General Information: Gender is a sociocultural construct that describes the behaviors, attitudes, and values socially assigned to women and men in a differentiated manner. First, the victim is asked to provide an open account, building trust so she can tell everything that has happened. The second step involves the victim answering a series of questions about the abuse she has suffered, her situation and that of her children (if any), the profile of the abuser, and any aggravating factors of vulnerability present in the case, such as economic dependence on the partner or ex-partner. The objective is to detect the risk of recidivism and the risk of homicide.With all the data considered, professionals establish a risk level that will always increase; it can never decrease. There are five risk levels in the VioGén system: extreme, high, medium, low, and not assessed. Each level implies a series of protective measures. In cases of lower threat, officers inform the victim about the legal and social resources available to help her, in addition to offering self-protection recommendations. The victim is also provided with 24-hour contact numbers for the law enforcement agencies assigned to the case. At higher levels, the victim may be transferred to a shelter, and occasional checks will be carried out at the woman's home and workplace, as well as at the school of her minor children, if she has any. The aggressor, for his part, will wear an electronic monitoring device and must comply with the imposed court orders.In high-risk cases, the victim will be relocated if the aggressor cannot be located, in addition to frequent and random checks of their home and workplace. The aggressor's movements and contacts with close associates will also be monitored. In extreme cases, the aggressor will be placed under intensive surveillance until they no longer pose an imminent threat to the victim's safety. To improve the effectiveness of the VioGén system, it has been upgraded five times since its inception up to 2023. However, the system is not always effective: in 2023, nearly 10,000 victims of gender-based violence registered in the VioGén system were assaulted again or had a protection order violated. Of the 59,950 cases registered in the VioGén system in 2023, 9,429 involved a new complaint, either filed by the victim or initiated by the authorities.In February 2024, the Ministry of the Interior announced a review of the criteria and procedures for closing cases. Furthermore, efforts are underway to evolve the system and expand its current functions to facilitate comprehensive monitoring of gender-based violence. Regarding victims of gender-based and sexual violence, two very different scenarios can be identified: a) cases in which the perpetrator has been previously identified and for which there is a protocol for the electronic monitoring system to ensure compliance with restraining orders and sentences related to gender-based and sexual violence; this electronic monitoring system consists of a radio frequency transmitter and a tracking unit for the accused or convicted person, and a tracking unit for the victim; b) cases in which the potential perpetrator is unknown and therefore cannot be monitored.However, aggressors of type (a) who, in violation of the protocol, do not carry the monitoring equipment, become case (b).
