Abstract
Description
[0001] Personal care compositions comprising dicocoyl pentaerythrityl distearyl citrate
[0002] Field of the invention
[0003] The present invention relates to a sunscreen or daily care composition, comprising: (i) dicocoyl pentaerythrityl distearyl citrate; and (ii) at least one organic UV filter. The present invention furthermore relates to the use of dicocoyl pentaerythrityl distearyl citrate for improving the sun protection factor (SPF) and water resistance of a sunscreen or daily care composition comprising at least one organic UV filter as well as the corresponding methods of use.
[0004] Background of the invention
[0005] UV radiation causes harmful effects on the human skin. Beside the acute effect of sunburn of the skin, UV radiation is also known to increase the risk of skin cancer. Furthermore, long time exposure to UVA and UVB light can cause phototoxic and photo allergenic reactions on the skin and can accelerate skin aging.
[0006] To protect the human skin from UV radiation, various sun protecting UV filters (also referred to as UV absorbers) exist, including UVA filter, UVB filter and broadband filters, the latter being UV filters absorbing in a wavelength range that covers both UVA and UVB. All these UV filters can be organic or inorganic, particulate or soluble compounds and are widely used in sunscreen but also daily care compositions with UV protection.
[0007] However, while a plethora of different UV filters are known and have been used in the past, in recent years many of these filters became heavily discussed due to toxicological or environmental reasons. The development of sunscreens without these UV filters while retaining high sun protection factors as well as other desirable properties, such as water resistance, is challenging. In many cases, extensive reformulation is necessary and there are ongoing efforts to develop new sunscreen formulations that on the one hand meet regulations but on the other hand provide the same properties consumers are used to and expect.
[0008] There is thus need for novel personal care compositions that provide for excellent SPF as well as good water resistance without requiring any of the organic UV filter substances that are currently facing toxicological or environmental concerns.
[0009] The present invention meets this need in providing a type of personal care compositions that combines high SPF values with very good water resistance.
[0010] Summary of the invention

Unless defined otherwise, all technical and scientific terms used herein have the same meanings as commonly understood by one of ordinary skill in the art.
[0045] The term “sunscreen composition” refers to any topical product, which absorb and further may reflect certain parts of UV radiation. Thus, the term “sunscreen composition” is to be understood as not only including sunscreen compositions, but also any cosmetic compositions that provide UV protection. The term “topical product” refers to a product that is applied to the skin and can refer, e.g., to sprays, lotions, creams, oils, or gels, sticks, foams. The sunscreen composition may comprise one or more active agents, e.g., organic, or inorganic UV filters, as well as other ingredients or additives, e.g., emulsifiers, emollients, viscosity regulators, stabilizers, humectants, film formers, UV scattering compounds, UV boosters, pH adjusters, preservatives, moisturizers, anti-aging actives, vitamins, or fragrances. A sunscreen composition of the present invention may be formulated as a water-in oil or an oil-in-water dispersion, or an oil or oil-alcohol mixture, or a vesicular dispersion of an ionic or nonionic amphiphilic lipid, or a gel, or a solid stick, or an aerosol formulation.
[0046] The term “daily care composition” refers to any topical product, which absorbs and which may further reflect and scatter certain parts of UV radiation and is used as an everyday care product for the human body, e.g., for face or body. The daily care composition may comprise one or more active agents, e.g., organic and / or inorganic UV filters, as well as other ingredients or additives, e.g., emulsifiers, emollients, viscosity regulators, stabilizers, humectants, film formers, UV scattering compounds, UV boosters, pH adjusters, preservatives, moisturizers, anti-aging actives, vitamins, or fragrances.
[0047] Suitable daily care composition are according to the present invention, e.g., leave-on face and body care products.
[0048] Suitable leave-on products for face and body are, e.g., decorative preparations and skin care preparations.
[0049] Suitable decorative preparations are, e.g., lipsticks, nail varnishes, eye shadows, mascaras, dry and moist make-up, rouge, powders, depilatory agents, and suntan lotions.
[0050] Suitable skin care preparations are, e.g., moisturizing, refining, and lifting preparations. The cited daily care compositions can be in the form of creams, ointments, pastes, foams, gels, lotions, powders, makeups, sprays, sticks or aerosols.
