40%, preferably, 8 to 30%, most preferably, from 10 to 25% by weight of the at least one oilsoluble sunscreen, based on the total weight of the emulsion, and wherein the at leastone oil-soluble sunscreen is UVA sunscreen, a UVB sunscreen, and / or a combination of a UVA and UVB sunscreen.
3. The emulsion of claim 1 , wherein the emulsion comprises from 1 wt% to 27 wt%, preferably, from 5 wt% to 27 wt%, more preferably, from 7 wt% to 25 wt%, and most preferably, from 10 wt% to 25 wt%, and even more preferably from 10 wt% to 20 wt%, and even more preferably, from 10 wt% to 15 wt% of water.
4. The emulsion of any of the preceding claims, wherein the emulsion comprises 0.1 wt% to 25 wt%, preferably, from 1 wt% to 20 wt%, more preferably, from 5 wt% to 18 wt% of the at least one non-sunscreen oil, based on the weight of the total emulsion.
5. The emulsion of any of the preceding claims, wherein a weight ratio of oilsoluble sunscreen to the at least one non-sunscreen oil is from 5:1 to 1 :1 , preferably, from 4:1 to 1 :1 , more preferably, from 3:1 to 1 :1.
6. The emulsion of any of the preceding claims, where the oil phase comprises from 15 wt% to 50 wt%, preferably, from 20 wt% to 45 wt%, more preferably, from 25 wt% to 40 wt% of the oil-soluble sunscreen, based on the weight of the oil phase.
7. The emulsion of any of the preceding claims, wherein the emulsion comprises at least 30 wt%, preferably, from 30 wt% to 70 wt%, more preferably, from 30 wt% to 65 wt%, even more preferably, from 30 wt% to 60 wt%, of an elastomer, based on the total weight of the emulsion, such that at least 50%, preferably, from 50 wt% to 100%, more preferably, from 60 wt% to 100 wt%, more preferably, from 70 wt% to 100 wt%, of the total amount of the elastomer is the functional elastomer.
8. The emulsion of claim 7, wherein the emulsion further comprises a nonfunctional elastomer, wherein the non-functional elastomer has a viscosity of at least 25,000 mPa s.
9. The emulsion of claim 7, wherein the emulsion is substantially free of a nonfunctional elastomer.
10. The emulsion of claim 8, wherein a weight ratio of the functional elastomer to the non-functional elastomer is from 5:1 to 1 :1 , preferably, from 4:1 to 1 :1 , and more preferably, from 3:1 to 1 :1.11 . The emulsion of any of the preceding claims further comprising at least one water-soluble sunscreen.
12. The emulsion of any of the preceding claims, wherein the emulsion the substantially free of volatile silicones, preferably D5.
13. The emulsion of any of the preceding claims, wherein the emulsion is substantially free of parabens and sulfates.
14. The emulsion of any of the preceding claims further comprising at least one optional component.
15. The emulsion of any of the preceding claims, wherein the emulsion further comprises tocopherol.
