Description

Docket No. 863910-00-WO-01-SHSKIN CARE COMPOSITIONSCROSS-REFERENCE TO RELATED APPLICATION

[0001] This application claims the benefit of priority from U.S. Patent Application No. 63 / 702,233, filed October 2, 2024, and from U.S. Patent Application No. 63 / 702,228, filed October 2, 2024, the contents of both are hereby incorporated herein by reference in their entirety.BACKGROUND

[0002] Skin produces less collagen and elastin as it ages. For example, after the age of twenty, a person (human) produces about 1 percent less collagen in the skin each year. As a result, the skin becomes thinner and more fragile. Inevitably, wrinkles, crow’s feet, age-spots, eye bags, and the like, begin to form.

[0003] Consumers often wish to improve the appearance of such age-related skin imperfections, preferably with instantaneous results. Many consumer products and procedures devoted to hiding and reducing wrinkles are available. Some products and procedures are simple and inexpensive, for example, applying make-up, particularly a primer or colored foundation, to cover the skin (and thereby cover and / or fill the wrinkles and provide a smoother look). Far more expensive and drastic procedures, such as surgical face lifts and Botox® injections, are also used to reduce the appearance of wrinkles. However, many consumers either cannot afford, or do not wish, to undergo such drastic cosmetic procedures.

[0004] There are a number of lotions and creams which are formulated to hydrate the skin and make it more supple, thereby reducing the appearance of wrinkles. Some of these products contain active ingredients that help repair and rejuvenate skin over time. Oftentimes, as the potency of a skin active increases, its level of instability in formula will also increase. Therefore, skincare products featuring highly potent actives also run the risk of featuring unacceptable levels of degradation. One such active that features this unfortunate condition is retinol, a form of vitamin A with proven anti-aging and anti-acne benefits. Retinol is sensitive to a variety of stimuli such as light, temperature, water and particularly oxygen. Thus, it can be difficult to stabilize retinol in skin care compositions. This is further complicated if the skincare product contains any further active(s). The additional actives may interact with retinol in a deleterious way and / or impose new formulation conditions that adversely impact the stability of retinol.Docket No. 863910-00-WO-01-SH

[0005] There is a growing need for skin care formulations with anti-ageing effects, which can improve the health and / or appearance of skin.BRIEF SUMMARY

[0006] This summary is intended merely to introduce a simplified summary of some aspects of one or more implementations of the present disclosure. Further areas of applicability of the present disclosure will become apparent from the detailed description provided hereinafter. Although certain embodiments of the invention are specifically described herein, one of ordinary skill in the art will readily recognize that the same principles are equally applicable to, and can be employed in other apparatuses and methods. Before explaining the disclosed embodiments of the present invention in detail, it is to be understood that the invention is not limited in its application to the details of any particular embodiment shown. The terminology used herein is for the purpose of description and not of limitation.

[0042] As used herein and in the appended claims, the singular forms “a”, “an”, and “the” include plural references unless the context dictates otherwise. The singular form of any class of the ingredients refers not only to one chemical species within that class, but also to a mixture of those chemical species. The terms “a” (or “an”), “one or more” and “at least one” may be used interchangeably herein. The terms “comprising”, “including”, and “having” may be used interchangeably. The term “include” should be interpreted as “include, but are not limited to”. The term “including” should be interpreted as “including, but are not limited to”.

[0043] As used throughout, ranges arc used as shorthand for describing each and every value that is within the range. Any value within the range can be selected as the terminus of the range. Thus, a range from 1-5, includes specifically 1, 2, 3, 4 and 5, as well as subranges such as 2-5, 3-5, 2-3, 2-4, 1-4, etc.

[0044] The term “about” when referring to a number means any number within a range of 10% of the number. For example, the phrase “about 2 wt.%” refers to a number between and including 1.8 wt.% and 2.2 wt.%.

[0045] All references cited herein are hereby incorporated by reference in their entireties. In the event of a conflict in a definition in the present disclosure and that of a cited reference, the present disclosure controls.