[0051] The term “dicocoyl pentaerythrityl distearyl citrate”, as used herein, is the INCI name of mixed esters of C12-18 fatty acids, citric acid, pentaerythritol and stearyl alcohol having the CAS No. 130328-22-2. Said compound is, for example, commercially available from BASF SE under the tradename Cutina® Shine.
[0052] The term “UV-filter” as used herein refers to organic or inorganic compounds, which can absorb or reflect UV radiation caused by sunlight. UV-filter can be classified based on their UV absorbance protection curve as UVA, UVB or broadband filters. Preferably, the term “UV filter” comprises or consists of any UV filter as defined in the Annex VI (version of 11 November 2022) of the Regulation (EC) No 1223 / 2009 of the European Parliament and of the Council.
[0053] The definition of “broadband” protection (also referred to as broad-spectrum or broad protection) is based, for example, on the “critical wavelength”. For broadband coverage, UVB and UVA protection must be provided. According to the US and European requirements, a critical wavelength of at least 370 nm is required for achieving broad spectrum protection. Furthermore, it is recommended in Europe by the European Commission that all sunscreens should have an UVA protection factor, which is at least one third of the sun protection factor (SPF), e.g. if the sunscreen composition has an SPF of 30 the UVA protection factor has to be at least 10.
[0054] The term “critical wavelength” is defined as the wavelength at which the area under the UV absorbance spectrum (% absorbance protection versus wavelength) represents 90 % of the total area under the absorbance spectrum in the UV region (290-400 nm). For example, a critical wavelength of 370 nm indicates that the protection of the sunscreen composition is not limited to the wavelengths of UVB, i.e. wavelengths from 290-320 nm, but extends to 370 nm in such a way that 90 % of the total area under the absorbance spectrum in the UV region are reached at 370 nm.
[0055] The term “sun protection factor (SPF)” as used herein indicates how well the skin is protected by a sunscreen composition against erythema occurrence which is mainly caused by UVB radiation. In particular, the factor indicates how much longer the protected skin may be exposed to the sun without getting a sunburn in comparison to unprotected skin. For example, if a sunscreen composition with an SPF of 15 is evenly applied in an amount of 2mg / cm2to the skin of a person usually getting a sunburn after 10 minutes in the sun, the sunscreen allows the person to stay in the sun 15 times longer. In other words, SPF 15 means that 1 / 15 of the burning UV radiation will reach the skin, assuming sunscreen is applied evenly at a dosage of 2 milligrams per square centimeter (mg / cm2).
[0056] “Water resistance”, as used herein, relates to the property of a sunscreen product to remain on a surface after contact with water. “Water resistance” may be determined in vitro by spectroscopic measurements and can be based on the “solution method” in Sohn et al., Int J Cosmet Sci, “In vitro water resistance testing using SPF simulation based on spectroscopic analysis of rinsed sunscreens", 2018; DOI:10.1111 / ics.12455. The steps of sunscreen application and water immersion plus rinsing and spectroscopic measurements may be the same as described in Sohn et al. The sunscreen to be studied is applied on substrate plates made of ethylene methacrylate acid copolymer (described in Sohn et al., Skin Pharmacol Physiol, “Development of a Synthetic Substrate for the in vitro Performance Testing of Sunscreens”, 2017, 30:159-170) at an amount of 2 mg / cm2. Two sunscreen-covered plates are then immersed in a water bath and two are kept at ambient temperature in the dark. After immersion, each of the four plates (two subjected and two not subjected to water immersion) is rinsed with a solvent mixture composed of THF / Ethanol / Neutrol® TE (ex BASF SE) (50:48:2) to recover the UV filters remaining on the plates. The solvent / formulation solution is diluted (1 :40 dilution) and filled into a 1 cm quartz cuvette for UV spectroscopic measurements from 290 to 400nm in 5nm step using a Lambda 20 device. The result is obtained as transmittance data, converted into absorbance values, from which the area under the curve is calculated. The area under the curve is then used for the calculation of the percentage of the water resistance (%WR). If not indicated otherwise, the water resistance referred to herein has been determined according to described method.
[0057] “Water soluble UV filters” have a solubility in water of at least 2.0 wt.-%, preferably at least 3.0 wt.-%, more preferably at least 5.0 wt.-%. “Oil soluble UV filters” have a solubility in common cosmetic oils, such as Ci2-Ci5-alkyl benzoate, dibutyl adipate, diisopropyl sebacate, phenethyl benzoate, or dicaprylyl carbonate of at least 2.0 wt.-%, preferably at least 5.0 wt.-%, more preferably at least 7.0 wt.-%.
