Abstract
Description
Background Art
[0001] Toys are typically packaged and presented for sale or inspection. Usually, toys can be packaged in clear plastic display packages so that they can be seen and inspected before purchase. However, in some cases, toys are intentionally presented in a form that cannot be seen or inspected before purchase and opening of the package, as this increases the surprise and interest when discovering the contents of the package.
[0002] Toys packaged in this hidden manner can be packaged in combination with an edible item such as a candy, and such combinations are known to have broad appeal. However, the types of candies or other edible items for which toy packaging configurations are known to be easy to manufacture are limited, which limits the diversity of options available for this type of product. There is a desire to develop new packaging structures that combine an edible item and a toy in an attractive and easy-to-manufacture manner.

[0102] In the following detailed description, reference is made to the accompanying drawings, which form a part hereof, and which illustrate by way of specific configurations or examples. Referring now to the drawings, in which like reference numerals indicate like elements throughout several views, aspects of the novelty frozen confection will be described.
[0103] As Figures 1A - 12B shown, the novelty frozen confection includes a non - edible capsule 100 containing a novelty item 106 and a container 104 containing a frozen confection 102. The non - edible capsule 100 and how it is configured to be used with the novelty frozen confection is particularly important.
[0104] As Figure 1AAs shown, in one embodiment of the novelty frozen dessert, the container 104 is an edible container, particularly an ice cream cone. The capsule 100 defines a compartment within which the novelty item 106 is located, and the capsule 100 is located above the container 104.
[0105] In this embodiment, capsule 100 is not in direct contact with container 104 (i.e., ice cream cone), but is located on top of frozen confection 102 (which extends outside container 104). A separator (e.g., a paper disk) may be provided between capsule 100 and frozen confection 102 so that they are not in direct contact.
[0106] If Figure 1B As shown, capsule 100 may include first portion 108 and second portion 110 that are removably attached together to define a compartment for novelty item 106. Capsule 100 may be removed from container 104 and frozen confection 102 contained therein.
[0107] However, the first portion 108 and the second portion 110 may not necessarily be completely removable from one another, and may only be movably attached together, for example by a hinged connection, such as a living hinge.
[0108] The first portion 108 is shaped to provide the majority of the interior volume of the compartment housing the novelty item 106, and may be considered a hood. In this embodiment, the first portion 108 is substantially shaped as a hemispherical dome.
[0109] The second portion 110 is located above the exposed portion 112 of the frozen confection 102 that fills the container 104 and may be in direct contact with the exposed portion 112. The second portion 110 may be considered a closure to the cover (ie, the first portion 108).
[0110] In this embodiment, the section of the frozen confection 102 that extends out of the container 104 may have sides parallel to the cone, so that the frozen confection 102 is a continuation of the conical shape of the container 104. This section terminates in an exposed portion 112, which is actually an end face of the conical shape.
[0111] If Figure 1C As shown, first portion 108 includes an open end within which second portion 110 may be located. Thus, removal of second portion 110 from the open end provides access to novelty item 106. The peripheral shape of the open end preferably generally matches the peripheral shape of exposed portion 112 of frozen confection 102, which, for an ice cream cone, is circular. Thus, their diameters may be generally the same.
[0112] Similarly, the second portion 110 includes a surface 116 having a perimeter that generally matches the perimeter of the exposed portion 112 of the frozen confection 102, which is circular in the case of an ice cream cone. In this embodiment, the surface 116 is configured to have a swirl pattern that may be complementary to a swirl pattern formed in the exposed portion 112 of the frozen confection 102.
[0113] The swirl pattern in the surface 116 itself can form a complementary swirl pattern in the exposed portion 112 of the frozen confection 102 by pressing the two together during manufacture. This can occur if the capsule 100 is positioned on the exposed portion 112 before the frozen confection 102 is fully frozen.
[0114] As Figure 1C and Figure 1D shown, the first portion 108 can include a peripheral lip 114 around the open end, which can surround the main shape formed by the first portion 108 (e.g., a hemisphere as shown). The peripheral lip 114 can be set at an angle that matches the angle of the container 104, so the peripheral lip 114 can effectively serve as a continuation of the conical shape of the container 104 (and the section of the frozen confection 102 extending therefrom).
[0115] As Figure 1E shown, the second portion 110 preferably includes a tab 118 located on its outer edge. The tab 118 can facilitate easier manual separation of the first portion 108 and the second portion 110. The first portion 108 can also include a cutout formed in its outer circumference (including in the peripheral lip 114) through which the tab 118 can be accessed.
