Abstract
Description
DATA COMMUNICATIONS NETWORK AND METHOD FOR OBTAINING AND MAINTAING REGULATORY AND / OR LEGAL COMPLIANCE FOR BUSINESS OPERATIONSFIELD OF THE INVENTION
[0001] The present invention relates to a data communications network and method for guiding a user regarding obtaining regulatory and / or legal compliance with respect to their business operation(s). The network and method of the present invention also facilitates a user to maintain regulatory and / or legal compliance, once obtained.BACKGROUND OF THE INVENTION
[0002] For a business to operate in compliance with statutory requirements, it must comply with specific industry standards, regulations, and ethical conduct requirements that apply to the business. Such standards, regulations and requirements vary from business to business and are also dependent upon the domain or jurisdiction in which the business is registered and / or operating. Generally, legal compliance refers to the adherence to laws and regulations established by the governing authority in the jurisdiction in which the business operates wherein failure to comply can result in legal action or penalties, whereas regulatory compliance focusses on industry-specific rules and standards wherein failure to comply may lead to sanctions and / or reputational damage and is generally enforced by industry-specific regulatory bodies rather than government authorities.
[0003] Examples of regulatory compliance include, but are not limited to, HR compliance and data compliance. HR compliance may cover business policies and procedures that ensure an organisation is operating within local requirements regarding the welfare of its employees, including privacy policies, contractor agreements, etc. More particularly, HR compliance establishes rules for maintaining employee documentation, ensuring diversity and inclusion within the workplace, implementing fair employment procedures, and ensuring employees have access to all of their entitlements and benefits.
[0004] Data compliance relates to the collection and storage of data and ensures that an organisation collects, organises, stores, and manages data with respect to their employees and customers in a manner that avoids such data being subject to corruption, loss, theft, and / or misuse.
[0005] An example of legal compliance includes work health and safety (WHS) compliance, which requires compliance with laws that relate to the provision of a safe working environment for employees. The objective of such laws include minimising the risk of serious accidents and illness in the workplace, improving staff productivity minimising costs associated with injury and employee compensation.
[0006] Ensuring a business complies with all regulatory and legal requirements is important since it provides transparency to customers and employees regarding the operation of a business. Compliance with all necessary regulatory and legal requirements assists to build trust and confidence in a business, ensures the safety and care of employees and consumers, and protects the business from expensive penalties, fees and potential litigation that could incur significant costs for the business.
[0007] However, due to the vast number of laws, rules and regulations that must be considered by a business when seeking to ensure compliance with all relevant regulations and laws, the process of obtaining and maintaining compliance is a complex, timeconsuming and expensive process that typically requires the input of numerous external advisors. In some instances, businesses take short cuts or elect not to comply with certain regulations due to the significant resource burden placed upon them, which can give rise to additional adverse consequences.
[0008] The present invention seeks to mitigate the problems discussed herein with respect to existing systems and methods for obtaining and maintaining legal compliance with respect to business operations and in particular including the technical problem associated with inefficient use of data communications network resources that occurs presently when businesses seek to process the data required and process same to address and / or maintain their legal and regulatory requirements.
[0009] The reference to any prior art in this specification is not, and should not be taken as, an acknowledgement or any suggestion, that the prior art forms part of the common general knowledge.SUMMARY OF THE INVENTION

[0038] For simplicity and illustrative purposes, the present disclosure is described by referring to embodiment(s) thereof. In the following description, numerous specific details are set forth to provide a better understanding of the present disclosure. However, it will be readily apparent that the current disclosure may be practiced without limitation to the specific details. In other instances, some features have not been described in detail to avoid obscuring the present disclosure.
[0039] According to an embodiment, the present invention relates to a computer- implemented data communications network and method of obtaining and / or maintaining regulatory and / or legal compliance in relation to a business operation (60) with various components of the data communications network in the form of one or more connected data communications devices operating to provide individual network functions. In particular, the network and method assists users (30) to adhere, or conform, to various regulations, rules and standards established by governments and regulatory agencies in a streamlined and digitized manner without the need for highly skilled operators such as chief compliance officers or consultants providing similar advice. In this regard, based upon receipt of information and input from a user (30) in relation to their business operation (60), documents required to satisfy such compliance requirements are automatically generated and presented to the user (30) for review in substantially realtime which achieved by sub-dividing components of the task and distributing for implementation by the one or more connected data communications devices.