[0058] The term “insoluble UV filter” refers to UV filters that are not soluble in water and cosmetic oils at 25 °. These are also referred to herein as “particulate UV filters”.
[0059] It has surprisingly been found by the inventors of the present invention that the addition of a specific waxy compound, namely dicocoyl pentaerythrityl distearyl citrate, enhances the sun protection factor and water resistance of a UV filter-containing personal care composition not only relative to an identical composition without this wax, but also relative to compositions that comprise other waxy compounds, such as coco-glycerides, hydrogenated castor oil or lauryl laurate.

Preferably, the particulate UV filters have a particle size DN50 determined by light scattering of less than 2000 nm, preferably less than 1000 nm, more preferably less than 500 nm, wherein DN50 refers to the particle size value, where half of the population lies below this value, and half of the population lies above this value, i.e., the median value of the particle size volume distribution.
[0070] The compositions of the invention may additionally comprise inorganic UV filters. Suitable inorganic UV filters include, without limitation, titanium dioxide, zinc oxide, iron oxide, cerium oxide and mixtures thereof. In various embodiments, the inorganic UV filters may be applied as a nano material. In this connection it is to be understood that the term “nano material” follows the definition of the European Commission recommendation (201 1 / 696 / EU, 2022 / C229 / 01). Accordingly, in a nano material 50 % of particles, based on a number-based size distribution, are smaller than 100 nm, including constituent particles present in aggregates or agglomerates. In another embodiment of the present invention, the inorganic UV filters may be applied as a non-nano material. Accordingly, in a non-nano material more than 50 % of the particles, based on a number-based size distribution, are larger than 100 nm. It is also possible to use mixtures of nano and non-nano inorganic UV filters. Furthermore, the inorganic UV filters may be coated or uncoated. If present, titanium dioxide is preferably coated, as uncoated titanium dioxide is photocatalytic and should be avoided in sunscreens. Coatings suitable in the context of inorganic UV filters may be organic and / or inorganic and are, for instance, disclosed in WO 2023 / 036749 A1.

[0311] Said “increase” (of SPF) may be relative to the same composition free of dicocoyl pentaerythrityl distearyl citrate and may be by at least 10%, preferably at least 20%, more preferably at least 30%. Said increase in SPF may, in preferred embodiments, refer to the increase in SPF relative to another composition without dicocoyl pentaerythrityl distearyl citrate or relative to a composition that comprises another wax instead, such as hydrogenated coco-glycerides, hydrogenated castor oil or lauryl laurate.
[0312] In various embodiments, said increase in water resistance may also be relative to the same composition that comprises hydrogenated coco-glycerides, hydrogenated castor oil or lauryl laurate instead of dicocoyl pentaerythrityl distearyl citrate. Again, said increase may be by at least 10%, at least 20%, at least 30%, at least 40%, preferably at least by 50%, more preferably by at least 60% or at least 70%.
[0313] The present invention also relates to a method for increasing the water resistance or sun protection factor, in particular the SPF, of a personal care composition comprising at least one organic UV filter, such as those defined above, by incorporating dicocoyl pentaerythrityl distearyl citrate into said composition.
[0314] The incorporation may be by any suitable means, all of which are known to those skilled in the art.
[0315] It is to be understood that the above embodiments of the sunscreen or daily care composition are also applicable for the uses and methods of the present invention, and vice versa.
[0316] The present invention is further illustrated by the following non-limiting examples.
[0317] Examples
[0318] Methods
[0319] Water resistance in vitro solution method
[0320] The in vitro water resistance was determined from spectroscopic measurements and is based on the “solution method” in Sohn et al., Int J Cosmet Sci, “In vitro water resistance testing using SPF simulation based on spectroscopic analysis of rinsed sunscreens", 2018; DOI:10.11 11 / ics.12455. The steps of sunscreens application and water immersion plus rinsing and spectroscopic measurements are the same as described in Sohn et al.
