Abstract
Description
Title of the invention: COMPOSITIONS CONTAINING BIS-ETHYLHEXYLOXYPHENOL METHOXYPHENYL TRIAZINE AND A COLORING AGENT FIELD OF THE INVENTION
[0001] The present disclosure relates to color compositions comprising 2,4-bis-{[4-(2-ethylhexyloxy)-2-hydroxy]-phenyl]-6-(4-methoxyphenyl)-1,3,5-triazine (INCI name: bis-ethylhexyloxyphenol methoxyphenyl triazine) and at least one coloring agent, as well as methods of making and using such compositions. BACKGROUND DISCUSSION
[0002] Radiation with wavelengths between 290 nm and 400 nm allows tanning of the human epidermis, while radiation with wavelengths between 290 and 320 nm, called UVB rays, hinders the development of a natural tan. Exposure is also likely to cause a detrimental change in the biomechanical properties of the epidermis, resulting in the appearance of wrinkles leading to premature aging of the skin (i.e., photoaging).
[0003] UVA rays with a wavelength between 320 and 400 nm penetrate deeper into the skin than UVB rays. UVA rays cause immediate and persistent browning of the skin. Daily exposure to UVA rays, even for a short time, under normal conditions, can damage collagen fibers and elastin, resulting in a change in the microrelief of the skin, the appearance of wrinkles and uneven pigmentation (spots, uneven skin tone).
[0004] Numerous studies show the need for effective protection against UVA and UVB to prevent sunburn, photoaging, and the like.
[0005] In order to obtain a high protection product, it is generally necessary to combine a large number of sunscreens and / or a large quantity of UV filters to achieve high levels of filtration efficiency.
[0006] However, high levels of UV filters do not lend themselves to easy development of compositions with a stabilized and pleasant texture.
[0007] Certain colorants found in consumer products such as, for example, red pigments are not particularly color stable to light, fade or degrade after exposure to light, which may result in changes in color intensity and / or color shade of the composition after exposure to light, as well as discoloration of the products.
[0008] There remains a need in the art for improved consumer care compositions that possess good color stability to light in addition to good staying power properties.
[0009] Accordingly, one aspect of the present disclosure is a color composition that has good color stability to light in addition to having good aesthetic properties (e.g., pleasing application). Summary of the invention

[0029] “Keratinous materials” means nails (fingernails and / or toenails), skin such as the body, face and eye area, scalp, keratinous fibers such as eyelashes, eyebrows and hair, and mucous membranes such as the lips.
[0030] “Physiologically acceptable” means compatible with keratinous materials and having a pleasant color, odor, and feel, and which does not cause a unacceptable discomfort (tingling or pulling) likely to discourage a consumer from using the composition.
[0031] “UV protection efficiency” or “filtration efficiency” in the context of the present disclosure, is evaluated from one or more of SPF, UVAPF, critical wavelength and UVA-I / UV ratio.
[0032] "SPF" (Sun Protection Factor) measures the level of protection against erythema provided by a composition. The SPF value corresponds to the ratio between the minimum erythema dose (MED) measured on skin covered with the composition and the MED measured on bare skin. "SPF" is a term known in the art of sunscreens and is defined, for example, in A new substrate to measure sunscreen protection factors throughout the ultraviolet spectrum, J. Soc. Cosmet. Chem., 40, 127-133 (May / June 1989).
[0033] The SPF (Sun Protection Factor) assessment can be carried out, for example, in vitro with a Labsphere spectrophotometer (North Sutton, NH, USA). In such an assessment, the plate is the material on which the composition under test is applied. For such an assessment, polymethyl methacrylate (PMMA) plates can be used. An example of an acceptable protocol is currently undergoing ISO accreditation as ISO Committee Draft 23675.
[0034] The evaluation of the sun protection factor (SPF) can also be carried out in vivo in accordance with the ISO 24444:2019 protocol “Cosmetics-Sun protection test methods-In-vivo determination of the sun protection factor (SPF).” It can also be determined according to FDA protocols, as described in the document “Labeling and Effectiveness Testing; Sunscreen Drug Products for Over-the-Counter Human Use” published in the US Federal Register on 07 / 05 / 2011 (https: / / www.federalregister.gOv / d / 2011-14766); 21 CFR Part 352 Subpart D § 352.72, updated and revised by the 2011 publication in the Federal Register.