[0046] The abbreviations and symbols as used herein, unless indicated otherwise, take their ordinary meaning. The abbreviation “wt.%” means percent by weight with respect to the skin care composition. The symbol “°” refers to a degree, such as a temperature degree or a degree of an angle. The symbols “h”, “min”, “mL”, “nm”, and “pm” refer to hour, minute, milliliter, nanometer,Docket No. 863910-00-WO-01-SH and micrometer, respectively. The abbreviation “UV-VIS” as referring to a spectrometer or spectroscopy, means Ultraviolet- Visible. The abbreviation “rpm” means revolutions per minute.

[0047] When referring to chemical structures, and names, the symbols “C”, “H”, and “O” mean carbon, hydrogen, and oxygen, respectively. The symbols “=” and “=” mean single bond, double bond, and triple bond, respectively.

[0048] “ Volatile”, as used herein, means having a flash point of less than about 100° C. “Nonvolatile”, as used herein, means having a flash point of greater than about 100° C.

[0049] “Cosmetically acceptable” means that the item in question is compatible with a keratinous substrate, such as skin. For example, a “cosmetically acceptable carrier” means a carrier that is compatible with a keratinous substrate, such as skin.

[0050] Any member in a list of species that are used to exemplify or define a genus, may be mutually different from, or overlapping with, or a subset of, or equivalent to, or nearly the same as, or identical to, any other member of the list of species. Further, unless explicitly stated, such as when reciting a Markush group, the list of species that define or exemplify the genus is open, and it is given that other species may exist that define or exemplify the genus just as well as, or better than, any other species listed.

[0051] The phrases, “a mixture thereof,” “a combination thereof,” or a combination of two or more thereof’ do not require that the mixture include all of A, B, C, D, E, and F (although all of A, B,C, D, E, and F may be included). Rather, it indicates that a mixture of any two or more of A, B, C,D, E, and F can be included. In other words, it is equivalent to the phrase “one or more elements selected from the group consisting of A, B, C, D, E, F, and a mixture of any two or more of A, B, C, D, E, and E” Likewise, the term “a salt thereof” also relates to “salts thereof.” Thus, where the disclosure refers to “an element selected from the group consisting of A, B, C, D, E, F, a salt thereof, and a mixture thereof,” it indicates that that one or more of A, B, C, D, and F may be included, one or more of a salt of A, a salt of B, a salt of C, a salt of D, a salt of E, and a salt of F may be included, or a mixture of any two of A, B, C, D, E, F, a salt of A, a salt of B, a salt of C, a salt of D, a salt of E, and a salt of F may be included.

[0052] All components and elements positively set forth in this disclosure can be negatively excluded from the claims. In other words, the skin care compositions of the instant disclosure can be free or essentially free of all components and elements positively recited throughout the instant disclosure. In some instances, the skin care compositions of the present disclosure may beDocket No. 863910-00-WO-01-SH substantially free of non-incidental amounts of the ingredient(s) or compound(s) described herein. A non-incidcntal amount of an ingredient or compound is the amount of that ingredient or compound that is added into the skin care composition by itself. For example, a skin care composition may be substantially free of a non-incidental amount of an ingredient or compound, although such ingredient(s) or compound(s) may be present as part of a raw material that is included as a blend of two or more compounds.

[0053] Some of the various categories of components identified may overlap. In such cases where overlap may exist and the skin care composition includes both components (or the composition includes more than two components that overlap), an overlapping compound does not represent more than one component. For example, certain compounds may be characterized as both an emulsifier and a surfactant. If a particular skin care composition includes both an emulsifier and a surfactant, a compound that may be characterized as both an emulsifier and a surfactant will serve only as either an emulsifier or a surfactant — not both.

[0054] For readability purposes, the chemical functional groups are in their adjective form; for each of the adjectives, the word “group” is assumed. For example, the adjective “alkyl” without a noun thereafter, should be read as “an alkyl group”.