[0116] As Figure 1F shown, the second portion 110 can include one or more ridges 120 at its outer edge, which are configured to mate with ridges inside the open end of the first portion 108. This facilitates releasable attachment therebetween while achieving a sufficient degree of retention. Thus, the engagement is effectively a push-fit or snap-fit. Alternative engagement means can include a threaded connection, a frangible connection, an adhesive bond connection, or a tear connection.
[0117] As Figure 1G shown, the novelty frozen confection preferably further includes a removable wrapper 124 that surrounds at least a portion of the container 104 and the capsule 100. The capsule 100 is thereby secured to the container 104 by the removable wrapper 124.
[0118] Preferably, the removable wrapper 124 lies flat against the ice cream cone and the peripheral lip 114 (if angled as described above), and together they form an effectively continuous cone. The removable wrapper 124 can be folded over the lip of the peripheral lip 114 to improve consolidation, or alternatively it can extend over the entire capsule 100.
[0119] The removable wrapper 124 can be at least partially adhered to the capsule 100 to improve consolidation, for example it can be adhered to the peripheral lip 114.
[0120] In use, the consumer 124 can peel off the removable wrapper 124 to remove the capsule 100 from the container 104 (i.e., the ice cream cone). By removing the capsule 100, the consumer 124 obtains the frozen confection 102 for consumption. Then, the consumer 124 can separate the second part 110 from the first part 108 to obtain the novelty item 106.
[0121] The removable wrapper 124 can include a frangible area to facilitate removal. It can include a shrink or elastic wrapper to facilitate the consolidation of the container 104 to the capsule 100.
[0122] The novelty item 106 can be a toy, such as a figurine. However, various other items subject to space constraints may be suitable, including edible items, such as a second form of confection. The novelty item 106 can be a single piece, or it can include separate components that can be assembled once removed from the capsule 100. Such components can be provided in a flexible bag inside the capsule 100.
[0123] In the embodiment shown above, the capsule 100 completely encloses the novelty item 106, i.e., the compartment is defined only by the capsule 100, particularly by its first part 108 and second part 110. However, in an alternative embodiment, the capsule 100 can only completely enclose the novelty item 106 together with the container 104, i.e., they together define the compartment.
[0124] The non - edible capsule 100 is preferably made of plastic, but can alternatively be made of some other food - safe material. It can be injection - molded or made using some other manufacturing technique.
[0125] The frozen confection 102 is preferably ice cream, but can also be sorbet, ice milk, frozen yogurt, or any other suitable frozen confection. It can contain other forms of candy or edible items as toppings or distributed throughout, such as gummy bears, chocolate, nuts, or syrup. The container 104, which is an edible cone in this embodiment, can be a waffle cone.
[0126] The frozen confection 102 and its container 104 may be manufactured together in a typical manner known in the art for pre-packaged frozen confections in cones, the difference being that the capsule 100 is consolidated with the container 104 during the packaging process.
[0127] Figure 2A and 2B An alternative embodiment of the capsule 100 is shown in which the surface 116 of the second portion 110 is planar rather than having a swirl pattern.
[0128] Figures 3A to 11B Various alternative embodiments of capsule 100 are shown that differ only in the shape of their first portion 108. It will be appreciated that such shape variations may be primarily aesthetic and that more shapes than those depicted may be suitable for first portion 108, but each variation shown will be briefly described herein.
[0129] Figure 3A and 3B An alternative embodiment of the capsule 100 is shown in which the first portion 108 is shaped as a crown. The peripheral lip 114 is ridged so as to mimic the crown shape, but is still angled so that it can serve as a suitable surface for contact with the removable wrapper 124.
[0130] Figure 4A and 4B An alternative embodiment of the capsule 100 is shown in which the first portion 108 is shaped as a gemstone, which can also be considered a faceted cover. This embodiment does not have a peripheral lip 114, although the gemstone-shaped face can be used as a contact surface for a removable wrapper 124. The shape of the open end of the first portion 108 remains rounded to match the container 104.
[0131] Figure 5A and 5B An alternative embodiment of the capsule 100 is shown in which the first portion 108 is shaped as an ellipsoid (truncated by an open end). This shape can be configured to resemble a "single scoop" of ice cream. This embodiment does not have the peripheral lip 114.
[0132] Figure 6A and 6B An alternative embodiment of the capsule 100 is shown in which the first portion 108 is shaped as a truncated cone.