[0035] “UVA protection factor” (UVA protection factor) refers to an index characterizing the UVA protection provided by a composition. For example, the UVA factor may be measured in vivo according to the “PPD” (Persistent Pigment Darkening) method of the ISO-24442:2022 protocol, measuring skin color observed 2 to 4 hours after UVA exposure. It may also be determined according to FDA protocols, as described in 21 CFR Part 352 Subpart D § 352.72 as discussed above in relation to SPF.
[0036] The assessment of UVA protection can also be measured in vitro with the Labsphere® spectrophotometer under conditions such as those discussed above in relation to SPF. The ISO 24443:2021 protocol describes such an in vitro method.
[0037] The FDA's broad spectrum test procedures, specifically the "critical wavelength" test procedures, are also available in 21 CFR Part 352 Subpart D § 352.72. In addition, the broad spectrum test procedures include the determination of the UVA1 / UV ratio as described in "Sunscreen Drug Products for Over-the-Counter-Human-Use" published in the Federal Register https: / / www.federalregister.gov / documents / 2019 / 02 / 26 / 2019-03019 / sunscreen-drug-pr oducts-for-over-the-counter-human-use. » In the assay described in the monograph, known as the Boots adaptation of the Diffey / Robson test method, a ratio is generated between the protection provided by the sunscreen product against UVA1 (340-400 nm) and the protection against total UV radiation (UVB and UVA at 290-400 nm) calculated from the absorbance curve. This UVA1 / UV ratio would represent the product's rating in the in vitro test.
[0038] According to the present disclosure, the compositions of the present disclosure preferably have one or more of the following properties:
[0039] The compositions have a critical wavelength as determined by FDA critical wavelength procedures of at least 370 nm;
[0040] The compositions have an SPF value of at least 15, preferably at least 30, preferably at least 50 and preferably at least 70;
[0041] The compositions have an FPUVA / SPF ratio of at least 1 / 3, and preferably at least 2 / 5 and / or
[0042] The compositions have a UVA1 / UV ratio of 0.7 or more, preferably 0.75 or more, and preferably 0.8 or more.
[0043] "Makeup result" as used herein relates to the visual impact of a composition when applied to a keratinous material such as skin. The makeup result may relate to the apparent color of the product after application to a keratinous material or an optical effect such as shine, the blurring of fine lines and imperfections, or a concealing effect on pores or skin defects after application of the product to the keratinous material.
[0044] “Long-lasting” as used herein refers to compositions where the color or other apparent properties remain the same or substantially the same as at the time of application, as viewed by the naked eye, after an extended period of time, or after a particular stress event such as immersion in water or rubbing. “Long-lasting” may be evaluated by evaluating long-lasting properties by any method known in the art for evaluating such properties. For example, long-lasting may be evaluated by a test involving the application of a composition to a keratinous material such as skin and evaluating the color of the composition after an extended period of time. For example, the color of a composition may be evaluated immediately following application to the keratinous material. ratinous such as skin and these characteristics can then be re-evaluated and compared after a period of time. In addition, these characteristics can be evaluated against other compositions, such as commercially available compositions. "Long wear" can also be evaluated using in vitro methods on non-keratinous substrates such as polymethyl methacrylate (PMMA), whereby properties such as color, transparency, or in vitro SPF can be evaluated before and after a period of time or stressor such as immersion in water, incubation at elevated temperatures, or the application of an abrasive technique.
[0045] “Coloring agent” as used herein means any material or substance designed to imparting color to the composition (“raw color”), color to the composition after application to a keratinous material, or both. Examples of suitable coloring agents may include dyes and / or pigments.
[0046] “Natural” as in the expression “natural compound”, means any compound derived directly from a natural substance such as a plant without undergoing chemical modification.
[0047] “Naturally occurring compound” means any compound derived from a naturally occurring compound which has undergone one or more chemical modifications, for example by organic synthesis reaction, without the properties of the natural compound having been modified.
[0048] “Synthetic compound” means any compound that is neither a natural compound nor a compound of natural origin.
[0049] “Room temperature” means approximately 20-25°C.
[0050] “Atmospheric pressure” means about 760 mmHg, i.e. about 105 pascals.