[0321] Sunscreen application:
[0322] The sunscreen to be studied was applied on substrate plates made of ethylene methacrylate acid copolymer having the dimension of 5 cm x 5 cm (described in Sohn et al., Skin Pharmacol Physiol, “Development of a Synthetic Substrate for the in vitro Performance Testing of Sunscreens" , 2017,30:159-170; DOI: 10.1159 / 000464471). These conditions are understood to be the current most adequate approach for determining the in vitro water resistance of formulations.
[0323] On each plate an amount of 2 mg / cm2(corresponding to 50 mg of the formulation per plate) was applied. In total, four plates were prepared per sunscreen. After sunscreen application followed by an equilibration period of 15 min, two of the four plates were immersed in a water bath and the two remaining plates were kept at ambient temperature in dark.
[0324] Water immersion condition
[0325] The sunscreen-covered plates were attached using a system of strips from Tesa Hook & Loop tape at a defined height on the edges of a 1000-mL beaker (diameter of 10 cm). The beaker was filled with 500 mL of distilled water with controlled temperature of 30°C ± 2°C. The water was stirred with a speed of 300 rpm for 20 min using a three-bladed propeller stirrer in an equidistant position from the attached plates. Afterwards, the plates were removed from the emptied beaker and were allowed to dry at ambient temperature for 30 min before continuation. Spectroscopic measurements and determination of the water resistance value
[0326] After immersion, each of the four plates (two subjected and two not subjected to water immersion) was put in a separate beaker and washed using 20 mL of a solvent mixture composed of THF / ethanol / Neutrol® TE (ex BASF SE) (50:48:2). To collect the sunscreen from the plate, each plate was rinsed 10 times using the same solvent with a Pasteur pipette holding the plate out of the solvent with tweezers to remove visually the entire sunscreen residue from the substrate plate. The solvent / formulation solution was diluted (1 :40 dilution) and filled into a 1-cm quartz cuvette for UV spectroscopic measurements from 290 to 400 nm in 5 nm step using a Lambda 20 device. The water resistance retention was deduced from UV transmittance measurement of the respective sunscreen solution resulting from the washing of the substrate plate with and without water immersion. The transmittance data are then converted into absorbance data according to equation 2:
[0327] A(A) = -logT(A) Eq(2) wherein A(A) us the absorbance and T(A) the transmittance at wavelength A.
[0328] The area under the curve (AUC) for the two plates subjected (AUCwet) and not subjected to water immersion (A UCstatic) was calculated from the absorbance data, and used for the calculation of the percentage of the water resistance (%WR).
[0329] As different plates are used to determine the AUCwetand AUCstatic, the %WR is calculated from the ratio between the average wet and average static as described in the equation 3 below:
[0330] % WR =AUCwet.100, Eq (3)
[0331] AUCstatic wherein AUCwetis the average of the area under the absorbance curve for the two plates subjected to water immersion and AUCdryis the average of the area under the absorbance curve for the two plates no subjected to water immersion (dry).
[0332] SPF in vitro
[0333] SPF in vitro determination was based on the assessment of UV-transmittance through a thin film of sunscreen sample spread on roughened PMMA plates (SB6 PMMA-plates from Helioscreen, Creil, France). The sunscreen formulation to be tested was applied on the PMMA plate with an amount of 1 .2mg / cm2. The formulation was distributed manually as equally as possible on the plate. The plates applied with formulation are then stored 30 minutes at room temperature (22°C) and in a dark place prior the measurement.
[0334] In vitro transmission measurement was performed from 290-400 nm with 1 nm steps with the Labsphere UV Transmittance Analyzer UV 2000S. The UV transmission spectrum is then acquired, and the SPF in vitro was calculated according to equation below (mean SPF of all 15 values (from the three plates and 5 measurements per plate)) wherein, ser(A) is the erythema action spectrum and S(A) is the spectral irradiance received from the UV source and T(A) is the in vitro measured light transmittance.
[0335] SPF in vivo
[0336] The SPF in vivo was measured according to the norm ISO24444:2019 which uses the erythemal response of the skin to ultraviolet. The SPF in vivo is the ratio calculated from the energies required to induce a minimum erythemal response with and without tested sunscreen product applied to the skin of human test subjects.
[0337] Water resistance in vivo
[0338] The water resistance in vivo was evaluated by measuring the SPF in vivo (ISO24444:2019) before and after water immersion according to the norms 15016217:2020 and ISO18861 :2020