[0133] Figure 7A and 7B An alternative embodiment of the capsule 100 is shown in which the first portion 108 is shaped as a cylinder (which may have rounded edges).
[0134] Figure 8A and 8B An alternative embodiment of the capsule 100 is shown in which the first portion 108 is shaped as a cone.
[0135] Figure 9A and 9B An alternative embodiment of the capsule 100 is shown in which the first portion 108 is shaped as two vertically connected ellipsoids (one truncated by an open end). This shape can be configured to resemble a "double scoop" ice cream.
[0136] Figure 10A and 10B An alternative embodiment of the capsule 100 is shown in which the first portion 108 is shaped as three perpendicularly connected ellipsoids (one truncated by an open end). This shape can be configured to resemble a "three scoops" of ice cream.
[0137] Figure 11A and 11B An alternative embodiment of the capsule 100 is shown in which the first portion 108 is shaped as three connected ellipsoids arranged in a triangular shape. Open ends are formed in two of the ellipsoids. The shape may be configured to resemble a triangular "three scoops" of ice cream.
[0138] Figures 6A to 11B All embodiments of also have a peripheral lip 114 surrounding the main shape of the first portion 108.
[0139] If Figure 12A As shown, in another embodiment of the novel frozen dessert, the container 104 is a non-edible container 204, such as a cup, which contains the frozen dessert 102. The capsule 100 is secured to the non-edible container in a different manner than the previously described edible container (i.e., ice cream cone) embodiment.
[0140] If Figure 12B As shown, the non-edible container preferably includes a container edge 205, and the capsule 100 is placed on the container edge 205. The capsule 100 can be adapted to releasably engage with the container edge 205, for example, using a groove formed between the first part 108 and the second part 110, or by using a shield extending from the first part 108, so that the capsule 100 can be connected in the same manner as a conventional plastic cover.
[0141] Alternatively, the capsule 100 may be at least partially seated within the container rim 205, for example the peripheral lip 114 may be at least partially seated within the container rim 205, and the angle of the container wall may prevent the capsule 100 from sliding below a certain height.
[0142] For some purposes, the releasable engagement of the capsule 100 with the container rim 205 can be a sufficient degree of consolidation between the capsule 100 and the non - edible container 204 (such as a cup) such that no removable wrapper 124 is required. For example, a novelty frozen dessert can be prepared and served in a restaurant by filling the non - edible container with the frozen confection 102 and then securing the capsule 100 to the container rim 205.
[0143] However, if the novelty frozen dessert is to be manufactured as a prepackaged product suitable for transportation and distribution, it may be preferable to increase the degree of consolidation between the non - edible container 204 and the capsule 100 by applying a removable wrapper 124, which is applied in the same manner as described for the aforementioned ice cream cone.
[0144] When configured for use with the non - edible container 204, the capsule 100 can be substantially the same as an ice cream cone, although its size and shape can vary or can be modified to engage the aforementioned container rim 205.
[0145] However, the use with the non - edible container 204 can facilitate some alternative configurations of the capsule 100. For example, the capsule 100 may not be formed by a first part 108 and a second part 110 that are removably attached together. Instead, the capsule 100 can include only the first part 108, and it can define a compartment for the novelty item 106 in a different way in conjunction with the non - edible container 204.
[0146] To give a more specific example, the non - edible container 204 can include a peel - away layer heat - sealed to its container rim 205. Then, the capsule 100 (i.e., the first part 108) can be located above the peel - away layer such that the novelty item 106 is located therebetween and remains separated from the frozen confection 102. Thus, the compartment is defined by the peel - away layer and the first part 108. Once the first part 108 has been removed to allow access to the novelty item 108, the peel - away layer can then be peeled away to allow access to the frozen confection 102.
[0147] In any case, any of the previously described shapes of the first part 108 can also be applied to the capsule 110 of this embodiment.
[0148] Preferably, the non - edible container 204 is made of plastic and is preferably molded into a cup, i.e., a frustum of a cone. However, it can also be a paper cup, or have some other shape that can hold the frozen confection 102. For example, the non - edible container 204 can be cylindrical or conical.
[0149] The present invention can also be broadly said to include the components, elements and features separately or jointly mentioned or pointed out in the specification of the present application, as well as any or all combinations of any two or more of said components, elements or features, and the specific integers mentioned herein have known equivalents in the field to which the present invention pertains, and these known equivalents are considered to be incorporated herein as if set forth separately.