[0055] Aspects of the invention are directed to skin care compositions and, e.g., skin care compositions containing retinol and salicylic acid. Without being limited to any particular theory, the inventors discovered that certain skin care compositions having retinol, salicylic acid, and certain pHs (e.g., a pH of about 4.75 to about 6.7) have enhanced retinol stability while simultaneously having desirable benefits of salicylic acid. These simultaneous benefits were unexpected as salicylic acid is considerably acidic (e.g., has a low pKa) and, thus, raising the pH could have been expected to degrade the benefits of salicylic acid. In accordance with one aspect, provided is a skin care composition comprising: a retinoid; salicylic acid, and / or a salt thereof; from about 1.5 to about 17 wt.% of a silicone; from about 1 to about 8 wt.% of a vitamin B; from about 5 to about 40 wt.% of a fatty component; and water, wherein the skin care composition has a pH of about 4.75 to about 6.7 and all weight percentages are based on the total weight of the skin care composition.

[0056] The skin care compositions may preferably have a pH of about 4.75 to about 6.7, about 4.75 to about 6.5, about 4.75 to about 6.3, about 4.75 to about 6.1, about 4.75 to about 5.9; about 5 to about 6.7, about 5 to about 6.5, about 5 to about 6.3, about 5 to about 6.1, about 5 to aboutDocket No. 863910-00-WO-01-SH5.9; about 5.25 to about 6.7, about 5.25 to about 6.5, about 5.25 to about 6.3, about 5.25 to about 6.1, about 5.25 to about 5.9; about 5.5 to about 6.7, about 5.5 to about 6.5, about 5.5 to about 6.3, about 5.5 to about 6.1, about 5.5 to about 5.9; from about 5.7 to about 6.7, about 5.7 to about 6.5, about 5.7 to about 6.3, about 5.7 to about 6.1, about 5.7 to about 5.9; from about 5.9 to about 6.7, about 5.9 to about 6.5, about 5.9 to about 6.3; from about 6.1 to about 6.7, about 6.1 to about 6.5, about 6.3 to about 6.7, or any range or subrange thereof. In certain preferred embodiments, the skin care composition has a pH of about 4.75 to about 6.3, about 5 to about 6.3, or about 5 to about 6.

[0057] Suitable components, such as those listed below, may be included or excluded from the formulations for the skin care compositions depending on the specific combination of other components, the form of the skin care compositions, and / or the use of the formulation (e.g., a serum, lotion, cream, gel, etc.). For example, the retinoids may comprise or consist of retinoic acid, retinol, tretinoin, acitretin, etretinate, adapalene, arotinoid, tazarotene,Docket No. 863910-00-WO-01-SH hydroxypinacolone retinoate, and a combination of two or more thereof. In some cases, the retinoids comprise or consist of at least one of rctinyl esters and / or rctinaldchydc. Examples of retinyl esters include retinyl palmitate, retinyl acetate retinyl propionate, and a combination thereof. The skin care composition may have retinol as the sole retinoid in some embodiments.

[0060] The skin care composition may optionally include delivery vesicle(s) (e.g., a multilamellar vesicle (“MLV”)). For instance, the skin care composition may have one or more ingredients that are encapsulated in a delivery vesicle, such as a multilamellar vesicle. The multilamellar vesicle may comprise liposome structuring agents comprising polygly ceryl- 10 dioleate and at least one of polyglyceryl-10 dilinoleate or poly lyceryl-10 dipalmitate in a weight ratio of polyglyceryl-10 dioleate to the at least one of polyglyceryl-10 dilinoleate or polyglyceryl-10 dipalmitate of from 300:1 to 5:1. [0118] Four skin care compositions (Compositions Al, Al, Bl, and B2) were prepared in the form of a serum. The formulations for Compositions A1-B2 are shown in Table 1.Table 1Example 2

[0119] Compositions A1-B2 were evaluated to determine the stability of the retinol in each skin care composition. Specifically, samples of Compositions A1-B2 were assayed to determine theDocket No. 863910-00-WO-01-SH initial amount of retinol, the amount of retinol after 30 days of aging at room temperature, and the amount of retinol after 60 days of aging at room temperature. The samples were assayed using a HPLC with an isocratic pump and UV-Vis detector. A Cl 8 column was used with a mobile phase of 99 / 1 methanol / water and a flow rate of 1 mL / min. Samples were detected at 325 nm at a retention time of approximately 2.7 minutes. The stability of the samples was calculated as 100x(retinol level / baseline level).