[0040] The network and method provide a platform that hosts a computer-executable software application (40), wherein the application (40) is accessible by a plurality of users (30) seeking assistance to ensure that their business operations (60) are fully compliant with statutory (legal) and / or regulatory requirements relevant to the production and / or provision of products and / or services by the organisation. The network utilises a central server (20) in communication with connected data communication devices (50) associated with users (30).
[0041] According to an embodiment, the platform is provided by a central server (20) which maintains one or more processors and / or databases for performing functions, including receiving details from a user (30) including verification details to enable the user(30) to establish and / or access a user account. Furthermore, the server (20) receives information from the user (30) including the geographic location (65) of their (or an associated) business operation (60), information relating to any products and / or services (70) associated with (eg. offered by) the business operation (60), and information relating to the type of facility (75) associated with the production and / or provision of the product(s) and / or service(s) (70).
[0042] The server (20) subsequently extracts information from one or more databases (80), including legal and / or regulatory requirements relevant to the production and / or provision of the product(s) and / or service(s) (70) pertaining to the geographic location (65) of the business operation (60), and accesses one or more additional databases (85) for a plurality of documents required to obtain and / or maintain regulatory and / or legal compliance with respect to one or more aspects of the business operation (60). One or more specific documents from the available plurality of documents are selected such that only a particular subset of the available documents are accessed. This selection is based on the subset of documents enabling the user (30) to obtain and / or maintain regulatory and / or legal compliance with respect to their particular business operations (60) at their particular location (65). The server (20) also generates one or more example documents (90) required for the business operations (60) to satisfy legal and / or regulatory compliance requirements, with parameters included (pre-populated) in the exemplary documents (90) according to the information received from the user (30). The user (30) is then presented with the one or more example documents (90) for final review with the ability to accept or reject same.
[0043] The skilled person will appreciate that the data communications network provides a solution to the abovementioned problems associated with conventional approaches in which businesses seek to achieve legal and / or regulatory compliance such that a user (30), by inputting certain information and data, receives as output (substantially in realtime) various example documents (90) that are likely to satisfy their legal compliance requirements on the basis that the documents (90) are pre-populated with parameters based on data received from the user (30) including the location (65), products and / or services offered, and type of facility associated with the business operation, data retrieved from database (80), and the implementation of one or more artificial intelligence techniques as described herein.
[0044] Accordingly, a significant amount of time and resources that would otherwise be used engaging highly skilled operators is conserved, and by reducing the need for multiple communications between users and their staff as well as external parties in an effort to satisfy legal and / or regulatory compliance requirements, computing resources and network communications bandwidth are also conserved. The present invention thus also offers a solution to one or more technical problems in addition to providing users with a solution to the problem without requiring highly skilled advisors to generate the documents required for one or more business operations that may be located in one or more disparate jurisdictions.
[0045] Figure 1 is divided into segments which are further expanded in subsequent Figures 2 to 6. In particular, Segment 200 of Figure 1 shows the server component (20) with which the software application (40) operating on each data communications device (50) is configured to communicate. It will be apparent to the person skilled in the relevant field of technology that the software application (40) may be a mobile application or a web application, and similarly, the data communication devices (50) utilised by users (30) may be portable devices such as mobile (cell) phones, tablets or laptops, or a fixed location computer device such as a workstation or personal computer (not shown). The server component (20) is additionally detailed in Figure 2.
[0046] The skilled person will further appreciate that the steps described herein may be executed by the devices (50), wherein such operations are facilitated by the software application (40) operating on each device. According to another implementation of the present invention, the server (20) may be programmed to provide most, or all, of the processing functions described herein, particularly where they cannot be provided locally on the user devices (50) or where it may be commercially or technically impractical to implement such an arrangement. In other words, the steps described herein as performed by the devices (50), or components thereof, may be associated with hardware that is located externally of the device (50), such as the remote central server (20) (ie. in a distributed architecture).