[0051] “UV filter” and “sunscreen agent” are used interchangeably in this request.
[0052] “UV efficacy” and “UV protection” are used interchangeably interchangeable in this application.
[0053] The compositions and methods of the present disclosure may comprise, consist of, or consist essentially of the essential elements and limitations of the disclosure described herein, as well as any additional or optional ingredients, components, or limitations described herein or otherwise useful. For example, the UV protection system of the compositions of the disclosure may "consist essentially of" bis-ethylhexyloxyphenol methoxyphenyl triazine alone, or bis-ethylhexyloxyphenol methoxyphenyl triazine in combination with zinc, titanium, and / or cerium oxides, and / or optionally one or more organic UV filters.
[0054] Similarly, the color protection system against light (“system color protection”) of the compositions of the disclosure may “consist essentially of” bis-ethylhexyloxyphenol methoxyphenyl triazine.
[0055] For the purposes of the present disclosure, the "fundamental and novel property" associated with the compositions, components and methods which "consist essentially of" the identified ingredients or actions is "color intensity stability and color shade stability with respect to light."
[0056] “Color intensity stability” as used herein means stability against de visible coloration (fading) of the color of the composition over time. In practice, this property is conveniently understood to mean that the color composition changes in chroma or brightness over time. The stability of color intensity can be visually assessed by comparing the color intensity immediately after application of the color composition of the present disclosure to the keratinous material (i.e., within 5 minutes of application) with the color intensity of the composition on the keratinous material after a predetermined time (e.g., 6 hours) after application. The color intensity stability of the color composition of the present disclosure prior to application may also be visually assessed by comparing an initial color intensity determination (time = To) with a determination at a later date after exposing the composition to light for a predetermined time (e.g., 2 months) at a predetermined temperature (e.g., 25°C or 45°C).
[0057] “Color shade stability” as used herein means stability with respect to the visible color change of the composition over time (e.g. from a reddish color to an orange color due to yellowing). In practice, this property is conveniently understood to mean that the color composition changes hue over time. The stability of color shade can be assessed visually according to the same protocols as those discussed above in relation to the stability of color intensity, either before or after application of the composition to the skin.
[0058] Color intensity stability or color shade stability may also be assessed using a colorimeter or chromatometer such as a CR-400 or CR-410 chromatometer sold by Konica Minolta designed to quantitatively measure the color of an object or substrate or a product applied to a substrate. Assessment of color stability using a colorimeter or chromatometer is designed to quantitatively report color variations via a color evaluation system such as L* a*b*. In such cases, color stability may be determined or reported as an overall color change, a change in an individual quantitative value (L*, a*, or b*), or a combination of color values. For convenience, it may be advantageous to represent the color compositions using brightness, hue, and chroma instead of or in addition to using L* a*b* color space values.
[0059] Without wishing to be limited by theory, it is understood that "color intensity stability" and "coloring agent stability" both apply to the coloring ability of the coloring agent in the compositions. "Coloring agent stability" is used interchangeably in the present disclosure with "color intensity stability" and "color shade stability".
[0060] The compositions of the present disclosure may be in any form suitable for use as a personal care composition, such as a stick, a paste, a cream, an anhydrous composition, an emulsion (oil in water, water in oil, a multiple emulsion such as water in oil in water), a nanoemulsion, a gel, a liquid, a solid, etc. These compositions may be used for any personal care purpose in cosmetic and / or dermatological products such as, for example, sunscreen, foundation, lip balms, lipsticks, concealers, mascaras, leave-in hair products, eye shadows, powders, etc.
[0061] Reference is made herein to trade names of materials including, but not limited to, polymers and optional components. The materials are not intended to be limited by the materials described and referenced by a certain trade name herein. Equivalent materials (e.g., those obtained from a different source under a different catalog name or (reference) number) to those referenced by a trade name may be substituted and used in the methods described and claimed herein.
[0062] All percentages and ratios are, unless otherwise indicated, calculated by weight. All percentages are, unless otherwise indicated, calculated based on the total weight of a composition. All levels of component or composition refer to the active level of that component or composition, and are exclusive of impurities, e.g., residual solvents or by-products, which may be present in commercially available sources.
[0063] All US patents or patent applications disclosed herein are expressly incorporated by reference in their entirety. COLOR COMPOSITION Coloring agent
