The unloading overturning preventing device comprises a driving device, a cross beam, and a plurality of telescopic landing legs, wherein the telescopic landing legs are fixedly connected with the cross beam; and the landing legs are driven to be stretched and contracted through the driving device. The invention further provides the ship loading and unloading machine. The unloading overturning preventing device provided by the invention is novel in structure, and a frame of the ship loading and unloading machine can be slightly jacked up, therefore, the pressure on tires can be effectively reduced, thus, a mechanism of the cart can be protected. The unloading overturning preventing device is connected with the ship loading and unloading machine through bolts, so as to facilitate assembly and disassembly. During use, the landing legs of the unloading overturning preventing device are contacted with a ship body, so that the stability of the ship loading and unloading machine can be improved, and the safety of the ship loading and unloading machine in transporting on the sea can be ensured.