[0120] Summaries of the amount of retinol after 30 days and after 60 days of aging are shown below in Tables 2 and 3. Specifically, Table 2 provides a summary of the amount of retinol after aging for Compositions A2 and B2, which had pHs of 4.5 and 4.4, respectively.Table 2

[0121] Table 3 provides a summary of the amount of retinol after aging for Compositions Al and Bl, which had pHs of 6.3 and 6, respectively.Table 3

[0122] It can be seen from Tables 2 and 3, that the addition of salicylic acid and sodium ascorbyl phosphate decreases the retinol stability of Compositions Bl and B2 relative to Compositions Al and A2. Notably, however, the addition of salicylic acid and sodium ascorbyl phosphate reduced the retinol stability for Composition Bl less than for Composition B2. It can be seen from Tables 2 and 3 that the stability of retinol in the presence of salicylic acid and sodium ascorbyl phosphate was unexpectedly increased by adding sodium hydroxide to achieve a pH of about 6 or more. Example 3

[0123] Three non-limiting example skin care compositions (Example Compositions A-C) were prepared in accordance with aspects of the disclosure. A comparative skin care composition (Comparative Composition 1) and a placebo composition (Placebo Composition) were alsoDocket No. 863910-00-WQ-01-SH prepared. The formulations of the Placebo Composition, Comparative Composition 1 , andExample Compositions A-C arc provided in Table 4.Table 4Docket No. 863910-00-WO-01-SHExample 4

[0124] Example Compositions A-C and Comparative Composition 1 from Example 3 were evaluated to assess their respective retinol stabilities. Specifically, samples of Example Compositions A-C and Comparative Composition 1 were stored at room temperature (e.g., about 21°C) and assayed for retinol content at the beginning of the evaluation, after 30 days, after 60 days, and after 90 days of aging.

[0125] Assays were conducted by weighing about 20 mg of the respective sample and then adding 10 mL of methanol. The samples were then thoroughly sonicated and vortexed to ensure all retinol in the formula was dissolved in the methanol. Retinol levels were assayed on an Agilent™ 1100 Series HPLC with a UV-Vis detector. A reverse-phase, Agilent™ C18 “Zorbax” column was used (150 mm X 4.6 mm) with an attached guard column. The mobile phase consisted of 99 / 1 methanol / water, which was run at a flow rate of 1.0 mL / min. 20 uL of solution was injected. Retinol could be detected at 325 nm with a retention time of approximately 2.7 minutes.

[0126] A summary of the retinol stability for Example Compositions A-C and Comparative Composition 1 are shown in FIG. 1. Notably, Example Compositions A-C achieved a significantly better retinol stability than Comparative Composition 1.Example 5

[0127] The Placebo Composition, Example Compositions A and B, and Comparative Composition 1 from Example 3 were evaluated to determine their respective bioefficacies. Specifically, samples of the Placebo Composition, Example Composition A, Example Composition B, and Comparative Composition 1 were stored at room temperature (e.g., about 21°C) for 90 days. The samples were diluted in keratinocyte culture media and then added to proliferating normal human epidermal keratinocytes (NHEK) cells. The cells were subsequently incubated at a temperature of 37 °C and in an atmosphere containing 5 vol.% of CO2 for 24 hours.

[0128] After the 24 hours of incubation, the cells were collected, the RNA isolated, and the expression of actively transcribed genes was analyzed with qPCR. The results were quantified and graphed (see FIGS. 2-4) as fold expression relative to the untreated control, which was set to 1. Fold expression values of greater than 1 indicate upregulation I stimulation of gene expression, while values of less than 1 indicate downregulation / inhibition of expression. Specifically, FIG. 2 is a graph of the KRT15 expression in the NHEK cells, FIG. 3 is a graph of the HBEGF expression in the NHEK cells, and FIG. 4 is a graph of the MMP1 expression in the NHEK cells. As seen inDocket No. 863910-00-WO-01-SHFIGS. 2-4, Example Compositions A and B desirably upregulated the expression of EGF-like growth factor (HBEGF) and keratin 15 (KRT15), while downrcgulatcd the expression of matrix metalloproteinase 1 (MMP1).
